I write to confirm my telephone message to you regarding the above-captioned
matter.
I am the attorney for Philip D. New, Executor of the above Estate, which was
opened solely for the purpose of a Wrongful Death/Survival Action litigation in
Cumberland County, Pennsylvania.
The caption of that litigation, which is currently pending in Cumberland County, is
<~s follows: Philip D. New, as Executor of the Estate of lda N. Tonui v. Henry K. Smith,
D.O., A/K/A Henry K. Smith, M. D., and Smith Radiology, Inc., Docket No. 05-3875.
On behalf of Philip New, I ask that you postpone any further action pending
completion of this litigation. It is currently anticipated that it will go to trial in the Spring
of 2009.
