To the Judges of Your Honorable Court:
This petition respectfully represents:
1. Petitioner is Karla J. Dechene, (hereinafter referred to as the "Petitioner"), an adult
individual who resides at 50 West Main Street, Newville, Cumberland County,
Pennsylvania 17241.
2. The subject minor children are Olivia R. Dechene, age eleven (11) years, having
been bom March 23, 1992, and Owen R. Dechene, age eight (8), having been born
October 8, 1995. (Hereinafter the "Minor Children").
3. Petitioner is the Minor Children's natural mother.
4. The Minor Children reside at 50 West Main Street, Newville, Cumberland County,
Pennsylvania 17241.
5. Petitioner, as the Minor Children's natural parent, consents to this Petition.
6. The Minor Children's natural father, Roger W. Dechene, is recently deceased,
having passed away on August 8, 2003.

The religious persuasion of Petitioner and the Minor Children is Lutheran.
Petitioner has been the primary car,giver and primary custodial parent for the
Minor Children since the natural parents' marital separation and subsequent
divorce.
Due to the Minor Children's Father's death, there are no other individuals who
have provided care for the Minor Children or who have had custody of the Minor
Children.
Petitioner is seeking to have herself appointed both guardian of the person and
estate of the Minor Children.
Upon information and belief, Petitioner has no interest adverse to the Minor
Children.
Petitioner seeks guardianship because it is required for the Minor Children to
receive the variable annuity contract death benefit from Thrivent Financial for
Lutherans, as beneficiaries designated by the Minor Children's recently deceased
father.
Petitioner further seeks guardianship because it is required for the Minor Children
to receive the life insurance proceeds from a policy at Members 1st Federal Credit
Union where no beneficiaries were designated.
Petitioner seeks plenary guardianship of the Minor Children's estate and person, to
wit: Powers of general care, maintenance and custody, power to designate the
place for the Minor Children to reside, power to provide required consents or
approvals on behalf of the Minor Children, and the power to assure that the Minor

Children receive such training, education, medical services and social and
vocational opportunities, as appropriate.
Petitioner, as proposed guardian, states as her qualifications: She has been
providing care for the Minor Children as her natural parent since the Minor
Children were bom and with regards to their estate she has personal knowledge as
to the Minor Children's needs, affairs and the nature and extent of their estate.
The gross value of the estate of the Minor Children is unknown, but is estimated to
be approximately $200,000.00, consisting of one-half interest in the following
assets designated to each child: A residence located at 5 Timber Lane, Newville,
Cumberland County, Pennsylvania 17241, an automobile, bank accounts the value
of which is yet to be determined, a death benefit from annuity contract valued at
$31,919.17, and miscellaneous personal property. It is believed that the Minor
Children will inherit and/or receive as a beneficiaries these assets due to the recent
death of their natural father, Roger W. Dechene.
The Minor Children have no known net income.
The Minor Children are not the children of a veteran.
To the best of Petitioner's knowledge and belief, no other court within this
Commonwealth has appointed a guardian for the Minor Children.
To the best of Petitioner's knowledge and belief, no other petition has been filed
for the appointment of a guardian for the Minor Children.
WHEREFORE, Petitioner prays that she be appointed guardian of the estate and the
person of the minor children, Olivia R. Dechene and Owen R. Decbene.

Dechene is hereby appointed Guardian of the Persons and o£ the Estates of Olivia R. Dechene and
Owen R. Dechene, minors, without the necessity of posting bond or other security.
IT IS FURTHER ORDERED, that any cash be deposited in one or more savings account in
the name of the minor in banks insured by a Federal government agency, provided that the amount
deposited in any one such savings institution shall not exceed the amount to which accounts are thus
insured. No withdrawal can be made from any such account until the minor attains majority, except
as authorized by a prior order o£ this Court.

hearing thereon, it is hereby ORDERED that Karla J. Dechene is authorized to refinance the currem

alone.
IT IS FURTHER ORDERED, that the property shall be conveyed to Karla J. Dechene and the
minor children, Olivia R. Dechene and Owen R. Dechene, each with a One-Third interest as Joint
Tenants with Rights of Survivorship.
IT IS FURTHER ORDERED, that the equity in the property upon inheritance shah be

PETITION FOR ORDER APPROVING REFINANCE
AND CONVEYANCE OF REAL PROPERTY

AND NOW, comes Petitioner, Karla J. Dechene (hereinafter referred~o as the~Petitk~n~"),
by and through her counsel, Law Offices of Craig A. Diehl, and files the wifliin PetitiOn for Order

