Inc. Contractor,
STIPULATION AGAINST LIENS
AND
Randall N. Sears and Leilani L. Lyons, hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a single family dwelling on that certain lot of ground situate in
2065 Brigade Road, Enola, East Pennsboro Township, Cumberland, PA.
NOW THEREFORE, THIS AGREEMENT WlTNESSETH: That the said Contractor, for and in
consideration of the sum of ($1.00) Dollar to Yingst Homes, inc. in hand paid by Owner, the receipt
whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection
and construction of the said buildings on the lot above described, and the said Contractor, for themselves,
their subcontractors and others under them hereby expressly waive and relinquish the right to have, file,
and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN lot or tract of land situate in East Pennsboro, Cumberland County,
Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point on the Northern dedicated right-of-way line of Brigade Road Cul~de-sac at
the dividing line of Lot No. 11 and Lot No. 10;
THENCE by line of Lot No. 11 North 43 degrees 21 minutes 18 seconds West 57.01 feet to a
point; thence by line of other lands of Whelan Crossing North 24 degrees 47 minutes 41 seconds
East 204.00 feet to a point; thence by same South 73 degrees 05 minutes 26 seconds East
167.65 feet to a point; thence by same South 65 degrees 12 minutes 19 seconds East 35.35 feet
to a point; thence by line of land now or formerly of David R. Bretz South 12 degrees 12 minutes
32 seconds East 120.11 feet to a point at the dividing line of Lot No. 8 and Lot No. I0; thence by
line of Lot No. 8 South 70 degrees 21 minutes 46 seconds West 194.17 feet to a point on the
Eastern right-of-way line of Brigade Road Cul-de-sac; thence by said right-of-way by a curve to
the left having a radius of 50.00 feet and an arc length of 99.27 feet to a point at the dividing line
of Lot No. 11 and Lot No. 10, the place of BEGINNING.
CONTAINING 48,297 square feet.
BEING Lot No. 10 on the Final Resubdivision Plan of Lots Nos. 8, 9 and 10, Whelan Crossing,
Phase I and II in the Office of the Recorder of Deeds in Plan Book 78, Page 129.
BEING SUBJECT TO a Storm Sewer Easement as shown on the above-mentioned Subdivision
Plan.
ALSO BEING SUBJECT TO other restrictions and conditions set forth on the above-mentioned
Subdivision Plan.
BEING THE SAME PREMISES which Yingst Homes, Inc,, by their deed to be recorded
simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County, granted
and conveyed unto Randall N. Sears and Leilani L. Lyons.
