STIPULATION AGAINST LIENS
THIS AGREEMENT made this 31st day of October, 2008, by and
between Neidlinger Fine Homes LLC, hereinafter referred to as
Contractor,
Larry V. Neidlinger and Mary Jo Neidlinger, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct single family dwelling on the
certain lot of ground situate in West Pennsboro Township,
Cumberland County, Pennsylvania, known as Lot 7 Kerrsville Road,
and more fully described in Exhibit "A" which is attached hereto
and made a part hereof.
NOW THEREFORE, THIS AGREEN~iT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

of Neidlinger Fine Homes LLC, known to me (or satisfactorily
proven) to be the person whose name is subscribed to the within
instrument, and acknowledged that he executed the same for the
purposes therein contained.

ALL THAT CERTAIN tract of land situate in West Pennsboro Township,
Cumberland County, Pennsylvania, Lot No. 7 on the Final Subdivision Plan of Gerald P.
Jones and Marjorie L. Jones, recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Plan Book 94, Page 49, the same being numbered as
more particularly described as follows:
BEGINNING at a point of the eastern right of way of Kerrsville Road (T-326) of the
aforementioned Plan, thence along the dividing lines between Lot No. 7 and Lot No. 2, North
52 degrees 37 minutes O1 seconds East 320.57 feet to a point; thence continuing along the
dividing line between Lot No. 7 and Lot No. 2, North 34 degrees 46 minutes OS seconds East
214.48 feet to a point; thence along the dividing line between Lot No. 7 and Lot No. 6, North
56 degrees 37 minutes 55 seconds West 382.49 feet to a point; thence continuing along Lot
No. 7 and Lot No. 6, North 85 degrees 22 minutes 19 seconds East 417.52 feet to a point;
thence along the dividing line between Lot No. 7 and lands now or formerly of Zane R.

point; thence along the eastern right of way of Kerrsville Road (T-326), South 22 degrees 20
minutes 19 seconds West 37.06 feet to a point; thence continuing along Kerrsville Road (T-
326), by a curve to the left having a radius of 1262.00 feet, an arc length of 10.94 feet to the
point and place of BEGINNING.
CONTAINING 4.52 acres more or less.
