COMPLAINT IN CIVIL ACTION AND NOTICE TO DEFEND
You have been sued in court. If you wish to defend against the claims set forth in the following
pages, you must take action within twenty (20) days after this complaint and notice are served, by entering
a written appearance personally or by an attorney and filing in writing with the court your defenses or
objections to the claims set forth against you. You are warned that if you fail to do so the case may
proceed without you and a judgment may be entered against you by the court without further notice for
any money claimed in the complaint or for any other claim or relief requested by the plaintiff. You may
lose money or property or other rights important to you.

Plaintiff is a corporation having offices in 5700 Crooks Avenue, Suite 301, Troy, MI

Defendants are adult individuals residing at 1001 Nanroc Drive, #22, Mechanicsburg, PA

On or about June 12, 2001, Defendants duly executed a Retail Installment Sale Contract
(hereinafter the "Contract") in favor of Faulkner Harrisburg, Inc., a true and correct copy of said Contract
is attached hereto, marked as Exhibit "I" and made a part hereof.
4. Pursuant to said Contract, Defendants took possession of the vehicle more particularly
identified in the Contract as a 2001 GMC Jimmy.
5. Pursuant to the terms and conditions provided by the Contract, the Contract was assigned
from Faulkner Harrisburg, Inc. to Plaintiff.
6. Plaintiff avers that Defendants are in default of the Contract by having not made payment
to Plaintiff as promised, thereby rendering the entire balance immediately due and payable.
7. Plaintiff avers that a balance of$1O,581.75 is due from Defendants as of March 12,2004.
8. Plaintiff avers that the Contract between the parties provides that Plaintiff is entitled to
interest at the rate of6% per annum.
9. Plaintiff avers that the Contract between the parties provides that Defendants will pay
Plaintiffs reasonable attorneys' fees.
10. Plaintiff avers that such attorneys' fees amount to $1,000.00.
11. Although repeatedly requested to do so by Plaintiff, Defendants have willfully failed and/or
refused to pay the principal balance, attorneys' fees, interest, or any part thereof to Plainti ff.
WHEREFORE, Plaintiff demands judgment against Defendants, Gloria J. Schel1 and Charles H.
Baenig, jointly and severally, in the amount of $1 0,581. 75 with continuing interest thereon at the Contract
rate of6% per annum from the date of judgment , plus attorneys' fees of$I,OOO.OO and costs.

DEFENDANT'S ANSWER AND NEW MATTER TO PLAINTIFF'S COMPLAINT
AND NOW, comes Gloria J. Schell, the Co-defendant above captioned, by her attorney,
Edward J. Mimnagh, Esquire, and files the following AnsW(lr and New Matter to Plaintiff's
Complaint respectfully averring as follows:
I. The averments of fact set forth in numbered paragraph 1 of the Plaintiff's Complaint
are admitted.
2. The averments of fact set forth in nwnbered paragraph 2 of the Plaintiff's Complaint
are admitted in part and denied in part. The Co-defendant admits she is an adult individual
residing at 1001 Nanroc Drive, #22, Mechanicsburg, PA 17055. However, the Co-defendant
denies that Charles H. Baenig resides at 1001 Nanroc Drive, #22, Mechanicsburg, PA 17055.
Co-defendant believes and therefore avers that Charles H. Baenig is currently serving a 225 year
prison sentence in a Pennsylvania State Correctional facility. By way of further answer, after

