The Department reasoned the transfers reported on Schedule G and the cash and personal property bequests provided for under Paragraph Second of decedent's Will had priority of distribution "before determining Residue." Petitioner argues that Paragraph Third of decedent's Will is not a residuary paragraph, but constitutes a specific legacy, which does not abate. For Pennsylvania inheritance tax purposes, a charitable bequest is an exclusion and not a deduction, so that in order for the Department to exclude a portion of the estate from tax, we must look to the assets in the Pennsylvania estate. Furthermore, at death, a decedent's interest in nonprobate property such as survivorship and "in trust for" accounts pass outside the estate by operation of law directly to the surviving joint owner or beneficiary, unless the joint owner or beneficiary disclaims their survivorship or beneficial rights as GRIFFIE JANE R BOARD DOCKET NO. 0314707 Page 2 of 3 provided under 61 Pa. Code § 94.1. Absent a disclaimer, nonprobate assets cannot be used to fund bequests under a will. As the estate reported administrative costs and debts in the amount of $36,554.13, and absent evidence that decedent's brother disclaimed the Schedule G transfers, there remains $19,291.36 to fund decedent's bequests. Paragraph Third of the Will provides for the distribution of funds derived from the sale of decedent's residence. Except for two (2) $2,000.00 bequests to decedent's aunt and cousin, the remainder of those proceeds pass to charity.