Petitioner is the natural parent of Olivia R. Dechene (age 11 years) and Owen R.
Dechene (age 8 years), (hereinafter the "Minor Children"), who are the subject of this
Orphan's Court proceeding.
By Order of Court dated January 14, 2004, as executed by the Honorable President
Judge George E. Hoffer, Petitioner was appointed Guardian of the Persons and &the
Estates &Olivia R. Dechene and Owen R. Dechene. (A tree and correct copy of the
Order of Court is attached hereto as Exhibit "A" and is incorporated herein as if fully
set forth verbatim).
A guardian appointed by the Court has powers and duties as described in 20 P.S.
{}5144, which includes inherent powers and duties as set forth in section 20 P.S. §3332
regarding personal representatives.
4. This Court has the authority to grant this Petition as per 20 P.S. §3332, which states
that the Probate Code does not limit the inherent powers and'duties of a personal
representative, except as otherwise provided in the Code.
5. The Minor Children will inherit real and personal property from the Estate of Roger W.
Dechene filed in the Register of Wills Office of Cumberland County, Pennsylvania to
estate number 21-03-0783.
6. The inheritance passing to the Minor Children will include certain real property situate
at 5 Timber Lane, Newville, Cumberland County, Pennsylvania (hereinafter the "Subject
Real Property").
7. The Subject Real Property has been a home to the Minor Children since birth.
8. Petitioner and the Minor Children presently reside in the Subject Property and they wish
to continue to reside there.
9. The Subject Real Property was appraised by a Pennsylvania state certified residential
appraiser at a value of $190,000.00 as of August 9, 2003. (A true and correct copy of
the appraisal is attached hereto as Exhibit "B" and is incorporated herein as if fully set
forth).
10. The Subject Real Property is encumbered by a Mortgage with a principal balance of
approximately $75,000.00.
11. Due to the passing of Roger W. Decbene on August 9, 2003, the Mortgage on the
property must be paid in full.
12. Cash flow restrictions prevent Petitioner from purchasing the Subject Real Property
from the Estate of Roger W. Dechene.

Since Petitioner has been living in the Subject Real Property with the Minor Children,
Petitioner has been the primary obligor for the financial liabilities of the Subject Real
Property, with the exception of the mortgage payment of approximately $520.00 per
month.
14. Due to the age of the Subject Real Property, since Petitioner has been living there with
the Minor Children she has spent significant sums of her own funds to repair and update
the property. To date she has spent in excess of $19,579.02. (A table ofrnany of
Petitioner's expenses is attached hereto as Exhibit "C" and is incorporated herein as if
fully set forth verbatim).
15. Petitioner seeks to have this Honorable Court authorize her refinance of the current
mortgage on the Subject Real Property to her name as sole obligor.
16. In exchange for refinancing the current mortgage on the Subject Real Property to her
name alone, Petitioner seeks to have the property conveyed fi.om the Estate of Roger
W. Dechene to Petitioner and the Minor Children, each with a One-Third interest in the
Subject Property as Joint Tenants with Rights of Survivorship, upon court approval.
17. Petitioner proposes that the Court's approval include the provision that the Minor
Children shall be entitled to the equity in the property that they inherited if the property
is ever sold'in the future minus the repair expenses paid by Petitioner, with any increase
in the equity of the property being divided equally between Petitioner and the Subject
Minor Children upon a future sale, if any.
18. To the best of Petitioner's knowledge, refinancing the current mortgage and conveying
the Subject Real Property as proposed herein is not adverse to the best interests of the
Subject Minor Children.
19. Approving the refinancing of the currem mortgage and permitting the conveyance as
proposed would permit Petitioner to utili~.e the appropriate tax deductions for the
Subject Real Property including any deductions for mortgage interest and real estate
taxes paid by Petitioner.
20. The Court's approval of the refinance and conveyance as proposed herein would
protect Petitioner because otherwise, she would reside in the Subject Real Property for
potentially numerous years without any financial benefit.
21. Petitioner is further having difficulties cominuing the homeowner's insurance on the
Subject Real Property because the existing insurance company will not provide
coverage since the legal owner is deceased.
WHEREFORE, Petitioner, Karla J. Dechene, respectfully requests that this Honorable Court
grant her Petition for Approval of Refinance and Conveyance of Real Property such that an Order is
entered permitting her to refinance the current mortgage on the subject property to her name alone,
authorizing the conveyance of the property to Petitioner and the Minor Children each with a One-Third
interest as Joint Tenants with Rights of Survivorship, and designate that the equity in the property upon
inheritance shall be distributed to the Minor Children upon a future sale minus the repair expenses paid
by Petitioner, with any increase in the equity being divided equally, and granting such other relief as this
Court deems just and proper.