reasonable investigation, answering Co-defendant is without knowledge or information sufficient
to form a belief as to the truth or falsity of the averment c:ontained in Paragraph 2 of the
Complaint and therefore denies the allegations thereof these alllegations are specifically denied.
Strict proof will be demanded at time of trial if the same be material.
3. The averments of fact set forth in numb(:red paragraph 3 of the Plaintiff's
Complaint are admitted.
4. The averments of fact set forth III numbered paragraph 4 of the Plaintiff's
Complaint are admitted.
5. The averments of fact set forth III numbered paragraph 5 of the Plaintiff's
Complaint are admitted.
6. The averments of fact set forth in numbered paragraph 6 of the Plaintiff's
Complaint are admitted in part and denied in part. The Co-defendant admits that she was unable
to make all payments as promised under the Contract. However, the Co-defendant denies that
the entire balance of the Contract is immediately due and payable to Plaintiff since Co-defendant
permitted Plaintiff to peacefully repossess the vehicle and is no longer in Co-defendant's
possession. The remaining averments of numbered paragraph 6 of the Plaintiffs Complaint are
conclusions of law with respect to which no responsive pleading is required.
7. The averments of fact set forth in numbered paragraph 5 of the Plaintiff's
Complaint are denied. After reasonable investigation, Co-defendant is without knowledge or

information sufficient to form a belief as to the truth of the averments of Paragraph 7 of
Plaintiffs Complaint.
8. Denied. By way of further answer, the contract does not provide that plaintiff is
entitled to interest at the rate of 6% per annum. By way of further answer, the contract indicates
that the late charge will be 2% per month on the amount of the payment that is late, computed on
the basis of a full calendar month for any fractional month period in excess of 10 days. By way
of further answer, after reasonable investigation, answering Co-defendant is without knowledge
or information sufficient to form a belief as to the truth of the remaining allegations contained in
this paragraph and therefore these allegations are specifically denied.
9. Admitted. It is admitted that the Contract provides for payment of reasonable
attorney fees, however, based upon the fact of this case it is denied that Co-defendant Schell
should be required to pay such fees. By way of further answer, after reasonable investigation,
answering Co-defendant is without knowledge or information sufficient to form a belief as to the
truth of the remaining allegations contained in this paragraph :md therefore these allegations are
specifically denied.
10. DENIED. After reasonable investigation, Co-defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of Paragraph 10 of
Plaintiffs Complaint. By way of further answer, after reasonable investigation, answering Co-
defendant is without knowledge or information sufficient to ~orm a belief as to the truth of the
remaining allegations contained in this paragraph and therefor'~ these allegations are specifically
denied.

11. DENIED. After reasonable investigation, Co-defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of Paragraph 11 of
Plaintiffs Complaint.
NEW MATTER
By way of further answer and defense, Co-defendant av<ers New Matter as follows.
12. On or about June 4, 2003 Plaintiff sent a notice of collection to Co-defendant
which stated that Co-defendant had until June 15, 2003 to cure the past due condition of Co-
defendant's account with Plaintiff.
13. On or about June 18, 2003, Co-defendant permitted Plaintiff to voluntarily
repossess the 2001 GMC Jimmy (hereinafter "vehicle") from the premises of Co-defendant's
employer.
14. At the time Plaintiff took possession Co-defendlmt had paid approximately seven
thousand eight hundred forty eight dollars ($7848.00) on the purchase price of the vehicle to
Plaintiff
15. At the time Plaintiff took possessIOn Co-defendant had driven the vehicle
approximately twelve-thousand - (12,000) miles.

16. On or about August 20, 2003, Co-defendant rec~:ived notice from Plaintiff that it
had, on August 8, 2003, sold the vehicle for and on account of Co-defendant.
17. However, Plaintiff failed to give Co-defendant any notice of the time and place of
sale, as required by the Uniform Commercial Code.
18. Plaintiff failed to comply with the notice and sale provisions of 13 Pa.C.S.A. 9
9504.
19. Plaintiff s notice to Co-defendant did include that at said sale the vehicle brought a
price amounting to eleven thousand one hundred dollars - ($11,100.00).
20. Pursuant to the Kelly Blue Book, said vehicle has a current fair market value of
thirteen thousand nine-hundred dollars - ($13,900.00) as of May 2004.
21. Co-defendant is unaware of the fair market value the vehicle would have brought in
August 8, 2003, when the vehicle was sold.
22. Because the vehicle was sold at a price below Dlir market value Co-defendant, is
entitled to be credited that amount from Plaintiff as a result of plaintiffs failure to forward proper
notice to Co-defendant.

