Carol Opalisky through their counsel, Reager & Adler, P.C., and petitions!this Con'to aut~'O~ze
the release of annuity benefits to their minor child, Colton M. Opalisky pursuant to section 20
Pa.C.S.A. Section 5101(3) as follows: " ~ ·
1. Michael Opalisky and Carol Opalisky are the natural parents of the minor child,
Colton M. Opalisky.
2. Michael Opalisky and Carol Opalisky are married and reside at 4 Truffle Glen,
Mechanicsburg, Pennsylvania 17055 with the minor child, Colton M. Opaliksy. 3. Colton M. Opalisky was born December 21, 1994·
4. Colton M. Opalisky is the annuitant under a The Baltimore Life Companies annuity
bearing the policy number 192746619.
5. Said annuity was purchased by Colton M. Opalisky's late grandfather, Lewis J.
Opalisky who died December 19, 2003.
0121. 6. The Estate of Lewis J. Opalisky is probated in Clearfield County at file number 1704-
7. The death benefit under said annuity is $5,494.57.
8. The minor child's entire estate is less than $25,000.
9. Pursuant to 20 Pa.C.S.A. Section 5101, if the value of the minor's estate is $25,000
or less, the Court having jurisdiction of the minor's estate, may authorize disbursement directly to
the minor, or to the parents or other person maintaining the minor, without the appointment of a
guardian or the entry of security.
10. Without such authority, Baltimore Life Companies cannot disburse the death benefit
under the annuity to the parents of the minor.
WHEREFORE, Petitioner requests this Honorable Court to enter an Order directing
Baltimore Life Companies to release the proceeds of the annuity to the natural parents of Colton
M. Opalisky.
