PETITION FOR SETTLEMENT OF SMALL ESTATE
Your petitioner is Catherine A. Stuart, who is the surviving spouse and
administrator of the estate of Samuel Stuart.
2. Petitioner is 76 years of age and had been married to the decedent for
almost 47 years prior to his death.
3. Samuel Stuart died on the 3rd day of December 2004, at 5:45 o'clock
a.m., and at the time of death the decedent's last principal residence was 351 Dickinson
School Road, Carlisle, Cumberland County, Pennsylvania.
4. The above-named decedent died intestate and no letters of administration
have been issued.

6. The decedent was survived by Catherine A. Stuart, which is tl'~e

7. The total value of the decedent's personal estate is less than $25,000 and
in the estate of the decedent as heirs or next of kin are as follows:

8. The expenses of the decedent's last illness and funeral have been paid,
and there are no unpaid creditors of the decedent.
9. Because the sole heir is the surviving spouse, and the spousal Inheritance
Tax rate is 0.00%, there is no Inheritance Due to the Commonwealth of Pennsylvania.
10. It is proposed that the following distribution of the decedent's personal
estate be made to the following heirs or next of kin.

WHEREFORE, your petition respectfully requests your Honorable Court to order
PNC Bank to distribute the value of the decedent's account # 500392.4201 to the
surviving spouse and to order Transamerica Life Companies to transfer ownership of
policy #92126367 to the surviving spouse who is entitle thereto as set forth in
Paragraph 10 above.
