WHEREAS,
wife, Owner, of Lot 81, Big Spring Terrace,
entered into a contract with Jason A. Davis,
Construction of 201 Pipeline Road, Newville,
Steven L. Negley and Lorena M. Negley, husband and
Newville, PA 17241,
t/a Davis
PA 17241, dated
March 30, 2004, to provide materials and perform labor necessary
for the construction of a dwelling house upon a tract of land
situate at 26 Hilltop Lane, Newville (West Pennsboro Township),
Cumberland County, Pennsylvania, more particularly bounded and
described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein set forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly called a mechanics'
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County Prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals

TO WAIVER OF MECHANICS' LIEN BETWEEN
STEVEN L. NEGLEY AND LORENA M. NEGLE¥, OWNER
JASON A. DAVIS, CONTRACTOR
ALL THAT CERTAIN lot of ground situate in West Pennsboro
Township, Cumberland County, Pennsylvania, bounded and described
as follows to wit:
BEGINNING at the intersection of the southwest line of Township
Road 436 with the northwest line of Township Road 433, and
running thence along the southwest line of Township Road 436
northwesterly 125 feet; thence along land now or formerly of
Kenneth M. Lamason et ux. and land now or formerly of Addison F.
Kreamer, Jr., et ux. on a line running parallel with northwest
line of Township Road 433, a distance of 200 feet to a stake at
corner of said lands now or formerly of Addison F. Kreamer, Jr.,
et ux.; thence by said lands now or formerly of Addison F.
Kreamer, Jr., et ux, by a line running parallel with the
southwest line of Township Road 436, a distance of 125 feet to a
point in the northwest line of Township Road 433; thence along
said northwest line of Township Road 433, a distance of 200 feet
to the point and Place of BEGINNING.
BEING the same premises which Thomas H. Burkepile, single man, by
his deed dated September 29, 2003 and recorded in the Office of
the Recorder of Deeds in and for Cumberland County in Deed Book
259, Page 4113, granted and conveyed unto Steven L. Negley and
Lorena M. Negley, husband and wife, the Owners.
