To the Honorable Judges of the Orphans' Court Division: ~ `~'
Petitioner, Hilda D. Christophel, through her counsel, Johnson, Duffie, Stewart & Weidner,
respectfully represents that:
1. Jack Edward Henry ("Decedent") died on November 29, 2007, a resident of New
Cumberland, Pennsylvania.
2. Decedent's Will dated August 31, 2007, was probated on January 24, 2008, in the
Office of the Register of Wills of Cumberland County, and Petitioner was granted Letters
Testamentary.
3. The beneficiaries of Decedent's Will are his children, Hilda D. Christophel,
Michelle L. Novosel, John P. Henry, and Patricia Henry, all of whom have been notified of the
filing of this Petition.
4. Decedent's widow, Minerva P. Henry, has filed an election to take her statutory
share and has also been notified.
5. Petitioner has become incapacitated to discharge the duties of her office because of
sickness, and her incapacity is likely to continue to the injury of the Estate.
6 Michelle L. Novosel, 2469 Cocklin Street, Mechanicsburg, PA 17055, who is
named as the Alternate Executrix under Decedent's Will, has agreed to take the necessary steps to
qualify as Petitioner's successor, and joins in this Petition.
7. Petitioner will turn over all books, papers, records and assets of Decedent's estate to
her successor when duly qualified.
WHEREFORE, Petitioner respectfully requests that this Honorable Court enter an order
accepting and approving Petitioner's resignation as Executrix, effective upon qualification of her
successor.
