PETITION FOR CONFIRMATION OF UPSET TAX SALE
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania Act of July 7, 1947, P.L. 1368, as amended 72
P. S. § 5860.101 et sic.
2. On September 25, 2008 the Bureau held an Upset Tax Sale listing seventy-six
(76) properties for the collection of delinquent real estate taxes. Of the properties
offered sixteen (16) received bids equal to or higher than the fixed upset price. A
list of said properties is hereto attached as Exhibit "A". Of those sixteen
properties that received bids, the buyers of three of the properties (sale nos. 621,
654, & 1162) failed to pay their bid price, therefore those properties will be offered
again at the continued Upset Sale on December 8, 2008.
3. Also of the properties that were sold, sale no. 2164 will be voided due to an
agreement between the property owner and the buyer in which all taxes levied
against the property would be paid in full.
4. Notices of the Sale were sent by certified mail, restricted delivery, returned receipt
to each reputed owner as listed in Exhibit "A".
5. For properties where a return receipt was not received from each owner or
reputed owner at least ten (10) days before date of Upset Sale, similar notice of

the sale was sent, to each owner who failed to acknowledge the first notice, by
United States first class mail.
6. In accordance with the Real Estate Tax Sale Law, advertisement of the Upset
Tax Sale was made at least thirty (30) days prior to the original scheduled sale
date in at least two newspapers of general circulation and the Cumberland Law
Journal. Proofs of publication are attached hereto as Exhibit "B".
7. Personal service by the Cumberland County Sheriffs Office was served on the
owner occupied properties as defined in Section 102 of the Pennsylvania Real
Estate Tax Sale Law.
8. The properties listed by tax parcel in Exhibit "A" were duly posted by the
Cumberland County Sheriffs Office or the County Assessment staff.
9. For properties that were sold, a notice that the property was sold was sent
certified mail, restricted delivery, return receipt to each owner at his or her last
known mailing address by the Bureau within thirty (30) days following the sale.
10.Your petitioner respectfully requests that the Court's Confirmation Nisi provide
that a consolidated notice regarding properties sold on September 25, 2008 be
published once in the Cumberland Law Journal, The Patriot News, and The
Sentinel within ten (10) days of the date of the Confirmation Nisi, and that any
exceptions or objections thereto be filed within thirty (30) days of the Court's
order.

ORDER OF CONFIRMATION NISI
AND NOW, this t%J, day of ?kA,, 2008, upon consideration of the
within Petition of Confirmation of a continued Upset Tax Sale it is ordered and decreed
that said Sale by the Cumberland County Tax Claim Bureau shall be confirmed
absolutely unless any objections or exceptions to the Sale are filed on or before thirty
(30) days from the date hereof.
The Cumberland County Tax Claim Bureau shall publish a general notice
describing by address the property sold, the name of the prior owner(s) or reputed
owner(s), the fact that the property was sold at Upset Sale on September 25, 2008, the
filing of the within Petition for Confirmation of Upset Sale, and providing that the Sale will
be confirmed absolutely and finally unless objections or exceptions to the Sale are filed
on or before thirty (30) days from the date hereof. Said notice by the Cumberland County
Tax Claim Bureau shall be published once in the Cumberland Law Journal, The Patriot
News, and The Sentinel, within ten (10) days of the date of this Confirmation Nisi. Any

PETITION FOR DISTRIBUTION OF SALE PROCEEDS
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania, Act 542 of July 7, 1947, P.L. 1368, as amended
72 P.S. § 5860.101 et sic.
2. On September 25, 2008 the Bureau held an Upset Tax Sale and successfully sold
a parcel of real estate owned by James Blessing, located on Cascade Road, Upper
Allen Township, Cumberland County, Pennsylvania, being Vacant Land as
Described in Deed Book 28L, Page 519.
3. At said Upset Tax Sale, the property of James Blessing, known as parcel number
42-29-2452-002 was sold for $600.00, a price in excess of the minimum bid
acceptable to the Bureau, to Lenh Phouasalith, 121 Regency Woods North,
Carlisle, Pennsylvania who paid said purchase price to the Bureau at time of sale.

