Petition to conduct testimony by telephonic
conference
PETITION TO CONDUCT TESTIMONY OF TREATING PHYSICIAN
TELEPHONICALLY
AND NOW, comes Petitioner, Barbara A. Minaya, by and through counsel, Lee
Eric Oesterling, Esquire and in support of this petition avers as follows:
1. Jed V. Minaya, the incapacitated person, remains in a comatose state and has
is currently receiving regular care at Mountainview Specialty Care, 229 Sand Hill Road,
Greensburg, Pennsylvania 15601.
2. The treating physician for the incapacitated person is John W. Hoyt M.D.
3. Dr. Hoyt is a physician with Pittsburgh Critical Care Associates at 1789 South
Braddock Ave, Suite 290, Pittsburgh, Pennsylvania 15218.
3. A Hearing on the issue of Paternity is scheduled before the Honorable Edward
E. Guido on October 27, 2008 at 3:00 p.m. Eastern Standard Time in Courtroom 3 of the
Cumberland County Courthouse.
4. Dr. Hoyt is scheduled to be at an annual medical conference in Philadelphia
on that date. But would be available to testify telephonically.
5. Dr. Hoyt's testimony is highly relevant to Mr. Minaya's current physical
status, diagnosis, prognosis and future care needs and his testimony is being offered for
that purpose.
6. Dr. Hoyt's Credibility is not at issue.
7. Dr. Hoyt can be contacted at 1-412-779-0754 (cell phone) at the date and time
of the hearing.
WHEREFORE ,Petitioner, respectfully requests, that this Honorable Court allow Dr.
Hoyt to appear telephonically at the hearing scheduled for 3:00 p.m. on October 27, 2008
