If he fails to survive me, I give said heirloom "Damask Rose" sterling flatware with matching candlesticks and compote to my granddaughter, KIMBERLY PAINTER, and my black and white mink jacket to JOHN C. PAINTER's wife, SHAWN, providing she survives, otherwise to my grandson TODD PAINTER. ARTICLE IV I give and bequeath unto my son, JAMES N. PAINTER, the following: A. My Haywood-Wakefield corner cupboard with its Wedgewood china contents. B. My antique wash stand and telephone. D. Piecrust dropleaf table. If JAMES N. ARTICLE VIII I direct that my house and its contents, excepting items specifically bequeathed herein, be sold and the proceeds thereof shall be distributed pursuant to ARTICLE IX hereof. On April 5, 2004, I received your note relating to the letter that you received from A. D. McNichol, III, dated March 24, 2004, which enclosed a copy of my letter of March 18, 2004 to Mr. Painter. That letter to Mr. Painter was copied to all of the beneficiaries of the estate. I am providing Mr. Painter and those beneficiaries with a copy of this response to your note and a copy of Mr. McNichol's letter to you, which, apparently, is the reason you sent your note to me inquiring - "Are you taking steps to remove him?" We have not taken any steps to remove Mr. Painter, nor do we plan to do so. We believe we have a conflict of interest in seeking his removal after having undertaken to represent Mr. Painter as Executor of his mother's estate. We have, on numerous occasions, including our letter of March 18, 2004, pointed out to Mr. Painter and the various beneficiaries our concerns about Mr. Painter's discharge of his duties as Executor. The reason for bringing those matters to the attention of the beneficiaries was so that they could take action to remove Mr. Painter, if they wished, as Mr. McNichol's letter suggests should be done, since we are not in a position to do so after having undertaken to represent Mr. Painter in this matter. We are copying this letter to all of the interested parties as indicated. We have and will continue to suggest that they make a determination of how they are going to proceed in light of the obvious dissatisfaction with Mr. Painter as expressed in Mr. McNichol's letter to you. We believe that the beneficiaries should secure separate counsel to seek the removal of Mr. Painter as Executor, force him to file an inventory or otherwise seek any relief to which they may be entitled. That he is a legatee of the above captioned Estate. 2. That inasmuch as James N. Painter (Painter), the Executor of the Estate has failed to file his Account, your Petitioner has initiated the procedure to bring this matter before the Court to enforce the aforesaid Executor's duty to so account. 3. The aforesaid procedures involved the entry of an Order and issuance of a Citation by the Clerk of the Orphans' Court on June 28, 2004 directing Painter to appear in Court on August 13, 2004 to show cause why he shouldn't file his Account. 4. Painter not appearing in Court as Ordered on August 13, 2004, he was Ordered and directed by the Court on September 9, 2004 (on the Motion of your Petitioner) to file his Account within 20 days after service of said Order. 5. No Account having been filed, your Petitioner motioned the Court for a Rule to be issued upon Painter to show cause why he should not be held in contempt. The aforesaid Rule was issued on January 14, 2005 and made returnable before the Court on March 30, 2005. 6. The hearing on the aforesaid contempt motion was held on March 30, 2005 and Painter didn't appear, but evidence was presented in support of the motion and your Honorable Court set April 25, 2005 for a final hearing on the aforesaid motion, for the purpose of adjudication and disposition pursuant to the five-step contempt procedure; and further, Painter was specifically Ordered to appear at the April 25, 2005 hearing. 7. The April 25, 2005 hearing was held as scheduled but Painter didn't appear. Your Honorable Court finding ".. . that he has intentionally, voluntarily and willfully failed to comply with an Order of Court," and he was adjudicated in contempt. 8. The sanction of the Court, imposed at the April 25, 2005 hearing, was that Painter undergo imprisonment in the Cumberland County prison for a period of one month, with the purge provision of his complying with the previous Court Order relating to the filing of the Account, and further, and in the absence of filing the Account he was Ordered to report to the aforesaid prison on May 25, 2005 at 9:00 a.m. without further Order of Court. 9. Your Honorable Court further Ordered on April 25, 2005 that if Painter failed to file the Account and failed to report to prison, that a bench warrant would be issued for his arrest upon your Petitioner's motion. 10. May 25, 2005 has come and gone and Painter has neither filed his Account nor reported to prison. WHEREFORE, and by virtue of the foregoing, your petitioner requests your Honorable Court to issue a bench warrant for the apprehension and arrest of James N. Mr. Painter is an engineer and has been employed by Tyco Electronics for the past twenty five years. 7. It is believed that it is not the intent of Your Honorable Court that Mr. Painter lose his job as a result of this matter. 8, It is believed and therefore averred that Mr. Painter with the assistance of counsel will be able to file an accounting in this matter within thirty days, 9. James Painter apologizes to Your Honorable Court for his dilatory behavior and apologizes for any problems which his behavior may have caused the Court and the other beneficiaries to his mother's estate. Regardless of the outcome of this Motion, he assures the Court that he will fully comply with all current and future Orders. On November 8, 2007 a Notice of Failure to File Status Report and Request to Conduct a Hearing Pursuant to Rule 6.12, Supreme Court Orphans' Court Rule was mailed to the personal representative. 5. James N. Painter did not appeared at hearing scheduled for January 7,2008 at 11 :00 a.m. before the Honorable Edgar B. Bayley in Courtroom Number 2. 6. On January 11, 2008, a letter from Kirk Sohonage, Solicitor was mailed to Personal Representative and Counsel advising them that they had 10 days to comply or a Motion for Sanctions for Failure to Comply with Orphans' Court Rule 6.12 would be filed requesting counsel fees and court costs be assessed against them. 7.