4. Currently there are delinquent real estate taxes, interest and costs on said property
due to the Tax Claim Bureau in the amount of $362.36. A tax lien certificate is
attached hereto as Exhibit "A".
5. As outlined on the Lien Search attached as Exhibit "B", and there are no
mortgages, judgments, or Federal liens on subject property.
6. As outlined on the Schedule of Distribution attached as Exhibit "C", the current year
taxes are due and payable to Marlin Yohn Sr., tax collector. Said taxes will be
turned over to the Tax Claim Bureau by January 15, 2009.
7. Distribution of sale proceeds by the Bureau is controlled by 72 P.S. §5860.205(d)
according to the following priority:
(1) First, to the Commonwealth, by payment to the State Treasurer through the
Department of Revenue, for satisfaction of tax liens of the Commonwealth
only if the total amount of such liens or such portion thereof have been included
in the purchase price and paid by the purchaser or the property is sold at judicial
sale pursuant to this act.
(2) Second, to the respective taxing districts in proportion to the taxes due
them.
(3) Third, to taxing districts or municipal authorities for satisfaction of
municipal claims.
(4) Fourth, to mortgagees and other lien holders, in order of their priority,
for satisfaction of mortgages and liens as they may appear of record,
whether or not discharged by sale.
(5) Fifth, to the owner of the property.
8. Petitioner proposes that the $600.00 of net proceeds of this Upset Sale; after
transfer tax and recording fees included in the sale price be distributed as follows:
a) $ 362.36 to the Cumberland County Tax Claim Bureau.
b) $ 105.33 to Marlin Yohn, tax collector.
c) $ 132.31 to James Blessing, owner at time of the sale. If not claimed,
within three (3) years, the distribution due James Blessing will be
forfeited to the taxing authorities, ( 72 P.S. §5860.205(f) ).

9. Section 205(e) of the Real Estate Tax Sale Law (72 P.S. §5860.101 et. seq.)
provides as follows:
Prior to the actual distribution required by subsection (d), the bureau shall
petition the court of common pleas for a confirmation of distribution. The
petition shall set forth a proposed schedule of distribution for each
account and shall request the court to issue a rule to show cause on each
distributee why the court should not confirm the distribution as proposed.
The rule to show cause and a copy of the petition shall be served by first
class mail upon each distributee and upon the purchaser, with proof of mailing
to the last residence or place of business of the distributee known to the
bureau and to the purchaser at the address given to the bureau. If the
rule to show cause is not returned by any distributee or purchaser on or
before the time set for its return, the court shall forthwith confirm the
distribution absolutely. If any distributee or purchaser makes a return
of the rule within the time set by the court, the court shall forthwith hear
any objections and exceptions to the proposed distribution and thereafter
adjust the schedule of distribution as it deems just and equitable according
to law and confirm the distribution absolutely as adjusted. An absolute
confirmation of distribution by the court shall be final and nonappealable
with respect to all distributees listed in the petition.

PETITION FOR DISTRIBUTION OF SALE PROCEEDS
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania, Act 542 of July 7, 1947, P.L. 1368, as amended
72 P.S. § 5860.101 et sic.
2. On September 25, 2008 the Bureau held an Upset Tax Sale and successfully sold
a parcel of real estate owned by James and Melinda Gruver, located on 114 Big
Spring Terrace, West Pennsoboro Township, Cumberland County, Pennsylvania,
known as 114 Big Spring Terrace.
3. At said Upset Tax Sale, the property of James and Melinda Gruver, known as
parcel number 46-09-0515-005 TR04200 was sold for $450.00, a price in excess of
the minimum bid acceptable to the Bureau, to Shirley A. Brownawell, 128 Darr
Avenue, Carlisle, Pennsylvania who paid said purchase price to the Bureau at time
of sale.

