HomeMy WebLinkAbout04-1347 STIPULATION AGAINST LIENS THIS AGREEMENT made th~. day of and between Yanek Homes, Inc. Contractor, AND Alfred Blank and Lori A. Blank, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Lot 92 McCoy Lane, Carlisle, Dickinson Township, Cumberland, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to Yanek Custom Homes, Inc. in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Yanek ~Z ~ ~, ~~(Sea,) L~i A~ Blank ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point along the northern right-of-way line of Seneca Circle at the dividing line between Lots 92 and 93 on the hereinafter mentioned Final Subdivision land; thence by said dividing line, North 08 degrees 39 minutes 19 seconds West 144.77 feet to a point; thence by the dividing line between Lots 91 and 92 on said plan, North 77 degrees 57 minutes 47 seconds East 285.38 feet to a point; thence along the western right-of-way line of McCoy Lane by a line curving to the right having a radius of 500.00 feet and an arc length of 29.51 feet to a point; thence continuing along the western right-of-way line of McCoy Lane, South 08 degrees 39 minutes 19 seconds East 112.11 feet to a point; thence along a line curving to the right along the western right-of-way line of the intersection of McCoy Lane and Seneca Cimle, having a radius of 20.00 feet and an arc length of 31.42 feet to a point; thence along the northern right-of-way line of Seneca Circle, South 81 degrees 20 minutes 41 seconds West 265.75 feet to a point, the place of BEGINNING. CONTAINING a gross area of 43, 686 square feet and being Lot No. 92 on a Final Subdivision Plan for Phase No. 2 of Callaptscink, recorded in the Office of the Recorder of Deeds in and for Cumberland County, in Plan Book 74, Page 141. BEING THE SAME PREMISES which Wilbert L. Diehl and Shryte M. Diehl and D & S Custom Homes, by their deed to be recorded simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Alfred Blank and Lori A. Blank.
