with Rule 5.6, Supreme Court Orphans' Court Rules, hereby notifies the Orphans' Court
Division, Court of Common Pleas of Cumberland County, that neither the above named personal
representative nor the above named counsel for the personal representative have filed with the
Register of Wills or Clerk of the Orphans' Court his, her or its certification required by Rule
5.6(e), Supreme Court Orphans' Court Rule and that the requisite notice, pursuant to Rule 5.6(e),
Supreme Court Orphans' Court Rules, was given by the Clerk of the Orphans' Court on 12-23,
2003, and that the ten (10) day notice to file the certification has expired. Accordingly, in
accordance with Rule 5.6(e) the Court is hereby notified of such delinquency and the
undersigned requests that a Court conduct a hearing to determine whether sanctions should be

Enclosed is the Inheritance Tax Return on the referenced estate along with a copy of
the HUD-l settlement statement for the sale of the property located at 1920
Princeton Avenue, Camp Hill, PA 17011. We have also enclosed a check for
$8,985.00 to be applied as a payment for the inheritance taxes on the referenced
estate and a check for $15.00 for payment of the filing fee.
A payment of $11,000.00 was previously made on May 19, 2004; a copy of our
cancelled check is enclosed.
Upon receipt of this payment of $8,985.00, will you please forward a receipt to me
for the entire payment that was made in the amount of $19,985.00. A return

[72 P.S. 99116 (a) (1.1) (i)].
For dates of death on or after January 1,1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. 99116 (a) (1.1) (ii)].
The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if
the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent,
or a stepparent of the child is 0% [72 P.S. 99116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. 99116(1.2) [72 P.S. 99116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. 99116(a)(1.3)]. A sibling is defined, under Section 9102, as an
individual who has at least one parent in common with the decedent, whether by blood or adoption.

It has come to my attention as solicitor for the Office of the Register of Wills and Clerk
of the Orphans' Court in and for Cumberland County, Pennsylvania, that the above estate
'has failed to file a report of the status of administration as required by Pennsylvania
Orphans' Court Rule 6.12.

It has come to my attention as solicitor for the Office of the Register of Wills and Clerk
of the Orphans' Court in and for Cumberland County, Pennsylvania, that the above estate
has failed to file a report of the status of administration as required by Pennsylvania
Orphans' Court Rule 6.12.
Subsection (f) of Rule 6.12 requires that the Register of Wills notify the Court in the
event the personal representative or counsel fails to file this notice after (10) days written
notice thereof. You have already received written notice of this delinquency by the

MOTION FOR SANCfIONS FOR FAILURE TO COMPLY WITH ORPHANS' COURT RULE 6.12
AND NOW, comes the Glenda Farner Strasbaugh, Cumberland County Register of Wills, by
and through her solicitor, Kirk S. Sohonage, Esquire, to hereby file this Motion for Sanctions against
Joseph A. Menard, Jr., for failure to comply with Orphans' Court Rule 6.12. In support of such
motion, the Moveant respectfully shows this Honorable Court the following.
1. The Register of Wills granted Letters of Administration to Joseph A. Menard, Jr. on
September 3, 2003.
2. A Reminder letter was mailed to the personal representative on July 27, 2007 via the United
States Postal Service advising that the Status Report would be due on August 15, 2007.
3. On September 7, 2007 a notice was mailed to the personal representative advising him of the
Failure to File the Status Report and advising him that he had 10 days in which to comply with
Rule 6.12 by filing said report.
4. On September 18, 2007 a Notice of Failure to File Status Report and Request to Conduct a
Hearing Pursuant to Rule 6.12, Supreme Court Orphans' Court Rule was mailed to the
personal representative.
5. Joseph A. Menard, Sr. did not appeared at hearing scheduled for December 3,2007 at 11 :00
a.m. before the Honorable Edgar B. Bayley in Courtroom Number 2.
6. On January 11, 2008, a letter from Kirk Sohonage, Solicitor was mailed to Personal
Representative and Counsel advising them that they had 10 days to comply or a Motion for
Sanctions for Failure to Comply with Orphans' Court Rule 6.12 would be filed requesting
counsel fees and court costs be assessed against them.
7. As of this date, the Status report has not been filed.