4. Currently there are delinquent real estate taxes, interest and costs on said property
due to the Tax Claim Bureau in the amount of $229.06. A tax lien certificate is
attached hereto as Exhibit "A".
5. As outlined on the Department of Motor Vehicle Abstract attached as Exhibit "B",
there are no other liens recorded for the owner, James and Melinda Gruver, at the
time of sale.
6. As outlined on the Schedule of Distribution attached as Exhibit "C", the current year
real estate taxes, in the amount of $28.63 are due and payable to Deborah Piper,
tax collector. Said taxes will be turned over to the Tax Claim Bureau by January
15, 2009.
7. Distribution of sale proceeds by the Bureau is controlled by 72 P.S. §5860.205(d)
according to the following priority:
(1) First, to the Commonwealth, by payment to the State Treasurer through the
Department of Revenue, for satisfaction of tax liens of the Commonwealth
only if the total amount of such liens or such portion thereof have been included
in the purchase price and paid by the purchaser or the property is sold at judicial
sale pursuant to this act.
(2) Second, to the respective taxing districts in proportion to the taxes due
them.
(3) Third, to taxing districts or municipal authorities for satisfaction of
municipal claims.
(4) Fourth, to mortgagees and other lien holders, in order of their priority,
for satisfaction of mortgages and liens as they may appear of record,
whether or not discharged by sale.
(5) Fifth, to the owner of the property.
8. Petitioner proposes that the $450.00 of net proceeds of this Upset Sale; after
transfer tax and recording fees included in the sale price be distributed as follows:
a) $ 229.06 to the Cumberland County Tax Claim Bureau.
b) $ 28.63 to Deborah Piper, tax collector.
c) $ 192.31 to James & Melinda Gruver, owners, at the time of sale. If not
claimed, within three (3) years, the distribution due James & Melinda
Gruver will be forfeited to the taxing authorities, ( 72 P.S. §5860.205(f) ).

9. Section 205(e) of the Real Estate Tax Sale Law (72 P.S. §5860.101 et. seq.)
provides as follows:
Prior to the actual distribution required by subsection (d), the bureau shall
petition the court of common pleas for a confirmation of distribution. The
petition shall set forth a proposed schedule of distribution for each
account and shall request the court to issue a rule to show cause on each
distributee why the court should not confirm the distribution as proposed.
The rule to show cause and a copy of the petition shall be served by first
class mail upon each distributee and upon the purchaser, with proof of mailing
to the last residence or place of business of the distributee known to the
bureau and to the purchaser at the address given to the bureau. If the
rule to show cause is not returned by any distributee or purchaser on or
before the time set for its return, the court shall forthwith confirm the
distribution absolutely. If any distributee or purchaser makes a return
of the rule within the time set by the court, the court shall forthwith hear
any objections and exceptions to the proposed distribution and thereafter
adjust the schedule of distribution as it deems just and equitable according
to law and confirm the distribution absolutely as adjusted. An absolute
confirmation of distribution by the court shall be final and nonappealable
with respect to all distributees listed in the petition.

1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania, Act 542 of July 7, 1947, P.L. 1368, as amended
72 P.S. § 5860.101 et sic.
2. On September 25, 2008 the Bureau held an Upset Tax Sale and successfully sold
a parcel of real estate owned by Bret Charles and Jodye Adele Reeder, located on
Fairfield Street, South Middleton Township, Cumberland County, Pennsylvania,
known as Lot 16 Blk A in Plan Book 2, Page 80.
3. At said Upset Tax Sale, the property of Bret Charles and Jodye Adele Reeder,
known as parcel number 40-22-0489-140 was sold for $3200.00, a price in excess
of the minimum bid acceptable to the Bureau, to Robert Scott Royer, 263 York
Road, Carlisle, Pennsylvania who paid said purchase price to the Bureau at time of
sale.