23. When Plaintiff chose to repossess and sell the vehicle as means of recovering said
deficiency, Co-defendant is entitled to have the reasonable value of vehicle at time of resale
determined.
WHEREFORE, Co-defendant respectfully requests that Plaintiffs demand in the amount
of $10,581.75 plus attorneys' fees and costs be denied and judgment against the Plaintiff and
costs of this action.

PLAINTIFF'S REPLY TO DEFENDANT'S NEW MATTER
AND NOW, comes the Plaintiff, by and through its Counsel, Weltman, Weinberg, &
Reis, Co. L.P.A., and hereby files this Reply to Defendant's New Matter in the above-referenced
matter. In support thereof, Plaintiff avers as follows:
12. After reasonable investigation, Plaintiff is unable to determine the truths of the
averments contained in paragraph 12 of Defendant's New Matter same are therefore denied.
13. Paragraph 13 of Defendant's New Matter is admitted to the extent that the vehicle in
question was repossessed by the Plaintiff on or about June 18, 2003.
14. It is denied that Defendant or Co-Defendant paid $7,848.00 towards the purchase
price of this vehicle. It is admitted, however, that numerous payments were received from either
the Defendant or Co-Defendant towards the purchase price of this vehicle.
IS. Paragraph IS of Defendant's New Matter is denied. To the contrary, at the time of
repossession the vehicle had 22,799 miles on it.
16. Paragraph 16 of Defendant's New Matter is admitted to the extent that the Co-
Defendant received notice from the Plaintiff that it had sold the vt,hicle. A copy of that notice is
attached to this pleading as Exhibit I.
17. Paragraph 17 of Defendant's New Matter is denied. To the contrary, Plaintiff sent to
both Defendants, by certified mail, a "notice of our plan to sell property", which notice was sent
on June 19, 2003. Attached as Exhibit 2 is a copy of that notice which was sent to Gloria J.
Schell. Attached as Exhibit 3 is a copy of the certified green card which bears Gloria J. Schell's
signature.
18. Paragraph 18 of Defendant's New Matter is a conclusion ofJaw to which no response
is required.
19. Admitted.
20. After reasonable investigation, Plaintiff is unable to determine the truths of the
averments contained in paragraph 20 of Defendant's New Matter same are therefore denied.
21. After reasonable investigation, Plaintiff is unable to determine the truths of the
averments contained in paragraph 21 of Defendant's New Matter same are therefore denied.
22. Paragraph 22 of Defendant's New Matter is a conclusion ofJaw to which no response

Any personal property left in your vehicle not already returned to you will be held for at least 30
days after the date of this letter. After that, we may dispose of it as the law allows. Contact us

