For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse
is three (3) percent [72 P.S. §9116 (a) (1.1) (i}].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero (0) percent
[72 P.S. §9116 (a) (1.1) (ii}]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an
adoptive parent, or a stepparent of the child is zero (0) percent [72 P.S. §9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half (4.5) percent, except as noted in
72 P.S. §9116(1.2) [72 P.S. §9116(a)(1}].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. §9116(a}(1.3)]. Asibling is defined, under
Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

AGREEMENT OF SALE
MADE THIS .~,~ day of October, 2008, by and between JbHN M. EAKIN,
Executor the Last Will and Testament of Laura c. McGee, deceased, of Mechanicsburg,
County of Cumberland, and State of Pennsylvania, SELLER
AND
CALVIN G. JOHNSON and SHARON E. JOHNSON, husband and wife, of the
Township of Hampden, Cumberland County, Pennsylvania, PURCHASERS
PREMISES SOLD SELLER agrees to sell and convey to the
PURCHASERS and the PURCHASERS agrees to purchase from the SELLER the real
estate described in Exhibit A. (900 East Simpson Street, Mechanicsburg)
2. PURCHASE PRICE. Purchase price shall be One Hundred Thirty Five
Thousand ($135,000.00) Dollars payable '- )
Dollars upon the execution of this agreement to be held in escrow by an agreed upon
party and the balance in cash at the time of settlement.
3. SETTLEMENT. Settlement shall be on or before October 30, 2008.
4. FIXTURES. The items which are considered as real estate and are
included in the sale are refrigerator, stove, window treatments, and chandelier in dining
room.
5. CONDITIONS PRECEDENT TO PURCHASER' S OBLIGATION
a.) Termite inspection -PURCHASERS shall have the right at their
expense to obtain an inspection by a licensed pest inspector, certified by the
Pennsylvania Department of Agriculture who shall prepare a written "Wood
Destroying Insect Infestation and Resulting Damage Report". This report is to
provide that an inspection of the visible and accessible areas of all structures
within the Property limits has been made satisfactory to and in compliance with
applicable laws and the requirements of mortgage lending institutions. If the
inspection reveals evidence of active infestation, previous infestation and/or
resultant damage which has not been corrected, the PURCHASERS shall provide
the SELLER with the report of the inspector with recommendation of the
necessary repairs to correct the damage. In the event the parties cannot agree on
the work necessary to correct the damage ,the cost or payment therefor, the
PURCHASERS receives the right to avoid the contract in which case the amount
already paid shall be returned to PURCHASERS and the rights of the parties shall
be at an end.
b.) Construction inspection - The obligation of the PURCHASERS is
conditioned on an inspection of the residence and a certificate from a qualified
inspector that the dwelling is structurally sound and in good repair. Upon
execution of this agreement the PURCHASERS shall retain a qualified building
inspector at their expense who shall be given access to the building to make his
inspection. A written report of the inspection of the condition of the building shall
be provided to both parties. In the event said inspection reveals structural defects
or defective fixtures or equipment the PURCHASERS shall inform the SELLER
of the defects and in the event the parties do not agree on the procedure and

expense of correcting the defect, the PURCHASERS reserves the right to avoid the
contract in which case the amount already paid shall be returned to them and the
right of the parties shall be at an end.
7. DEED. At Settlement, SELLER shall deliver to PURCHASERS a special
warranty deed. The property is to be conveyed free and clear of all liens, encumbrances,
and easements, excepting easements for roads, or rights of public service companies, if
any agreements of like matters of record, and easements or restrictions visible upon the
ground. Title to the Property shall be good and marketable and as such will be insured at
regular rates by a Title Insurance company licensed to do business in Pennsylvania.
8. RISK OF LOSS. SELLER shall maintain insurance on the property until
settlement and SELLER shall bear the risk of loss from fire or other casualty until
settlement.
9. TAXES. Real estate taxes and assessable charges shall be prorated as of
the day of settlement and each party shall pay half of all transfer taxes.
10. DEFAULT BY SELLER. In the event SELLER fails or refuses to convey
good and marketable title and such as will be insured by a licensed title insurance
company at regular rates, PURCHASERS shall have the option to either (a) take the title
SELLER can give without abatement of price of (b) rescind the contract whereupon the
down payment shall be returned and the rights of the parties shall be at and or (c )
proceed by an action at law or equity to enforce their rights under the contract.
11. DEFAULT BY PURCHASER. In the event PURCHASERS fail or
refuse to make settlement all contingencies having been met, time being of the essence,

the amount already paid shall be forfeited as liquidated damages and the rights or the
parties shall be at an end and the SELLER may convey the premises free and clear of any
claims of the PURCHASERS.

BEGINNING at a point on the center line of the Simpson Ferry Road, said
point being at a distance of eighteen hundred eighty (1860) feet measured in a
westerly direction from the westerly line of lands of the Koller Estate; thence along
other lands nor or formerly of John A. Cocklin south ten (10) degrees east two
hundred (200) feet to a point; thence along lands o f C.A. Lantzy south eighty (80)
degrees west seventy-five (75) feet to a point; thence along other lands of C.A.
Lantzy north ten (10) degrees west two hundred (200) feet to a point in the center
line of the Simpson Ferry Road; thence along the center line of said Road north
eighty (80) degrees east seventy-five (75) feet to the point or place of BEGINNING.
HAVING thereon erected a single family residence numbered 900 East
Simpson Street, Mechanicsburg, Pennsylvania.
BEING the same premises which Annabelle M. Norris, widow, by her deed
dated June 13, 1958, and recorded in the Cumberland County Recorder's Office in
Deed Book "M", Volume 18, at Page 139, granted and conveyed unto Donald
Kemp McGee, Jr. and Laura C. McGee, his wife. Donald Kemp McGee died
February 14, 1996 whereupon fee simple title vested in Laura C. McGee by operation of
law.

I, LAURA C. McGEE, of the Borough of Mechanicsburg, Cumberland
County, Pennsylvania, being of sound and disposing mind, memory and
understanding, do hereby make, publish and declare this my Last Will and
Testament, hereby revoking and making void any and all prior Wills by me at any
time heretofore made.
1.
I direct the payment of all my just debts and funeral expenses as soon after
my decease as the same can conveniently be done.
2.
I direct that there shall be paid out of my residuary estate all estate,
inheritance and like taxes together with any interest or penalty thereon imposed by
the Government of the United States, or any state or territory thereof, or by any
foreign government or political subdivision thereof, in respect to all property
required to be included in my gross estate for estate, inheritance or like tax purposes
by any of such governments, whether the property passes under this will or
otherwise.
3.
I give, devise and bequeath my entire estate, real, personal and mixed of
whatsoever nature and wheresoever the same maybe situate, to my two friends, JIM
ZEIGLER and LINDA L. ZEIGLER, husband and wife, or the survivor of them.
4.
Lastly, I nominate, constitute and appoint, JOHN M. EAKIN, to be
Executor of this my Last Will and Testament and I further direct that no bond or
other security be required of my personal representatives to guarantee faithful
performance of his duties.