4. Currently there are delinquent real estate taxes, interest and costs on said property
due to the Tax Claim Bureau in the amount of $522.18. A tax lien certificate is
attached hereto as Exhibit "A".
5. As outlined on the Lien Search attached as Exhibit "B", there are no other liens
recorded for the owner, Bret Charles and Jodye Adele Reeder, at the time of sale.
6. As outlined on the Schedule of Distribution attached as Exhibit "C", the current year
taxes, $150.64 are due and payable to Robert Cairns, tax collector. Said taxes will
be turned over to the Tax Claim Bureau by January 15, 2009.
7. Distribution of sale proceeds by the Bureau is controlled by 72 P.S. §5860.205(d)
according to the following priority:
(1) First, to the Commonwealth, by payment to the State Treasurer through the
Department of Revenue, for satisfaction of tax liens of the Commonwealth
only if the total amount of such liens or such portion thereof have been included
in the purchase price and paid by the purchaser or the property is sold at judicial
sale pursuant to this act.
(2) Second, to the respective taxing districts in proportion to the taxes due
them.
(3) Third, to taxing districts or municipal authorities for satisfaction of
municipal claims.
(4) Fourth, to mortgagees and other lien holders, in order of their priority,
for satisfaction of mortgages and liens as they may appear of record,
whether or not discharged by sale.
(5) Fifth, to the owner of the property.
8. Petitioner proposes that the $3200.00 of net proceeds of this Upset Sale; after
transfer tax and recording fees included in the sale price, have been deducted,
remaining proceeds be distributed as follows:
a) $ 522.18 to the Cumberland County Tax Claim Bureau.
b) $ 150.64 to Robert Cairns, tax collector.
c) $ 2,527.18 to Bret Charles and Jodye Adele Reeder, owners at time of sale.
If not claimed, within three (3) years, the distribution due Bret Charles
and Jodye Adele Reeder will be forfeited to the taxing authorities, ( 72
P.S. §5860.205(f) ).

9. Section 205(e) of the Real Estate Tax Sale Law (72 P.S. §5860.101 et. seq.)
provides as follows:
Prior to the actual distribution required by subsection (d), the bureau shall
petition the court of common pleas for a confirmation of distribution. The
petition shall set forth a proposed schedule of distribution for each
account and shall request the court to issue a rule to show cause on each
distributee why the court should not confirm the distribution as proposed.
The rule to show cause and a copy of the petition shall be served by first
class mail upon each distributee and upon the purchaser, with proof of mailing
to the last residence or place of business of the distributee known to the
bureau and to the purchaser at the address given to the bureau. If the
rule to show cause is not returned by any distributee or purchaser on or
before the time set for its return, the court shall forthwith confirm the
distribution absolutely. If any distributee or purchaser makes a return
of the rule within the time set by the court, the court shall forthwith hear
any objections and exceptions to the proposed distribution and thereafter
adjust the schedule of distribution as it deems just and equitable according
to law and confirm the distribution absolutely as adjusted. An absolute
confirmation of distribution by the court shall be final and nonappealable
with respect to all distributees listed in the petition.
10. Your petitioner respectfully requests that the Rule be Returnable on or after
January 12, 2009 in order to allow service thereof.
11. Your Petitioner further requests that a copy of the Court's Rule to Show
Cause also be served upon the following by United States first class mail by

PETITION FOR DISTRIBUTION OF SALE PROCEEDS
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania, Act 542 of July 7, 1947, P.L. 1368, as amended
72 P.S. § 5860.101 et sic.
2. On September 25, 2008 the Bureau held an Upset Tax Sale and successfully sold
a parcel of real estate owned by Bret Charles and Jodye Adele Reeder, located on
Fairfield Street, South Middleton Township, Cumberland County, Pennsylvania,
known as Lot 16 Blk A in Plan Book 2, Page 80.
3. At said Upset Tax Sale, the property of Bret Charles and Jodye Adele Reeder,
known as parcel number 40-22-0489-140 was sold for $3200.00, a price in excess
of the minimum bid acceptable to the Bureau, to Robert Scott Royer, 263 York
Road, Carlisle, Pennsylvania who paid said purchase price to the Bureau at time of
sale.

