Count57, Pennsylvania, being of sound mind, memory and understanding,
do make, publish and declare this as and for my last will and testament,
hereby revoking and making void all former wills by me at any time
heretofore made.
FIRST. I direct all my just debts including all inheritance
taxes be fully Paid and satisfied out of my estate by my personal
representative hereinafter named as soon as conveniently may be done
after my decease.
SECOND. I give, devise and beGueath all my property whatsoever
and wherever situate unto my husband, W. Grant McCoy, to be his
absolutely.
THIRD. In the event my said husband predeceases me, then I
give, devise and bequeath all of my property, whatsoever and wherever
situate, as follows:
1. Two-third (2/3rd) thereof to the Farmers Trust Company, of
Carlisle, Pennsylvania, in trust, for the Barnitz Methodist Church,
Barnitz, Pennsylvania, of which I am a member, the income from which
shall be used each year for such purposes as the Board of Directors
shall think best in their discretion and, if the said Church fails to
exist, then the cor9us thereof and any accrued interest shall be ~aid
to the Carlisle Hospital, Carlisle, Pennsylvania.
2. One-third (1/3rd) thereof to the Farmers Trust Company, of
Carlisle, Pennsylvania, in trust, for the Salvation Army of Carlisle,
Pennsylvania, ~e income of which to be used for the benefit of the
poor people of the Carlisle area.
LASTLY, I nominate, constitute and appoint my said husband, W.
Grant ~cCoy, Executor of this my last will and testament, and in the
event he should predecease me or is unable to serve, I nominate,
constitute and appoint the Farmers Trust Company, of Carlisle, as
successor Executor, and I order and direct that Henry L. Stuart be
employed as attorney in the settlement of my estate due to his
familiarity and knowledge of ml~ affairs and business.

If any tax due is paid within three ($) calendar months after the decedent's death, a five percent (5Z) discount of
the tax paid is allowed.
The 15Z tax amnesty non-participation penalty is computed on the total of the tax and interest assessed, and not
paid before January 18, 1996, the first day after the end of the tax amnesty period. This non-participation
penalty is appealable in the sams manner and in the the same time period as you would appeal the tax and interest
that has been assessed as indicated on this notice.
Interest is charged beginning with first day of delinquency, er nine (9) months and Dna (1) day from the date of
death, to the date of payment. Taxes which became delinquent before January 1, 1982 bear interest at the rate of
six (6Z) percent per annum calculated at a daily rate of .00016~. All taxes which became delinquent on and after
January l, 1982 wil! bear interest et a rate which will very fram calendar year to calendar year with that rate

AND NOW, comes Manufacturers & Traders Trust Company, Executor and Trustee under
the Last Will and Testament in the above decedent's estate, by and through its attorneys, Martson
DeardorffWilliams & Otto, and requests permission to make outright distribution of charitable trust
bequests upon the following:
1. Anna R. McCoy (herein, "Decedent") died on the 18th day of April, 2003.
2. Decedent's Last Will and Testament (herein, "Will") was duly probated by the
Register of Wills in and for Cumberland County on May 22, 2003, at Estate No. 2003-00424; a copy
is attached hereto and marked Exhibit "A."
3. Paragraph Third of the Will provides as follows:
THIRD. In the event my said husband predeceases me, then I give, devise

Under the terms of the Will, Farmers Trust Company was named as Executor.
By various mergers, Farmers Trust Company is now Manufacturers & Traders Trust
After payment of the Pennsylvania Inheritance Tax liability and administrative
expenses, it is anticipated that the residue of decedent's estate will be approximately $92,000.00.
8. Approximately $61,000.00 will be available to fund the Barnitz Methodist Church
testamentary trust; approximately $31,000.00 will be available to fund the Salvation Army
testamentary trust.
9. Your petitioner believes that the annual income to be derived from each trust will be
insufficient to pay its usual and customary trustee fees and other annual expenses of trust
administration, thus precluding the effective administration of the trusts and precluding meaningful
enjoyment of income or principal by the beneficiaries.
10. Your petitioner believes that it is impracticable to fund the trusts in strict conformity
with the testamentary charitable bequests.
11. Your petitioner believes that the cypres doctrine warrants outright distribution of
residue in the testamentary share percentages.
12. There is attached hereto and marked Exhibit "B," correspondence from the Office of
the Attorney General of the Commonwealth of Pennsylvania communicating its lack of objection
to the outright distribution of residue under the conditions therein enumerated.
13. There is attached hereto and marked Exhibit "C," the release of the contingent interest
of Carlisle Area Health and Wellness Foundation, successor in interest to Carlisle Hospital for
purposes of this petition (see proceedings in the Orphans' Court of Cumberland County,
Pennsylvania, at No. 2001- 0518), to allow the outright distribution of the testamentary share to
Barnitz Methodist Church upon the payment to the Foundation of the sum of $5,000.00 from the
share of Bamitz Methodist Church.
14. There is attached hereto and marked Exhibits "D" & "E," the approvals of Barnitz
Methodist Church and the Salvation Army for the outright distribution of the residuary shares of
each.
WHEREFORE, your Petitioner respectfully requests the entry of a Decree, under the
authority of 20 Pa. C.S. § 6110, directing the payment of $5,000.00 to Carlisle Area Health and
Wellness Foundation from the share of Barnitz Methodist Church and further directing the outright

/~i, ANNA R. McCOY, of Pine Road, Mount Holly Springs, Cumberland
County, Pennsylvania, being of sound mind, memory and understanding,
do make, publish and declare this as and for my last will and testament,
hereby revoking and making void all former wills by me at any time
heretofore made.
FIRST. I direct all my just debts including all inheritance
taxes be fully paid and satisfied out of my estate by my personal
representative hereinafter named as soon as conveniently may be done
after my decease.
SECOND. I give~ devise and bequeath all my property whatsoever
~ ~ to be his
and wherever situate unto my husband, ~. Grant ~4cCo¥,
absolutely.
THIRD. In the event my said husband ~redeceases me, then I
give, devise and bequeath all of my property, whatsoever and wherever
situate, as follows:
1. Two-third (2/3rd) thereof to the Farmers Trust Company, of
Carlisle, Pennsylvania, in trust, for the Barnitz ~thodist Church,
Barnitz, Pennsylvania, of which Ii am a member, the income from which
shall be used each year for such purposes as the Board of Directors
shall think best in their discretion and, if the said Church fails to
exist, then the corpus thereof and any accrued interest shall be ~aid
to the Carlisle Hospital, Carlisle, Pennsylvania..
2. One-third (1/3rd) thereof to the Farmers Trust Company, of
Carlisle, Pennsylvania, in trust, for the Salvation Army of Carlisle,
Pennsylvania, ~e income of which to be used for the benefit of the
poor people of the Carlisle area.
LASTLY, I nominate, constitute and appoint my said husband, W.
Grant ~4cCoy, Executor of this m~~ last will and testament, and in the
event he should predecease me or is unable to serve, I nominate,
constitute and appoint the Farmers Trust Company, of Carlisle, as
successor Executor, and I order and direct that }tenry L. Stuart be
employed as attorney in the settlement of my estate due to his
familiarity and knowledge of my affairs and business.
