STIPULATION AGAINST LIENS
THIS AGREEMENT made the~~~`day of September, 2008, by and between Michael
Ludt Construction, LLC, hereinafter referred to as Contractor,
AND
Edward John Hartmann, Jr. and Amy E. Winters, hereinafter referred to as Owners, whereby
the former undertook and agreed to erect and construct a building on that certain lot of ground
situate in South Middleton Township, Cumberland County, Pennsylvania and being more
commonly own as Lot No. 3 of the Subdivision Plan recorded in Plan Book 93, Page 132, also
known as W. Old York Road, Carlisle, PA 17015, as more particularly described in Exhibit
"A" attached hereto and incorporated herein by reference.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of ($1.00) Dollar to it in hand paid by Owners, the receipt whereof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
itself and its subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by it or any of its subcontractors against the
said buildings and the lot of ground appurtenant thereto for or on account of any work done or
materials furnished by it or any of its subcontractors under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above described, and the
said Contractor, for itself, its subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant.

ALL THAT CERTAIN messuage and tract of land situated in South Middleton Township, Cumberland
County, Pennsylvania, being Lot No. 3 bounded and described in accordance with the Final Minor
Subdivision Plan for Bret J. and Peggy Sue Whitcomb, prepared by Dawood Associates, Inc., dated October
12, 2004, revised through June 28, 2006, and recorded in Cumberland County Plan Book 93,Page 132, as
follows to wit:
BEGINNING at a point in the centerline of West Old York Road (S.R. 0174) (30' ROW) at the
Northwestern corner of land now or formerly of Glen W. Flohr and Fay A. Flohr; thence along said land
now or formerly of Glen W. Flohr and Fay A. Flohr, South 24° 03' 30" East 705.93 feet to an existing iron
pin; thence along same, South 68° 39' 35" West 584.80 feet to an iron pin set; thence along land now or
formerly of Shirley M. Edris, North 22° 12' S4" West 777.65 feet to a point; thence in the centerline of said
West Old York Road, (S.R. 0174) (30' ROW), Noth 75° 59' 15" East 567.83 feet to a point, the point and
place of BEGINNING.
CONTAINING 9.3586 acres (net).
