HomeMy WebLinkAbout01-6548IN RE: RETURN AND REPORT OF A CONTINUED UPSET TAX SALE HELD BY THE CUMBERLAND COUNTY TAX CLAIM BUREAU ON NOVEMBER 14, 2001 IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA CIVIL DIVISION - LAW .o. 2004- G'/< PETITION FOR CONFIRMATION OF UPSET TAX SALE Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called "Bureau") created under the provisions of the Real Estate Tax Sale Law of the Commonwealth of Pennsylvania Act of July 7, 1947, P.L. 1368, as amended 72 P.S. § 5860.101 et sic. On November 14, 2001 at 2:00 p.m., the Bureau held a Continued Upset Tax Sale on eight (8) properties for delinquent taxes. Of the properties offered, three (3) received bids equal to or higher than the fixed upset price, and five (5) did not receive bid. A list of said properties is hereto attached as Exhibit "A" and also lists the name of the owner in whose name the property was assessed, which in each instance is the same as the name of the owner at the time of sale. Notice of Public returned receipt, Exhibit "A". Tax Sale was sent by certified mail, restricted delivery, to each owner or reputed owner as listed in Column 1 on 4. On properties where return receipt was not received from each owner or reputed owner at least ten (10) days before date of original Upset Sale, similar notice of the sale was sent to each owner who failed to acknowledge the first notice by regular United States first class mail, proof of mailing at his or her last known address. F: ldata\melissalPetitionslConfirmati°n Nisi Petition Nov 14. doc Page 1 of 4 In accordance with the Real Estate Tax Sale Law, advertisement of the Upset Tax Sale was made at least thirty (30) days prior to the original scheduled sale date in at least three (3) newspapers of general circulation and the Cumberland Law Journal and proofs of publication are hereto attached as Exhibit "B". Personal service of the Notice of Public Tax Sale was made by the Cumberland County SherifFs Office on the owner occupied properties as defined in Section 102 of the Pennsylvania Real Estate Tax Sale Law, except for the property of Sara J. Creelman and Lori Creelman. The properties listed in Column 2 of Exhibit "A" were duly posted with a Notice of Public Tax Sale by the Cumberland County Sheriff's Office and the Tax Claim Bureau. The preceding notices concerned an Upset Tax Sale scheduled for these properties on September 27, 2001. Because the Sheriff was not able to personally serve the owners who occupy the premises or post the premises, the sale of the properties was continued to the continued sale date of November 14, 2001 pursuant to Section 601 (a) which provides, inter alia. as follows: "The Bureau shall schedule the date of sale no earlier than the second Monday of September and before October 1, and the sale may be adjourned, re-adjourned or continued. No additional notice of sale is required when the sale is adjourned, re-adjourned or continued if the sale is held by the end of the calendar year .... " Although not required by statute, by first class United States mail, postage pre- paid, the Cumberland County Tax Claim Bureau sent a notice to each property owner that their property would be offered for sale on November 14, 2001. By proceedings filed to No. 2001-6387 personal service on owner/occupant Lori Creelman was waived by the Court. See copy of Order of November 9, 2001 attached hereto as Exhibit "C". 11. Post Sale Notice of the sale of property was sent by the Bureau by Certified mail, restricted delivery, return receipt within thirty (30) days following the sale to each owner at his or her last known mailing address informing the owner(s) that the property was sold. 12. Your petitioner respectfully requests that the Court's Confirmation Nisi provide that a consolidated notice regarding properties sold on November 14, 2001 be published once in the Cumberland Law Journal, The Harrisburg Patriot News, and The Sentinel within ten (10) days of the date of the Confirmation Nisi, and that any exceptions or objections thereto be filed within thirty (30) days of the Court's order. 13. DeLuca, Esquire, and respectfully objects, takes exception and petitions to vacate the tax sale by the Cumberland County Tax Claim Bureau dated November 14, 2001, and in support thereof, avers the following: 1. The property at issue in this matter is located at 33 Prospect Drive, Middlesex Township, Carlisle, Cumberland County, Pennsylvania, consisting of real estate and a mobile home, with a tax parcel number of21-22-0119-061 ( hereinafter, "The Property"). 2. The owner and tax payer of the real estate property at the time of the sale was Marc Abbey ("Abbey"), an adult individual, with his residence at 33 Prospect Drive, Middlesex Township, Carlisle, Cumberland County, Pennsylvarda. 