Spatter , an incapacitated person (Deceased) Record#: 21-06-813 Greetings Your Honor, PA Guardianship Assoc. was appointed guardian of Ruth V. Spatter by court order dated 10/26/06. In that order PA Guardianship was ordered to post a bond in the amount of $100,000.00. Ruth V. Spatter died on 9/18/08. The Insurance Co. that holds the bond will need a release order signed by the Orphan's Court to cancel the bond. SPATZER PETITION PURSUANT TO SECTION 5511 OF THE PROBATE, ESTATES AND FIDUCIARY CODE TO ADJUDICATE RUTH V. SPATZER TO BE INCAPACITATED AND TO APPOINT GUARDIANS FOR HER PERSON AND HER ESTATE FINAL ORDER OF COURT APPOINTING A PLENARY GUARDIAN AND NOW, this a G ~ day of ~~'~~° ~~ 2006, a hearing in this case havin been held on O~ ~ 4 g 2006, and it appearing to the Court that Ruth V. Spatter was properly served with a Citation and Notice of this hearing. Based upon the testimony presented at the hearing, the Court further finds from the #estimony: 1. That Ruth V. Spatter is an incapacitated adult individual who suffers from cognitive disabilities which impairs her capacity to receive and evaluate information effectively and to make and communicate decisions concerning her~physical_health and safety. 2. That there exists no other less restrictive aftemative mechanism for decision making. 3. That based on the total incapacity of Ruth V. Spatter to receive and evaluate information and to make or communicate decisions, a plenary guardian of the person is required on a permanent basis. NOW, THEREFORE, based on the clear and convincing evidence supporting the foregoing findings 'tt is ORDERED, ADJUDGED and DECREED that Ruth V. Spatter be and is hereby adjudged an incapacitated person and Pennsylvania Guardianship Association is appointed Plenary Guardian of the Person of Ruth V. Spatter. ~ond shall be required of the Plenary Guardian named hereiny- O 0'~'?? . /D ~ The Plenary Guardian is hereby authorized to make decisions on Ruth V. Spatrer's behalf concerning her medical care and treatment including the admission to nursing homes, personal care facilities, hospitals and other healthcare providers, as welt as to consent to and authorize medical treatment; and the Plenary Guardian herein appointed is further authorized to handle all the assets of her estate including the principal and interest, and to conduct her business affairs on her behalf, including the sale or transfer of any assets including the sale of her home at 32 Highland Drive, Lower Allen Township, Cumberland County, Pennsylvania, payment of her bills and expenses, investment of assets and all matters related thereto. The Pennsylvania Guardianship Association is due a reasonable fee for its services to be deducted from the income of the incapacitated person. In the event Ruth V. Spatrer qual~es for medical assistance benefits, the Pennsylvania Guardianship Assoaatian, Inc. shall be entitled to a reasonable fee~for its services. J.