MOTION FOR SUMMARY JUDGMENT AS TO DEFENDANT GLORIA SCHELL
AND NOW COMES, Plaintiff, by and through its counsel, Weltman, Weinberg & Reis,
Co., L.P.A., and hereby files this Motion for Summary Judgment as to Defendant Gloria Schell.
In support thereof, Plaintiff avers as follows:
1. This action arises out of Defendant Gloria Schell's failure to make payments on a
Retail Installment Sale Contract for a 2001 GMC Jimmy.
2. Plaintiff filed a Complaint against the defendants, seeking $10,581. 75, jointly and
severally, with continuing interest thereon at the legal rate of 6.00% per annun from the date of
Judgment, plus costs. A true and correct copy of the Complaint is attached hereto as Exhibit
"A" and made a part hereof.
3. Attached to the Complaint was Verification from an authorized representative of
Plaintiff verifying the accuracy of the amount sought. See Exhibit "A".
4. Defendant Gloria J. Schell filed an Answer admitting she entered into the retail
installment sale contract and took possession of the vehicle, but claiming she is not responsible
for the remaining balance because she "permitted Plaintiff to peacefully repossess the vehicle."
Defendant Gloria Schell also questions whether she owes the deficiency balance due to an
alleged failure to receive a Notice of Plan to Sell Property letter. A true and correct copy of the
Answer is attached hereto as Exhibit "B" and made a part hereof.
5. Defendant Gloria Schell's Answer contained New Matter, which claimed she
never received the statutorily required Notice of Plan to Sell Property. Defendant Gloria Schell
also claimed that the vehicle was sold for less then market value, which entitles her "to be
credited that amount from Plaintiff as a result of Plaintiffs failure to forward proper notice to
Co-defendant. "
6. On or about August 23, 2004, Plaintiff served upon Defendant Gloria Schell's
Counsel a set of requests for admissions and requests for production of documents.
7. On or about September 23,2004, Defendant Gloria Schell's Counsel withdrew his
appearance.
8. On or about September 27, 2004, Plaintiff served upon Defendant Gloria Schell a
set of requests for admissions and requests for production of doc:uments. A true and correct copy
of same is attached hereto as Exhibit "e" and made a part hereof.
9. On or about October 27, 2004, Defendant Gloria Schell served Answers to those
Requests. A true and correct copy of Defendant Gloria Schell's answers to Plaintiffs First
Request for Admissions and Production of Documents is attached hereto as Exhibit "D" and
made a part hereof.
1 O. Defendant Gloria Schell admits she is in default of the Retail Installment Sale
Contract for failing to make monthly payments. See Exhibit "D."
11. Defendant Gloria Schell admits she has not submitted any written dispute as to
any accounting inaccuracy concerning payments on the contract in question. See Exhibit "D."
12. Defendant Gloria Schell admits she received the attached "Notice of Plan to Sell
Property" letter. See Exhibit "D."
13. Under Pennsylvania law, the resale price of a motor vehicle after repossession is
prima facie, but not conclusive evidence, of the reasonable value of the motor vehicle at the time
of resale. 69 P.S. 9627.
14. Defendant Gloria Schell has provided information stating the Blue Book retail
value of the car as $12,835.00. Plaintiff sold the vehicle for $11,100.00 at a public auction.
Plaintiffre-sold the vehicle within $1,600.00 of the blue book value.
15. Defendant Gloria Schell failed to prove that the r1esale value was unreasonable.
16. Defendant Gloria Schell's New Matter does not claim the resale was
unreasonable, but rather, that she is entitled to money due to "Plaintiffs failure to forward
proper notice to Defendant Gloria Schell."
17. Defendant Gloria Schell, after being provided copy, now admits she received a
copy of Plaintiffs "Notice of Plan to Sell Property." See Exhibit "D."
18. There are no meritorious defenses against this action and no genuine issue of
material fact exists as to Plaintiff s claim.
19. Plaintiff is entitled to judgment in its favor as a matter of law on the amount
sought in the Complaint.
WHEREFORE, Plaintiff respectfully requests that this Court grant Summary Judgment in
Plaintiffs favor and against Defendant Gloria Schell in the amount of $10,581.75 with
continuing interest thereon at the legal rate of 6.00% per annun from the date of Judgment, plus
costs

COMPLAINT

Plaintiff is a corporation having offices in 5700 Crooks Avenue, Suite 301, Troy, MI
2.
Defendants are adult individuals residing at 1001 Nanroc Drive, #22, Mechanicsburg, PA
17055.
3. On or about June 12, 2001, Defendants duly executed a Retail Installment Sale Contract
(hereinafter the "Contract") in favor of Faulkner Rarrisburg, Inc., a true and correct copy of said Contract
is attached hereto, marked as Exhibit "1" and made a part hereof.
4. Pursuant to said Contract, Defendants took possession of the vehicle more particularly
identified in the Contract as a 2001 GMC Jimmy.
5. Pursuant to the terms and conditions provided by the Contract, the Contract was assigned
from Faullmer Ramsburg, Inc. to Plaintiff.
6. Plaintiff avers that Defendants are in default of the Contract by having not made payment
to Plaintiff as promised, thereby rendering the entire balance immediately due and payable.
7. Plaintiff avers that a balance of$10,581.75 is due from Defendants as of March 12,2004.
8. Plaintiff avers that the Contract between the parties provides that Plaintiff is entitled to
interest at the rate of 6% per annum.
9. Plaintiff avers that the Contract between the parties provides that Defendants will pay
Plaintiffs reasonable attorneys' fees.
10. Plaintiff avers that such attorneys' fees amount to $1,000.00.
11. Although repeatedly requested to do so by Plaintiff, Defendants have willfully failed and/or
refused to pay the principal balance, attorneys' fees, interest, or any part thereof to Plaintiff.
WHEREFORE, Plaintiff demands judgment against Defendants, Gloria 1. Schell and Charles H.
Baenig, jointly and severally, in the amount of $1 0,581.75 with continuing interest thereon at the Contract
rate of6% per annum. from the date of judgment, plus attorneys' fees of$l,OOO.OO and costs.

