Whereas Charles E. Cain, II and Christina L. Cain, H/W, of Cumberland, Pennsylvania, is about to execute
contemporaneously herewith, a contract, with Pat-Mar Builders, of York Haven, Pennsylvania, for the erection of a one story
dwelling building upon a lot of le~d situate in East Pennsboro Township, Cumberland County, Pennsylvania, more
particularly bounded and described as follows, to wit:
ALL THAT CERTAIN part or parcel of land erected situate in East Pennsboro Township, Cumberland County, Pennsylvania,
being Lot No. 2-A of the Final Subdivision Plan for Nell M. and Barbara A. ~eitzer as recorded in the 0~ce of the Recorder of Deeds
in and for Cumberland County, Pennsylvania, in Plan Book 78 at page 124, more particularly described as follows:
BEGINNING at a point along the intersection of the existing dedicated right-of-way line for Creekside Drive and lands now
or formerly of Michael T. Reed and Becky A. ~nuby South 66 degrees 33 minutes 13 seconds East a distance of 294.33 feet to a point
at the edge of the Condoquinet Creek, South 34 degrees 01 minutes 26 seconds West a distance of 62.41 feet to a point along said
creek; thence South 27 degrees 11 minutes 13 seconds West a distance of 109.83 feet to a point along said creek at the intersection of
other lands now or formerly of Nell M. and Barbara A. Xreitzer; thence along said lands now or formerly of Nell M. and Barbara A.
~eituer North 64 degrees 14 minutes 89 seconds West a distance of 271.23 feet to a point along the existing dedicated right-of-way
line of Creedside Drive; thence along the existing dedicated right-of-way line of Creekside Drive North 21 degrees 48 minutes 05 seconds
East a distance of 160.10 feet to a point, the place of BEGINNING.
BEING PART OF THE SAME PREMISES which James M. l~eitzer, by his deed dated August 28, 1985, and recorded
August 28, 1985 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 31, Volume "L", at
page 384, grated and conveyed unto Nell M. Kreitzer and Barbara A. ~reitzer, husband and wife. The said Barbara ~. Kreitzer
departed this life on January 16, 2000, thereby vesting title as the surviving entireties tenant unto Nell M. Kreitzer, 6rantor herein.
AND BEING pa~t of the same premises which James M. Kreitzer, by his deed dated
October 17, 2003, and recorded in the Cumberland County Recorder of Deeds office
in Book 259, Page 4856, granted and conveyed to Charles E. Cain, II and
Christina L. Cain, his wife.
Now, February ~O , 2004, at the time of and immediately before the execution of the principal contract, and before any
authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials
for the same in consideration of the making of the said contract with Pat-Mar Builders and the further consideration of One Dollar,
to Contractor paid by Charles E. Cain, II and Christina L. Cain, H/W it is agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.
