THIS AGREEMENT made the 5TH day of MARCH, 2004
by and between
WILLIAM H. GOODLING, CONSTRUCTION
hereinafter referred to as Contractor,
AND
WILLIAM H. GOODLINGAND KELLY J. GOODLING, H/W
hereinafter referred to as Owner, whereby the former undertook and agreed to construct a
single family dwelling, in LOT %133-2315 LONGWOOD LANE, HAMPDEN TOW~NSHIP, ENOLA, PA 17025,

NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ~o it in hand paid
by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under them, covenant and agree that no mechanic's liens or
claims shall be filed or maintained by them or any of them against the said buildings and
the lot of ground appurtenant rhereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims agains~ the said buildings or any of them, and agree that this instrument,
waiving the right of lien, shall be an independant covenant.

LEGAL DESCRIPTION
ALL that certain piece, parcel or lot of land situate in Hampden Township, Cumberland
County, Pennsylvania, and bounded and described as follows:
BEGINNING at a point on the Eastern right-of-way lin. e of Longwood Lane (50.00 feet
wide), said point being located at the Southwestern'corner of Lot No. 134; then along the
Southern boundary line of Lot No. 134, and through a 20.00 foot wide stormwater easement,
North 88 degrees 30 minutes 15 second East, for a distance of 119.95 feet, to a point in line of
other lands now or formerly of The McNaughton Company; then along said other lands now or
formerly of MCNaughton and along the centertine of said 20.00 foot wide stormwater easement,
South 10 degrees 35 minutes 45 seconds East, for a distance uf 90.02 feet, to a point in line of
other lands now or formerly of The McNaughton Company; then along the said other lands of
McNanghton, South 79 degrees 24 minutes 15 seconds West, for a distance of 125.00 feet, to a
point on the Eastern right-of-way line of Longwood Lane (50.00 feet wide); then along said
right-of-way North 10 degrees 35 minutes 45 seconds West, for a distance of 30.20 feet, to a
point on the arc of a circle cra-ring to the right, having a radius of 475.00 feet, and an arc length
of 75.44 feet, to a point along same; then North 01 degrees 29 minutes 45 seconds West, for a
distance of 3.70 feet, to a point a the place of BEGINNING.
This piece, parcel or lot of land consists of approximately 12,328 square feet of land, has an
address of 2325 Longwood Lane, and is known and numbered as Lot No. 133 on the Final
Subdivision Plan for Westhury - Phases VIIA and VIIB, which is recorded in Cumberland
Comity in Plan Book 86, Page 4.
BEING THE SAME PREMISES which-The McNaughton Company by its Deed
dated'~~ ~' ,2004 and about to be recorded in the
Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, granted and conveyed unto William H. Goodling and
Kelly J. Goodling, h/w, Mortgagors herein.
