COMPLAINT
The above Plaintiff brings this action against the above Defendant to recover the sum of
$25,487.40, with interest thereon as hereinafter stated, upon the following cause of action:
1. Plaintiff, GOLDEN PALM CASINO N.V. d/b/a Dolphin Casino, is located at
Simpson Bay Road, Sunset Building, No. 111, St. Maarten, Neth Ant.
2. Defendant, DEMETRIOS KARAGIANNIS also known as JIM
KARAGIANNIS, is located at 249 Winding Hill Road, Box 1126, Mechanicsburg PA 17055.

3. Plaintiff, at Defendant's request, granted credit in the amount of $19,000.00 and
Defendant subsequently executed counter checks to the Plaintiff. True and correct copies of the
counter checks are attached hereto, made a part hereof and marked Exhibit "A."
4. The checks have not been honored by Defendant. Therefore, Defendant is
indebted to Plaintiff and obligated to Plaintiff in the amount of $19,000.00.
5. The prices charged for the aforesaid items are just and reasonable and are those
which Defendant promised to pay Plaintiff.
6. Defendant received and accepted the benefit of receiving said monies described in
the exhibits, and a total principal amount which became due as a result thereof, after allowance
for all proper credits for payments and/or returned merchandise, if any, was $19,000.00.
7. Plaintiff is also entitled to receive interest on the above amount determined by
applying the statutory interest rate of 6.00% per annum to the past due balance. As of September
3, 2008 the total amount of interest due to Plaintiff is $2,011.40.
8. Plaintiff is entitled to have the 6.00% interest charge continue to accrue as set
forth above, from September 3, 2008 on down to the date of judgment in this matter.
9. Defendant further agreed to pay Plaintiff s reasonable attorneys' fees incurred in the
collection of any balance due Plaintiff. Presently, Plaintiff is due attorneys' fees in the amount of
$4,476.00, for a total due of $25,487.40.
10. Plaintiff has made demand against Defendant for the aforesaid sum, but Defendant
failed or refused to pay the same or any part thereof.
WHEREFORE, Plaintiff demandsjudgment against Defendant for $25,487.40 together with
the continually accruing interest charge at the statutory rate of 6.00% per annum from September
3, 2008, and cost of suit.
COUNT II
Alternative to Count I - Unjust Enrichment
11. Plaintiff incorporates the allegations of every paragraph enumerated above of this
Complaint as if said paragraphs were fully set forth here at length.
12. At Defendant's request, Plaintiff conferred a benefit upon Defendant by providing
the goods, wares, merchandise and/or services described in the exhibits attached hereto.
13. Defendant received and accepted the benefit of said goods, wares, merchandise
and/or services provided by Plaintiff.
14. At all times material hereto, Defendant was aware that Plaintiff was providing the
aforesaid goods, wares, merchandise and/or services to Defendant and that Plaintiff expected to be
paid for such.
15. At all times material hereto, Defendant, with the aforesaid knowledge, permitted
Plaintiff to provide said goods, wares, merchandise and/or services and to incur damages.
16. At all times material hereto, Defendant was unjustly enriched by retaining the benefit
of receiving said goods, wares, merchandise and/or services without paying Plaintiff fair and
reasonable compensation.
17. Allowing Defendant to retain the benefit of said goods, wares, merchandise and/or
services without paying fair compensation would be unjust.
18. By reason of the aforesaid unjust enrichment of Defendant at Plaintiffs expense, an
implied contract exists between Plaintiff and Defendant and Defendant is obligated to pay Plaintiff
the quantum meruit value of the goods, wares, merchandise, and/or services described in the exhibits
attached hereto in the amount of $19,000.00.
WHEREFORE, Plaintiff demands judgment against Defendant for $19,000.00 together with
the continually accruing interest charge at the statutory rate of 6.00% per annum from September
3, 2008, costs of suit and all other relief to which Plaintiff may be entitled.

to her marriage to defendant, Demetrios Karagiannis, and all such property is presumed
to be held as tenants by the entireties. "It is the actual marital status and not necessarily
the words stated or omitted in the instrument that determines [a] right to take as tenants
by the entireties." Constitution Bank v. Olsen et al, 423 Pa.Super. 134, 142, 640 A.2d
1146, 1150 (1993). Claimant and defendant were married on February 12, 1967 and have
been married from that date to the present.

03/19/2009 05:21 PM - Noah Cline, Deputy Sheriff, who being duly sworn according to law, states that on March 19,
2009 at 1721 hours, he served a true copy of the within writ of execution, upon the defendant, to wit:
Demetrios Karagiannis a/k/a Jim Karagiannis, by making known unto Demetrios Karagiannis a/k/a Jim
Karagiannis, at 249 Winding Hill Road, Mechanicsburg, Cumberland County, Pennsylvania its contents
and at the same time handing to him personally the said true and correct copy of the same. Upon serving
the writ of execution, a levy was completed. Postcard mailed to attorney and letter mailed to defendant on
03-23-09.
04/01/2009 On April 1, 2009 at 1050 hours, I received a property claim on this case. The property claim was filed by
attorney James Kollas on behalf of Phyllis Karagiannis, wife of the defendant, claiming all items on
sheriffs levy.
The registrations were run through PennDot and it was learned that the vehicles are registered solely to
the defendant, thereby making them exempt from the property claim. Notices of property claim were
mailed on
04-01-09 to attorney Amato (plaintiffs attorney) and to attorney James Kollas (attorney for defendant and
claimant).
04/09/2009 On April 9, 2009 1 received a property claim filed on behalf of Nissan - Infiniti LT. Inc. by attorney David A.
Scott. This property claim was for the two vehicles listed on the levy.
04/13/2010 Ronny R. Anderson, Sheriff, who being duly sworn according to law, states this writ of execution is
returned as ABANDONED. No action on writ in over 6 months.
SHERIFF COST: $105.11
