THIS AGREEMENT made the o~ day of Qf; 2008, between Terry L.
Dougherty Building Contractor (Builder), of 266 West Barrens Church Road, Dillsburg, PA.
17019, referred to as Contractor,
AND Lisa Goodyear, a/k/a Lisa A. Goodyear, of 247 Bonnybrook Road, Carlisle, PA.
17013 of, Cumberland County, Pennsylvania, hereinafter referred to as Owner.
WHEREAS, Owner is the owner of certain real estate situate in South Middleton
Township, Cumberland County, Pennsylvania, more particularly described and recorded in
Cumberland County Deed Book 221/509, known and numbered as Lot No. 3, Bonnybrook Road,
Carlisle, PA; and
WHEREAS, Contractor has undertaken and agreed to erect and construct a new home on
that certain above-described property pursuant to a Building Construction Agreement executed by
the parties dated ~~' /„X~- ZQ~' R' ;and
NOW THEREFORE TH~S AGREEMENT WITNESSETH:
That the said Contractor, for and in consideration of the sum of One ($1.00) Dollar in hand
paid to it by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the Agreement aforesaid, for itself and its subcontractors, and all parties acting
through or under it or them, covenant and agree that no mechanic's liens or claims shall be filed or
maintained by it or any of them against the said buildings and the lot of ground appurtenant thereto
for or on account of any work done or materials furnished by it or any of them under said contract
or otherwise, for, towards, in or about the erected and construction of the said buildings on the lot
above described, and the said Contractor, for itself, its subcontractors and others under it hereby
expressly waives and relinquishes the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of the improvements, and agrees that this instrument,
waiving the right of lien, shall be an independent covenant.
IN WITNESS WHEREOF, the parties hereto intending to be legally bound have hereunto
set their hands and seals the day and year first above written.
