HomeMy WebLinkAbout01-6523 STIPULATION AGAINST LIENS THIS AGREEMENT made this /~7~day of ~~ 2001 by and between , , HOME DESIGN UNLIMITED, hereinafter referred to as Contractor, WILLIAM J. WIDDERS AND MICHE~.~.~ M. WIDDERS, hereinafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a single family dwelling situate in Monroe Township, Cumberland County, Commonwealth of Pennsylvania, known as 306 Stumpstown Road, Mechanicsburg, PA 17055 and more fully described in Exhibit "A" which is attached hereto and made a part hereof. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said building~'~h'd-~h~~ id~,b~7~-~h~-~ppurtenant thereto for or on account of any work done Or m~r~als!furnished bv them or an them under said~COntraCt or otherw~ for, towards, in, or a~o~ the erection a~d[[cOnstructiOh of' ~'~ said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. L LENKER, NOTARY I~J I ~LISLE BORO, CUMBERLAND C, OLIN'I~ Exhibit A ALL THAT certain tract of land situate in the Township of Monroe, County of Cumberland, and Commonwealth of Pennsylvania, being more particularly bounded and described as follows, to wit: BEGINNING at a steel pin set on the westernmost dedicated right of way line of the Stumpstown Road, said pin marking the common point of adjoiner of Lots #13 and #14 on the hereinafter mentioned plan of subdivision; thence departing from the Stumpstown Road right of way and extending along Lot #14 the following two courses and distances: South sixty-seven degrees eighteen minutes twenty-eight seconds West (S 67-o 18' 28" W), for a distance o~' two hundred ninety and no hundredths feet (290.00') to a steel pin; thence continuing along Lot #13, South forty-four degrees twenty-seven minutes fourteen seconds West (S 44-0 27' 14" W), for a distance of six hundred thirty-nine and fifty-seven hundredths feet (639.57') to an existing steel pin at Lot #1 of the Myers & Bare subdivision; thence extending along last mentioned lands, North forty-four degrees thirty minutes zero seconds West (N 44° 31' 00" W), for a distance of Three Hundred forty-four and twenty-six hundredths feet ((344.26') to an existing steel pin; thence continuing along said lands North thirty-nine degrees twenty minutes seven seconds East (N 39-0 20' 07" E), for a distance of forty-five and fifty-three hundredths feet (45.53') to an existing steel pin at Lot #10 on the hereinafter mentioned plan of subdivision; thence extending North sixty-six degrees thirty-four minutes twenty-nine seconds East (N 66-0 34' 29" E), along Lots #10, #11, and #12 on the hereinafter mentioned plan of subdivision for a total distance of nine hundred sixty-nine and nine hundredths feet (969.09') to a steel pin set on the westernmost dedicated right of way line of the Stumpstown Road; thence extending in and along the westernmost dedicated right of way line of the Stumpstown Road, South twenty-one degrees thirty-six minutes fifty-one seconds East (S 21-o 36' 51" E), for a distance of one hundred five and no hundredths feet (105.00') to a steel pin on said dedicated right of way line of Lot #14, said pin marking the place of BEGINNING. CONTAINING 4.211 acres and being designated as Lot #13 on a final plan of subdivision of Monroe Meadows, prepared for Kimba, Inc. by Statler and Lahr, Registered Engineers, dated November 24, 1986, and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 53, at page 34. BEING the same premises which J. Clifford Renyo and Regina A. Renyo, husband and wife, granted and conveyed to William J. Widders and Michelle M. Widders, husband and wife o--