DEFENDANT'S ANSWER AND NEW MATTER TO I'LAINTIFF'S COMPLAINT
AND NOW, comes Gloria J. Schell, the Co-defendant above captioned, by her attorney,
Edward 1. Mimnagh, Esquire, and files the following Answer and New Matter to Plaintiffs
Complaint respectfully averring as follows:
1. The averments of fact set forth in numbered paragraph 1 of the Plaintiffs Complaint
are admitted.
2. The averments of fact set forth in numbered paragraph 2 of the Plaintiffs Complaint
are admitted in part and denied in part. The Co-defendant admits she is an adult individual
residing at 1001 Namoc Drive, #22, Mechanicsburg, PA 17055. However, the Co-defendant
denies that Charles H. Baenig resides at 1001 Namoc Drive, #22, Mechanicsburg, P A 17055.
Co-defendant believes and therefore avers that Charles H. Baenig is currently serving a 225 year
prison sentence in a Pennsylvania State Correctional facility. By way of further answer, after

reasonable investigation, answering Co-defendant is without knowledge or information sufficient
to form a belief as to the truth or falsity of the averment contained in Paragraph 2 of the
Complaint and therefore denies the allegations thereof these allegations are specifically denied.
Strict proofwill be demanded at time of trial if the same be material.
3. The averments of fact set forth in numbered paragraph 3 of the Plaintiffs
Complaint are admitted.
4. The averments of fact set forth in numbered paragraph 4 of the Plaintiffs
Complaint are admitted.
5. The averments of fact set forth in numbered paragraph 5 of the Plaintiffs
Complaint are admitted.
6. The averments of fact set forth in numbered paragraph 6 of the Plaintiffs
Complaint are admitted in part and denied in part. The Co-defendant admits that she was unable
to make all payments as promised under the Contract. However, the Co-defendant denies that
the entire balance of the Contract is immediately due and payable to Plaintiff since Co-defendant
permitted Plaintiff to peacefully repossess the vehicle and is no longer in Co-defendant's
possession. The remaining averments of numbered paragraph 6 of the Plaintiffs Complaint are
conclusions of law with respect to which no responsive pleading is required.
7. The averments of fact set forth in numbered paragraph 5 of the Plaintiffs
Complaint are denied. After reasonable investigation, C o-d(:fendant is without knowledge 0 r

information sufficient to form a belief as to the truth of the averments of Paragraph 7 of
Plaintiff s Complaint.
8. Denied. By way of further answer, the contract does not provide that plaintiff is
entitled to interest at the rate of 6% per annum. By way of further answer, the contract indicates
that the late charge will be 2% per month on the amount of the payment that is late, computed on
the basis of a full calendar month for any fractional month period in excess of 10 days. By way
of further answer, after reasonable investigation, answering Co-defendant is without knowledge
or information sufficient to form a belief as to the truth of the remaining allegations contained in
this paragraph and therefore these allegations are specifically denied.
9. Admitted. It is admitted that the Contract provides for payment of reasonable
attorney fees, however, based upon the fact of this case it is. denied that Co-defendant Schell
should be required to pay such fees. By way of further answer, after reasonable investigation,
answering Co-defendant is without knowledge or information sufficient to form a belief as to the
truth of the remaining allegations contained in this paragraph and therefore these allegations are
specifically denied.
10. DENIED. After reasonable investigation, Co-defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of Paragraph 10 of
Plaintiffs Complaint. By way of further answer, after reasonable investigation, answering Co-
defendant is without knowledge or information sufficient to form a belief as to the truth of the
remaining allegations contained in this paragraph and therefore these allegations are specifically
denied.