4. Currently there are delinquent real estate taxes, interest and costs on said property
due to the Tax Claim Bureau in the amount of $522.18. A tax lien certificate is
attached hereto as Exhibit "A".
5. As outlined on the Lien Search attached as Exhibit "B", there are no other liens
recorded for the owner, Bret Charles and Jodye Adele Reeder, at the time of sale.
6. As outlined on the Schedule of Distribution attached as Exhibit "C", the current year
taxes, $150.64 are due and payable to Robert Cairns, tax collector. Said taxes will
be turned over to the Tax Claim Bureau by January 15, 2009.
7. Distribution of sale proceeds by the Bureau is controlled by 72 P.S. §5860.205(d)
according to the following priority:
(1) First, to the Commonwealth, by payment to the State Treasurer through the
Department of Revenue, for satisfaction of tax liens of the Commonwealth
only if the total amount of such liens or such portion thereof have been included
in the purchase price and paid by the purchaser or the property is sold at judicial
sale pursuant to this act.
(2) Second, to the respective taxing districts in proportion to the taxes due
them.
(3) Third, to taxing districts or municipal authorities for satisfaction of
municipal claims.
(4) Fourth, to mortgagees and other lien holders, in order of their priority,
for satisfaction of mortgages and liens as they may appear of record,
whether or not discharged by sale.
(5) Fifth, to the owner of the property.
8. Petitioner proposes that the $3200.00 of net proceeds of this Upset Sale; after
transfer tax and recording fees included in the sale price, have been deducted,
remaining proceeds be distributed as follows:
a) $ 522.18 to the Cumberland County Tax Claim Bureau.
b) $ 150.64 to Robert Cairns, tax collector.
c) $ 2,527.18 to Bret Charles and Jodye Adele Reeder, owners at time of sale.
If not claimed, within three (3) years, the distribution due Bret Charles
and Jodye Adele Reeder will be forfeited to the taxing authorities, ( 72
P.S. §5860.205(f) ).

9. Section 205(e) of the Real Estate Tax Sale Law (72 P.S. §5860.101 et. seq.)
provides as follows:
Prior to the actual distribution required by subsection (d), the bureau shall
petition the court of common pleas for a confirmation of distribution. The
petition shall set forth a proposed schedule of distribution for each
account and shall request the court to issue a rule to show cause on each
distributee why the court should not confirm the distribution as proposed.
The rule to show cause and a copy of the petition shall be served by first
class mail upon each distributee and upon the purchaser, with proof of mailing
to the last residence or place of business of the distributee known to the
bureau and to the purchaser at the address given to the bureau. If the
rule to show cause is not returned by any distributee or purchaser on or
before the time set for its return, the court shall forthwith confirm the
distribution absolutely. If any distributee or purchaser makes a return
of the rule within the time set by the court, the court shall forthwith hear
any objections and exceptions to the proposed distribution and thereafter
adjust the schedule of distribution as it deems just and equitable according
to law and confirm the distribution absolutely as adjusted. An absolute
confirmation of distribution by the court shall be final and nonappealable
with respect to all distributees listed in the petition.
10. Your petitioner respectfully requests that the Rule be Returnable on or after
January 12, 2009 in order to allow service thereof.
11. Your Petitioner further requests that a copy of the Court's Rule to Show
Cause also be served upon the following by United States first class mail by
the Tax Claim Bureau:

