I have represented the late Abdul Turk over the last several years in a personal-injury lawsuit
against Merck & Co., Inc., because of injuries Mr. Turk sustained from ingesting their dangerous
medication, Vioxx. We have reached a settlement in Abdul Turk's case. However, before I could
have Mr. Turk sign the release for the settlement of his claim, he unexpectedly died. Therefore,
we are now forced to petition the Register of Wills to open up an Estate for litigation purposes, so
that we can have an Administratrix appointed who would have the legal authority to sign the release
on the Estate's behalf.
Mr. Turk is survived by his wife, Nyamu, and his daughter, Asmita Sabar. His daughter, Asmita,
is a United States citizen, but currently resides outside the USA, in Qatar. We recommended that
Asmita be appointed the Administratrix, rather than Nyamu, because Asmita is fluent in English,
and Nyamu is not.
Once I receive the Short Certificate in this matter, I will then submit the release that we already had
Asmita sign, along with the Short Certificate, to complete the settlement paperwork with Merck.
The gross sum of the settlement monies will then be sent to our office, and our office will deposit
the said funds into an IOLTA account. We will hold the settlement funds in this account until the
inheritance tax form has been f led and the tux, if any, has been paid. Once any inheritance tax
has been paid, we will then disburse the settlement funds to the appropriate heirs.
