CIVIL ACTION/MORTGAGE FORECLOSURE
1. Plaintiff is Beneficial Consumer Discount Company d/b/a Beneficial Mortgage
Company of Pennsylvania, a corporation duly organized under the laws of Pennsylvania and doing
business at the above captioned address.
2. The Defendant is Linda R. Bonner adk/a Linda Bonner, who is one of the mortgagors
and real owners of the mortgaged property hereinafter described, and her last-known address is 1023
York Road, Dillsburg, PA 17019.
3. The Defendant is Clyde L. Bertram a/k/a Clyde N. Bertram, who is one of the
mortgagors and real owners of the mortgaged property hereinafter described, and his last-known
address is 1023 York Road, Dillsburg, PA 17019.
4. On 06/26/2001, mortgagors made, executed and delivered a mortgage upon the
premises hereinafter described to Plaintiff which mortgage is recorded in the Office of the Recorder
of Cumberland County in Mortgage Book 1725, Page 1092.
5. The premises subject to said mortgage is described in the mortgage attached as
Exhibit "A" and is known as 1023 York Road, Dillsburg, PA 17019.
6. The mortgage is in default because monthly payments of principal and interest upon
said mortgage due 05/26/2002 and each month thereafter are due and unpaid, and by the terms of
said mortgage, upon default in such payments for a period of one month, the entire principal balance
and all interest due thereon are collectible forthwith.
7. The following amounts are due on the mortgage:

8. The attorney's fees set forth above are in conformity with the mortgage documents
and Pennsylvania Law and will be collected in the event ora third party purchaser at Sherifl?s Sale.
If the mortgage is reinstated prior to the Sale, reasonable attorney's fees will be charged based on
work actually performed.
9. Notice of Intention to Foreclose as required by Act 6 of 1974 (41 P.S. §403) and
notice required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code
Chapter 13, et seq., commonly known as the Combined Notice of Delinquency has been sent to
Defendants by regular mail with certificate of mailing.
WHEREFORE, Plaintiff demands Judgment against the Defendants in the sum of
$205,000.48, together with interest at the rate of $47.34 per diem and other costs and charges
collectible under the mortgage and for the foreclosure and sale of the mortgaged property.

DEFENDANT'S PRELIMINARY OBJECTIONS
Defendants, Clyde L. Bertram and Linda R. Bonnelr, by their undersigned
attorney, preliminarily object to Plaintiff's Complaint, as follows:
1. Plaintiff lender commenced this mortgage foreclosure action against
defendants by filing a complaint on April 1, 2004.
2. The mortgage sought to be foreclosed is a lien on real property containing
a single-family residence, located at 1023 York IP, oad, Monroe Township,
Cumberland County, Pennsylvania.
3. Defendant Linda R. Bonner is a legal title owner of the property located at
1023 York Road, Monroe Township, Cumberland County, Pennsylvania.
4. On March 9, 2004, the defendant, Linda R. Bonner, filed a voluntary
petition pursuant to Chapter 7 of the Bankruptcy' Code in the United States
Bankruptcy Court for the Middle District of Pennsylvania.
5. The aforesaid Chapter 7 proceeding was assigned case number 04-1382
to Judge Mary D. France.
6. Pursuant to 11 U.S.C. § 362(a), an automatic stay takes effect the instant
a case is filed, placing the debtor, Linda R. Bonner, and her property under
the protection of the bankruptcy court.
7. The purpose of the stay is to protect debtor, Lin, da R. Bonner, and her
property.
8. The stay bars "the commencement or continuation, including the issuance
or employment of process, of a judioial, administrative, or other action or
proceeding against the debtor that was or could have been commenced
before the commencement of the case ... or to recover a claim against the
debtor that arose before the commencement of the case ..... "11 U.S.C. §
362(a)(1).
9. Plaintiff's commencement of the action in mortgage foreclosure after
Defendant's commencement of her Chapter 7 proceeding, violates the
automatic stay and may be actionable pursuant to 11. U.S.C. § 362(h) or
as contempt of court and punished accordingly.
10. Plaintiff was required to seek relief from the stay before filing the within
action against the debtor, Linda R. Bonner, to foreclose on debtor's
property.
11. Plaintiff's action in mortgage foreclosure is void .and should be dismissed.
12. Only the bankruptcy court has the power to grant relief from the automatic
stay.
WHEREFORE, defendants respectfully requests that plaintiffs' action be
declared void and the complaint dismissed.
