Irwin III, Esquire, and file this complaint against the defendant, representing as follows: 1. The plaintiffs are TIMOTHY M. ALEXANDER and PATRICIA A. ALEXANDER, adult individuals residing at 7 Kutz Road, Carlisle, Cumberland County, Pennsylvania 17013. 2. The defendant is JOHN C. RIGHI, trading and doing business as RIGHI MECHANICAL, with a place of business located at 355 Greenspring Road, Newville, Cumberland County, Pennsylvania 17241. 3. Plaintiffs are the owners of a 1991 Ford Aerostar minivan which, on October 25, 2003, they delivered to defendant's auto repair business to replace a rear taillight and to fix the right rear passenger door. They also indicated to defendant's employee that they could not get hot air from the heater in the van and requested that defendant repair that problem. 4. During the process of attempting to fix the heater problem, defendant'employee blew the transmission seal of the van. Defendant's employee offered to drive plaintiff home and promised that the car would be repaired two days later, on October 27th 5. When the car was not ready on the 27th, defendant stated that the car would be finished by the following day; however, it was not ready on the 28th either. In fact, each time the plaintiffs talked to defendant or one of his employees, plaintiffs were advised of additional things that defendant or his employees stated needed repaired. 6. Finally, on October 29th, defendant or his employee told plaintiff that the transmission of the vehicle would have to be replaced and defendant refused to return the vehicle to plaintiffs without payment of $280 for the work defendant stated had been performed on the vehicle. 7. Plaintiffs believe and therefore aver that the method by which defendant and his employees attempted to repair the heater problem was the direct and proximate cause of the failure of the transmission. 8. Plaintiffs believe and therefore aver that the cost of replacing the transmission in their car exceeds it value; furthermore, defendant continues to hold the vehicle in his garage, refusing to permit the plaintiffs to pick it up without payment of his bill. 9. Plaintiffs believe and therefore aver that the fair market value of this vehicle is $1,645.00. WHEREFORE, plaintiffs demand judgment against the defendant in the sum of $1,645.00, plus costs of this suit, interest from 2E5, 2003 and attorney fees. April ? , 20042 HAROLD S.
