COMPLAINT
AND NOW, comes the Plaintiff, Zunny A. Santiago, by his attorney,
William A. Addams, and files the following complaint.
1. The plaintiff is Zunny A. Santiago, an adult individual residing at 821
South Queen St., York, PA.
2. The defendant is Devin A. Oberry, an adult individual residing at 2
Gray Place, Mechanicsburg, PA 17055.
3. On May 29, 2007, the plaintiff was the owner of a 2005 Toyota Scion
which was lawfully parked in the 700 block of McKenzie Ave. in York, PA.
4. At about 2:20 PM on May 29, 2007, the defendant was driving a vehicle
traveling on McKenzie Ave. when he negligently and carelessly collided with the
plaintiff's parked car causing the damages hereinafter set forth.
5. The defendant was negligence and careless in:
a. failing to have his vehicle under control.
b. reckless driving.
6. As a result of the negligence and carelessness of the defendant, the
plaintiff's vehicle was a total loss. The vehicle had an actual cash value of
$16,818.93 and a net salvage value of $2,092.50 resulting in a loss of $14,226.43. In
addition the plaintiff incurred rental expense of $1,146.01.
WHEREFORE, the plaintiff demands judgment against the defendant in
the amount of $15,272.44, plus interest and costs of suit, an amount within the
jurisdiction of arbitration under the local rules of court.