PETITION FOR DISTRIBUTION OF SALE PROCEEDS
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania, Act 542 of July 7, 1947, P.L. 1368, as amended
72 P.S. § 5860.101 et sic.
2. On September 25, 2008 the Bureau held an Upset Tax Sale and successfully sold
a parcel of real estate owned by James and Melinda Gruver, located on 114 Big
Spring Terrace, West Pennsoboro Township, Cumberland County, Pennsylvania,
known as 114 Big Spring Terrace.
3. At said Upset Tax Sale, the property of James and Melinda Gruver, known as
parcel number 46-09-0515-005 TR04200 was sold for $450.00, a price in excess of
the minimum bid acceptable to the Bureau, to Shirley A. Brownawell, 128 Darr
Avenue, Carlisle, Pennsylvania who paid said purchase price to the Bureau at time
of sale.

4. Currently there are delinquent real estate taxes, interest and costs on said property
due to the Tax Claim Bureau in the amount of $229.06. A tax lien certificate is
attached hereto as Exhibit "A".
5. As outlined on the Department of Motor Vehicle Abstract attached as Exhibit "B",
there are no other liens recorded for the owner, James and Melinda Gruver, at the
time of sale.
6. As outlined on the Schedule of Distribution attached as Exhibit "C", the current year
real estate taxes, in the amount of $28.63 are due and payable to Deborah Piper,
tax collector. Said taxes will be turned over to the Tax Claim Bureau by January
15, 2009.
7. Distribution of sale proceeds by the Bureau is controlled by 72 P.S. §5860.205(d)
according to the following priority:
(1) First, to the Commonwealth, by payment to the State Treasurer through the
Department of Revenue, for satisfaction of tax liens of the Commonwealth
only if the total amount of such liens or such portion thereof have been included
in the purchase price and paid by the purchaser or the property is sold at judicial
sale pursuant to this act.
(2) Second, to the respective taxing districts in proportion to the taxes due
them.
(3) Third, to taxing districts or municipal authorities for satisfaction of
municipal claims.
(4) Fourth, to mortgagees and other lien holders, in order of their priority,
for satisfaction of mortgages and liens as they may appear of record,
whether or not discharged by sale.
(5) Fifth, to the owner of the property.
8. Petitioner proposes that the $450.00 of net proceeds of this Upset Sale; after
transfer tax and recording fees included in the sale price be distributed as follows:
a) $ 229.06 to the Cumberland County Tax Claim Bureau.
b) $ 28.63 to Deborah Piper, tax collector.
c) $ 192.31 to James & Melinda Gruver, owners, at the time of sale. If not
claimed, within three (3) years, the distribution due James & Melinda
Gruver will be forfeited to the taxing authorities, ( 72 P.S. §5860.205(f) ).

9. Section 205(e) of the Real Estate Tax Sale Law (72 P.S. §5860.101 et. seq.)
provides as follows:
Prior to the actual distribution required by subsection (d), the bureau shall
petition the court of common pleas for a confirmation of distribution. The
petition shall set forth a proposed schedule of distribution for each
account and shall request the court to issue a rule to show cause on each
distributee why the court should not confirm the distribution as proposed.
The rule to show cause and a copy of the petition shall be served by first
class mail upon each distributee and upon the purchaser, with proof of mailing
to the last residence or place of business of the distributee known to the
bureau and to the purchaser at the address given to the bureau. If the
rule to show cause is not returned by any distributee or purchaser on or
before the time set for its return, the court shall forthwith confirm the
distribution absolutely. If any distributee or purchaser makes a return
of the rule within the time set by the court, the court shall forthwith hear
any objections and exceptions to the proposed distribution and thereafter
adjust the schedule of distribution as it deems just and equitable according
to law and confirm the distribution absolutely as adjusted. An absolute
confirmation of distribution by the court shall be final and nonappealable
with respect to all distributees listed in the petition.
10. Your petitioner respectfully requests that the Rule be Returnable on or after
January 12, 2009 in order to allow service thereof.
11. Your Petitioner further requests that a copy of the Court's Rule to Show
Cause also be served upon the following by United States first class mail by
the Tax Claim Bureau:
