On or about 05/01/2007 at or near 4005 Three Square Hollow Road, Hopewell Township, Cumberland County, PA, a horse belonging to Defendants Richard A. Rea Jr. and Lorian Rea exited their property and proceeded onto the highway, Route 4005. 7. The horse proceeded to cause a collison with the Plaintiffs vehicle causing damages to same in the amount of $4,440.10. 8. The negligence of the Defendant consisted of a) failing to properly secure livestock; b) being inattentive; c) failing to properly fence in horse; d) failing to take proper safety precautions; e) other such negligence that may be developed through continuing discovery and trial of this matter. 9. The aforesaid collision resulted solely from the negligent acts and/or failure to act on part of Defendant named herein and was due in no manner whatsoever to any act and/or failure to act on part of Plaintiff s insured. 10. As a result of the aforesaid collision, Plaintiff State Farm Mutual Automobile Insurance Company settled the collision claim of Trevor Benner in the amount of $4,440.10 (said figure includes the first party deductible) representing fair and reasonable reimbursement for the damages sustained. 11. Pursuant to the aforesaid policy of insurance, State Farm Mutual Automobile Insurance Company is subrogated to Trevor Benner for this loss.