WHEREFORE, movant requests that the Personal Representative and counsel be held in
contempt and that a warrant be issued for his/her arrest until such time she complies with the Order
of this Court.
In the alternative, if the Court deems it necessary to first give the personal representative and

and through her solicitor, Kirk S. Sohonage, Esquire, to hereby file this Motion for Sanc~fons ag~lnst
Joseph A. Menard, Jr., for failure to comply with Orphans' Court Rule 5.6(a). In support of such
motion, the Moveant respectfully shows this Honorable Court the following.
The Register of Wills granted Letters of Administration to Joseph A. Menard, Jr. on
September 3, 2003.
2. On November 26, 2008, a notice was mailed to the personal representative via regular and
certified mail advising him of the Failure to File the Certification of Notice under rule 5.6(a)
and advising him that he had 10 days in which to comply with Rule 5.6(e) by filing said report.
3. On December 3, 2008, return receipt to Joseph A. Menard, Jr., was received by the personal
rerpesentative on December 1, 2008.
4. On December 12, 2008, a Notice of Failure to File Certification of Notice under rule 5.6(e) and
Request to Conduct a Hearing Pursuant to Rule 5.6(e), Supreme Court Orphans' Court Rule
was mailed to the personal representative via regular and certified mail.
5. On December 17, 2008, return receipt to Joseph A. Menard, Jr., was received on December
15, 2008.
6. Joseph A. Menard, Jr. did not appear at hearing scheduled for February 2, 2009 at 11:00 a.m.
before the Honorable Edgar B. Bayley in Courtroom Number 2.
7. On February 17, 2009, a letter from Kirk Sohonage, Solicitor was mailed to Personal
Representative via regular and certified mail, advising him that he had 10 days to comply or a
Motion for Sanctions for Failure to Comply with Orphans' Court Rule 5.6(e) would be filed
requesting counsel fees and court costs be assessed against him.
8. On February 26, 2009, return receipt to Joseph A. Mendard, Jr., was received by the personal
representative on February 24, 2009.
9. As of this date, the Certification of Notice under rule 5.6(a) has not been filed.
WHEREFORE, moveant requests that the Personal Representative and counsel be held in
contempt and that a warrant be issued for his/her arrest until such time she complies with the Order
of this Court.
In the alternative, if the Court deems it necessary to first give the personal representative and
Opportunity to respond, it is hereby requested that a rule be entered in the proposed form.

AND NOW, comes Glenda Farner Strasbaugh, Register of Wills, of Cumberland County, by
and through her solicitor, Kirk S. Sohonage, Esquire, to hereby file this Motion for Sanctions against
Joseph A. Menard, Jr., for failure to comply with Orphans' Court Rule 6.12. In support of such
motion, the Moveant respectfully shows this Honorable Court the following.
1. The Register of Wills granted Letters of Administration to Joseph A. Menard, Jr. on
September 3, 2003.
2. On November 26, 2008, a notice was mailed to the personal representative via regular and
certified mail advising him of the Failure to File the Status Report and advising him that he
had 10 days in which to comply with Rule 6.12 by filing said report.
3. On December 3, 2008, a return receipt to Joseph A. Menard, Jr., was received on December
1, 2008 by the personal representative.
4. On December 12, 2008, a Notice of Failure to File Status Report and Request to Conduct a
Hearing Pursuant to Rule 6.12, Supreme Court Orphans' Court Rule was mailed to the
personal representative via regular and certified mail.
5. On December 17, 2008, return receipt to Joseph A. Menard, Jr., was received on December
15, 2008 by the personal representative.
6. Joseph A. Menard, Jr. did not appear at hearing scheduled for February 2, 2009 at 11:00 a.m.
before the Honorable Edgar B. Bayley in Courtroom Number 2.

And now, on this the i`~' day of December 2009, this matter having been called for a hearing on
December 11, 2009, at which Joseph A. Menazd, Jr., failed to appear to show why the relief requested by the
Register of Wills in her Motion for Sanctions for Failure to Comply with Orphans' Court Rule 5.6 and her
Motion for Sanctions for Failure to Comply with Orphans' Court Rule 6.12 the Court finds the following:
In the matter of the Rule 5.6, IT IS ORDERED that Joseph A. Menazd, Jr. is found to be in contempt
for failure to provide Certification of Notice under Rule 5.6(d).
In the matter of Rule 6.12, IT IS FURTHER ORDERED that Joseph A. Menard is found to be in
contempt and that pursuant to 20 Pa.C.S.A. 6.12(f), Joseph A. Menazd, Jr., shall pay $250 as a sanction for his
failure to file a report of his administration with the Register of Wills. The $250 shall be made payable to the
Register of Wills.