11. DENIED. After reasonable investigation, Co-defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of Paragraph 11 of
Plaintiffs Complaint.
NEW MATTER
By way of further answer and defense, Co-defendant avers New Matter as follows.
12. On or about June 4, 2003 Plaintiff sent a notice of collection to Co-defendant
which stated that Co-defendant had until June 15, 2003 to cure the past due condition of Co-
defendant's account with Plaintiff.
13. On or about June 18, 2003, Co-defendant permitted Plaintiff to voluntarily
repossess the 2001 GMC Jimmy (hereinafter "vehicle") from the premises of Co-defendant's
employer.
14. At the time Plaintiff took possession Co-defenmmt had paid approximately seven
thousand eight hundred forty eight dollars ($7848.00) on the purchase price of the vehicle to
Plaintiff
15. At the time Plaintiff took possessIOn Co-dej=endant had driven the vehicle
approximately twelve-thousand - (12,000) miles.

16. On or about August 20, 2003, Co-defendant received notice from Plaintiff that it
had, on August 8, 2003, sold the vehicle for and on account of Co-defendant.
17. However, Plaintiff failed to give Co-defendant any notice of the time and place of
sale, as required by the Uniform Commercial Code.
18. Plaintiff failed to comply with the notice and sale provisions of 13 Pa.C.S.A. 9
9504.
19. Plaintiff s notice to Co-defendant did include that at said sale the vehicle brought a
price amounting to eleven thousand one hundred dollars - ($11.,100.00).
20. Pursuant to the Kelly Blue Book, said vehicle has a current fair market value of
thirteen thousand nine-hundred dollars - ($13,900.00) as of May 2004.
21. Co-defendant is unaware of the fair market value the vehicle would have brought in
August 8, 2003, when the vehicle was sold.
22. Because the vehicle was sold at a price below fair market value Co-defendant, is
entitled to be credited that amount from Plaintiff as a result of plaintiff's failure to forward proper
notice to Co-defendant.

23. When Plaintiff chose to repossess and sell the vehicle as means of recovering said
deficiency, Co-defendant is entitled to have the reasonable value of vehicle at time of resale
determined.
WHEREFORE, Co-defendant respectfully requests that Plaintiffs demand in the amount
of $10,581.75 plus attorneys' fees and costs be denied and judgment against the Plaintiff and
costs of this action.

Plaintiff demands that the defendants answer and respond to the following Request for
Production of Documents under oath pursuant to the Pennsylvania Rules of Civil Procedure
within 30 days from the date of service hereof.
Plaintiff also demands that defendants answer and respond to the following Request for
Admissions pursuant to Pa. Rules of Civil Procedure 4014.
You are requested to admit the truth of each of the statements of fact hereinafter stated. You are
instructed that:
1. These requests are made under Pennsylvania Rules of Civil Procedure 4001, et
seq., and each of these matters of which an admission is requested shall be deemed admitted

8. Unless otherwise indicated, all Requests herein relate to those certain events,
persons, and period of time more fully described in the pleading in this case.
9. These requests are of a continuous nature.
These Requests for Production of Documents shall be de:emed continuing so as to require
supplemental answers and documents if any information of documents are acquired subsequent to
the filing of responses hereto, which information or documents would have been included in the
answers and documents produced had it been known or available at the time the answers and the
documents provided pursuant hereto were produced. Defendants shall supply such information
and documents by supplemental answers and production of documents as soon as such
information becomes known or available and in all events, prior 10 trial of this action.
If objection is made to any requests for production of documents, it is demanded that the
requests for which there is no objection be answered and furnished within the aforesaid period.
All documents identified in response hereto shall be orglmized and labeled to correspond
with the request to which it pertains. For all documents produced, list the individual and his or
her job title and department from whose files it was produced and the current custodian of said
document.
If a document called for is believed to exist or is known to exist, but is in the possession,
custody or control of another person or party, the existence of the document, the identity of the

