NOW. November 5, 2001 t~ . at the time of and immediately before the execution of the prin-
cipal contract, and before any authority has been given by the said Rosalie B. Myers
to the said Haubert Homes INc.
to commence work on the said building, or purchase materials for the same in consideration of the making of the said
contract with
Haubert Homes Inc. and the further
consideration of One Dollar. to Haubert Homes Inc. paid
by Rosalie B. Myers , it m agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any
labor, or materials purchased, or extra labor or materials purchased )'or the erection of said building, the right to Hie such
liens being expressly waived.

BEGINNTNG at a point located on the eastern right-of-way line of Sconset~ Way, Twenty-five
Feet (25') from the centerline of the s~me and along lands of Phase 3 of the Heights of Beacon
II/Il.
THENCE along said right-of-way, with a curve to the left having a Radius of one hundred
seventy-five and zero hundredths feet, an arc length of fifty-eight and twenty-seven hundredths
feet, a bearing of North thirty-one degrees thirty minutes four seconds East with a distance of
fifty-eight and zero hundredths feet (R= 175.00', A=58.27', N 31° 30' 04' E - 58.00') to a point on
the same and the front property corner with lot # 132.
THENCE leaving said right-of-way and along the property line with said lot, South sixty-eight
degrees two minutes sixteen seconds East, a distance of one hundred sixty-five and fifty-two