3. The owner and tax payer of the mobile home property at the time of the sale was Marc Abbey and Linda E. Abbey, ("Abbey"), both adult individuals, with their residence at 33 Prospect Drive, Middlesex Township, Carlisle, Cumberland County, Pennsylvania. The purchaser of the property at the tax sale was William Edward Lowe, ("Lowe"), having a residence at 4500-1 Rocky Spring Road, Chambersburg, Franklin County, Pennsylvania 17201. The petitioner avers that the names and addresses of all interested parties are as follows: Marc Abbey, 33 Prospect Road, Carlisle, Pennsylvania 17013; Linda E. Abbey, 33 Prospect Road, Carlisle, Pennsylvania 17013; William Edward Lowe, 4500-1 Rocky Spring Road, Chambersburg, Pennsylvania 17201; and Cumberland County Tax Claim Bureau, Old Courthouse, One Courthouse Square, Carlisle, Pennsylvania 17013. On or about November 14, 2001, the Cumberland County Tax Claim Bureau did hold a tax sale and attempted to sell and sold this real estate with mobile home for unpaid taxes. Based on the consolidated return which was confirmed Nisi by the Court on November 14, 2001, the said real estate with mobile home was purchased by William Edward Lowe of 4500-1 Rocky Spring Road, Chambersburg, Pennsylvania for a total purchase price of $1,106.38. The petitioner objects and excepts to the sale for the following reasons: g. The Bureau failed to provide proper notice of the sale as required under the Real Estate Tax Sale law, 72 Pa.C.S.A. §5860.101 et. seq. The Bureau failed to properly post the property as required by the Real Estate Tax Sale Law. The Bureau failed to give proper notice to the Pennsylvania Department of Revenue as required by the Real Estate Tax Sale Law. The Bureau failed to properly provide post sale notice as required by the Real Estate Tax Sale Law. The Bureau failed to provide notice of the fight to appeal as required by the Real Estate Tax Sale Law. The Bureau failed to provide proper notice to Linda E. Abbey. The Bureau failed to provide proper notice to Marc Abbey and Linda E. Abbey as "Owner Occupants". The Bureau failed to allow the property owner of the real estate to enter into an installment agreement to make installment payments on the balance of property tax due where the property owner of the real estate had paid more than 25% of the total amonnt of back taxes due. The Bureau failed to follow the procedural requirements as set forth in the Real Estate Tax Sale Law as to the above items as well as to other items which will be more fully developed by the objector, Marc Abbey, at a later hearing. The upset tax sale of the property was substantially defective and deprives Abbey of legally and constitutionally protected property rights and privileges. 9. In light of the foregoing, said upset tax sale for this Property should be set aside and vacated as a nullity. 10. In light of the foregoing, Abbey avers that said upset tax sale for this Property was improperly conducted pursuant to the Upset Sale provisions of 72 P.S. Section 5860.601 et seq. and said sale for this Property must be vacated by this Honorable Court. WHEREFORE, for all the above reasons, Petitioner, MARC ABBEY, hereby objects and excepts to the real estate tax sale held on November 14, 2001 and respectfully requests this Court to vacate, overturn and set aside the sale of this property. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called "Bureau") created under the provisions of the Real Estate Tax Sale Law of the Commonwealth of Pennsylvania Act of July 7, 1947, P.L 1368, as amended 72 P.S. § 5860.101 et sic. 2. Distribution of sale preceeds by the Bureau is contrelled by 72 P.S.§5860.205(d) according to the following priority: (1) First, to the Commonwealth, by payment to the State Treasurer through the Department of Revenue, for satisfaction of tax liens of the Commonwealth only if the total amount of such liens or such portion thereof have been included in the purchase pdce and paid by the pumhaser or the property is sold at judicial sale pursuant to this act. (2) Second, to the respective taxing districts in proportion to the taxes due them. (3) Third, to taxing districts or municipal authorities for satisfaction of municipal claims. (IV) Attaches as Exhibit "D" is a copy of a Notice of Public Tax Sale which was posted on the property by Melissa F. Mixell of the Cumberland County Tax Claim Bureau on September 10, 2001, along with a copy of her Affidavit for Posting Premises. Posted notice is required by {}602(e)(3) of the Real Estate Tax Sale Law. Parcel No 21.22-0119-061: Answer Page 2 of 6 (V) As the Bureau believed that the property was owner- occupied by Marc Abbey, official service of the notice of sale by the Sheriff was required pursuant to §601(a)(3) of the Real Estate Tax Sale Law. However, the Cumberland County Sheriff's Office was unable to effect personal service within the required time period and therefore the sale was continued from the originally scheduled date and time of September 27, 2001 at 2:00 p.m. to the continuation date and time of November 14, 2001 at 2:00 p.m. This continuation date was announced at the September 27, 2001 sale of other properties and in addition a notice of the continuation date was sent by regular United States mail to Marc Abbey even though no such notice is required by law. (See also paragraph 7(b) of this Answer.) A copy of the notice mailed to Marc Abbey is attached hereto, marked Exhibit "E" and is incorporated herein by reference thereto. (VI) Notice of the continued tax sale was then personally served upon Marc Abbey by the Cumberland County Sheriff's Office as evidenced by the Return and copy of the notice served attached hereto as Exhibit "F" and incorporated herein by reference thereto. Said personal service being required by §601(a)(3) of the Real Estate Tax Sale Law. (VII) Post sale notice of the sale was then given to Marc Abbey by return receipt mail as evidenced by the copy of the notice and return receipt card signed by Amanda Abbey on November 16, 2001 and attached hereto as Exhibit "G" and incorporated herein by reference hereto. Said notice was given pursuant to §607(a.1) of the Real Estate Tax Sale Law.
