Petitioner was appointed as Administratrix of the Estate of Blake A. Myers, deceased, by the Register of Wills of in and for Cumberland County on April 18, 2007. A true and correct copy of the Register of Wills Certificate is attached hereto and incorporated by reference herein as Exhibit "A". 2. The sole beneficiary of the said Estate was Petitioner and Petitioner has settled all claims in the Estate, namely, the claim of Deausen Enterprises, Inc. and Mr. Ramon Penela as evidenced by the Satisfaction and Release Agreement attached hereto and marked as Exhibit «B„ 3. There are no other claims in the Estate to Petitioner's knowledge. WHEREFORE, Petitioner, Christina M. Myers, respectfully requests this Honorable Court enter an Order discharging her from the duties of the office of Administratrix and that she be released from future liability for acts as Administratrix of the Estate of Blake A. Q r ORPHANS' COURT DIVISION IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY ESTATE OF BLAKE A. MYERS, DECEASED ESTATE NO. 381 OF 2007 RECEIPT AND RELEASE AGREEMENT The circumstances leading up to execution of this Instrument are as follows: 1. Blake A. Myers, hereinafter referred to as "the Decedent" died on January 15, 2007, a resident of 9 Ryan Drive, South Middleton Township, Cumberland County, Pennsylvania. 2. The Decedent died Intestate and a Petition for Letters of Administration were filed with the Register of Wills of Cumberland County on April 18, 2007 and Letters of Administration were granted the same day to Christina M. Myers, as Administratrix of the Estate of the Decedent, hereinafter referred to as "Administratrix". 3. Decedent had a safe deposit box number 4046 which box was maintained at M&T Bank, One West High Street, Carlisle, Pennsylvania. 4. On September 18, 2007, the Administratrix caused an Inventory of the safe deposit box was made and contained therein were 25 U.S. Silver Dollar coins. The said safe deposit box account was made payable on death to Ms. Anita Lanious, 296 Heiser's Lane, Carlisle, Pennsylvania, 17015. 5. The Administratrix caused the U.S. Silver Dollar coins to be appraised on September 25, 2007 by Ochman's Coins & Jewelry, 18 Church Street, Dallas, Pennsylvania, 18612 and the said coins were appraised as having a total value of $159.50. A copy of the said appraisal of Ochman's Coins & Jewelry is attached hereto and marked as Exhibit "A". 6. Ms. Anita Lanious as beneficiary of the contents of the safe deposit box number 4046 located at M&T Bank, One West High Street, Carlisle, Pennsylvania, acknowledges the receipt of the 25 U.S. Silver Dollar coins which were contained within the said safe deposit box number 4046. Ms. Anita Lanious agrees to refund to the Administratrix any amount which may be at any time determined to have been an erroneous distribution to her regardless of the cause of distribution and agrees that any period or limitation of the absence of reflection of any erroneous distribution shall commence only at such time as Administratrix shall have obtained actual knowledge of such erroneous distribution and that no event shall the period of collection of any erroneous distribution be less than two (2) years after the discovery thereof. 8. Ms. Anita Lanious agrees that the Orphan's Court Division, Court of Common Pleas of Cumberland County, Pennsylvania, made by its decree, confirm the account of the Administratrix and discharge the Administratrix. 9. Ms. Anita Lanious agrees to indemnify and hold harmless, Christina M. Myers, as Administratrix, or in her individual capacity, or both from any liability or possible expense (including but not limited to costs and counsel fees) as a result of this distribution made by her pursuant to this instrument and without the filing, audit, adjudication and confirmation of an account. 10. Ms. Anita Lanious declares it to be her intention that this instrument be governed by the laws of the Commonwealth of Pennsylvania and that it shall be legally and binding upon her heirs, executors and administrators and assigns.
