HomeMy WebLinkAbout04-1599WAI~ER OF RIGHT TO WHEREAS, SECOND STATE ENTERPRISES, INC., having a principal address of 20 Spring Street, Chambersburg, Pennsylvania, entered into a contract with SECOND STATE ENTERPRISES, INC. having a principal address of 20 Spring Street, Chambersburg, Pennsylvania, to provide materials and perform labor necessary for construction of dwelling upon a lot of ground located in Middlesex Township, Cumberland County, Pennsylvania, known as Lot 2 Rt. ! 1 and Shady Lane, Carlisle, Pennsylvania. CONTAINING 8.125 acres as per deed from John I. Enck, Jr. and Linda L. Enck to Second State Enterprises, Inc., dated April ! ~}, , 2004 and recorded in Cumberland County Record Book ~-~t~ ~-, Page 2qZT. NOW THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or material man, nor any other person furnishing labor or materials to the said contractor under this contract shall file a lien, commonly called a mechanics' lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided.
