unto W. Lee Roland and Rosalie H. Roland, husband and wife.
NOW THEREFORE, THIS AGREEFIENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
STIPULATION AGAINST LIENS
THIS AGREEMENT made the i~%~ay of March, 2004, by and
between W. LEE ROLAND, Builder, of 101 Windrush Lane,
Mechanicsburg, PA 17055, hereinafter referred to as Contractor,
AND W. LEE ROLAND and ROSALIE H. ROLAND, husband and wife, of 104
Lavynndon Lane, Mechanicsburg, PA 17055, hereinafter referred to
as Owner, whereby the former undertook and agreed to erect and
construct a single-family residential dwelling on that certain
lot of ground situate on 5017 Hart Crossing in Lower Allen
To.wnship, Cumberland County, Pennsylvania, being Lot No. 38,
Phase I Final Subdivision Plan for The Manor at Fair Oaks, dated
April 22, 2002, last revised August 30, 2002, said plan being
recorded in Plan Book 86, Page 1. Being a part of the same
premises which Susan M. Ritter, by her Attorney-in-Fact Cecelia
J. Stoner, by Deed dated September 11, 2002 and recorded in the
Cumberland Recorder of Deeds Office in Deed Book 0253, Page 2871,
granted and conveyed unto R, Hart Enterprises, Inc. Also being
the same premises which R. Hart Enterprises, Inc., by Deed dated
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relin~ish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
WIT~SS our hands and seals, or if a corporation, it has
caused these presents to be signed by its proper corporate
officers and its corporate seal to be affixed hereto, the day and
year above written.