Plaintiff demands that the defendants answer and respond to the following Request for
Production of Documents under oath pursuant to the Pennsylvania Rules of Civil Procedure
within 30 days from the date of service hereof.
Plaintiff also demands that defendants answer and respond to the following Request for
Admissions pursuant to Pa. Rules of Civil Procedure 4014.
You are requested to admit the truth of each of the statements of fact hereinafter stated. You are
instructed that:
1. These requests are made under Pennsylvania Rules of Civil Procedure 4001, et
seq., and each of these matters of which an admission is requested shall be deemed admitted
unless your sworn statement in compliance with such Rules is timely made.
2. If you do not admit each of such statements, you must specifically deny each one
not admitted or set forth in detail the reasons why you cannot truthfully either admit or deny each

photographic matter, or, sound reproductions, however produced or reproduced, pertaining to any
manner to the subject matter indicated;
C. The words "identity", "identify", "identification", when used with
respect to a person( s) means to state the full name and present or last mown address and business
address of such person(s) and, if an actual person, his present or last mown job title, and the
name and address of his present or last mown employers;
D. The words "identity", "identify" "identification", when used with respect
to a date, subject matter, name(s) or person(s) that wrote, signed initialed, dictated or otherwise
participated in the creation of the same, the name( s) of the addressee or addressees if any and the
name(s) and addressees) of each person who have possession, custody, and control of said
document( s ). If any such document was, but is no longer in your possession, custody, or control,
or in existence, state the date and manner of its disposition; and
E. The word "identify", when used with respect to an act (including an
alleged offense), occurrence, statement, or conduct (hereinafter collectively called "act"), means
to (1) describe the substance ofthe event or events constituting such an act, and to state the date
when such act occurred; (2) identify each and every person(s) participating in such an act; (3)
identify all other person(s) (if any) present when such act occurred; (4) state whether any minutes,
notes, memoranda, or other record of such act was made; (5) state whether such record now
exists; and (6) identify the person(s) presently having possession, custody or control of such
record.
8. Unless otherwise indicated, all Requests herein relate to those certain events,
persons, and period of time more fully described in the pleading in this case.
9. These requests are of a continuous nature.
These Requests for Production of Documents shall be deemed continuing so as to require
supplemental answers and documents if any information of documents are acquired subsequent to
the filing of responses hereto, which information or documents would have been included in the
answers and documents produced had it been mown or availabk at the time the answers and the
documents provided pursuant hereto were produced. Defendants shall supply such information
and documents by supplemental answers and production of documents as soon as such
information becomes mown or available and in all events, prior to trial of this action.
If objection is made to any requests for production of documents, it is demanded that the
requests for which there is no objection be answered and furnishe:d within the aforesaid period.
All documents identified in response hereto shall be organized and labeled to correspond
with the request to which it pertains. For all documents produced, list the individual and his or
her job title and department from whose files it was produced ~illd the current custodian of said
document.
If a document called for is believed to exist or is mown to exist, but is in the possession,
custody or control of another person or party, the existence of the document, the identity of the
possessor, custodian and one in control of such documents shall be provided along with any
applicable common description or citation utilized by the publisher, possessor, custodian or
disseminator of such document.
If any document called for by this request is withheld on the basis of any claim of
privilege or any similar claim, identify that document as follows: author; addressee; indicated or
blind copies, date, subject matter; number of pages; attachments or appendices; all persons to
whom distributed, shown or explained; present custodian; and nature of the privilege or similar
claim asserted.
REQUEST FOR PRODUCTION OF DOCUMENTS I:
List all payments on the subject Retail Installment Sale Contract referenced in the
Complaint and produce any and all documents evidencing proof of those payments, including, but
not limited to, cancelled checks, receipts, coupons, statements, accountings, memoranda,
invoices, financial statements, accounting entries, diaries, charts, lists, phone records, data
compilations etc.

Produce any and all documents you intend to introduce and/or provide testimony on as
evidence at the time of trial.
