Marzella & Associates, P.C. to withdraw as counsel for Administrator Castle in the above captioned estate and in support thereof aver as follows: 1. On October 1, 2003, Betty J. Castle suffered an untimely death. 2. Ralph E. Castle, Ms. Castle's husband, wished to pursue a potential medical malpractice action on behalf of her estate, and sought the services of the firm of Metzger Wickersham to investigate the matter and aid in administration of her estate. 3. On or around December 23, 2003, Mr. Castle, was named Administrator of Ms. Castle's estate at the Cumberland County Register of Wills. 4. Metzger Wickersham attorney, Jered L. Hock, Esquire, was retained to represent him for -?~ -T- s -r=~ .~v -n purposes of estate administration. 5. Over the next several years, administration of the estate was halted because Administrator Castle became impossible to contact. 6. Numerous letters were sent to his home and several phone calls were made, all to no avail. 7. A people search that was conducted on the Internet revealed that his last known address was the same one where correspondence was being sent. 8. On September 17, 2008, Administrator Castle appeared to sign for a certified letter sent by the firm to him, urging him to contact them immediately. 9. However, there was still no communication of any kind from Administrator Castle. 10. On or around September 24, 2009, Jered L. Hock, Esquire withdrew as counsel for Administrator Castle and Robert P. Grubb, Esquire entered his appearance. 11. Mr. Grubb continued the attempts to communicate with Administrator Castle, but failed. 12. Up to this point and for the past several years, the attorney of record was forced to continue __ _ I I filing Status Reports stating that there is a delay in administration because Administrator Castle could not be reached. 13. On or around October 30, 2009, Robert P. Grubb, Esquire withdrew his appearance as counsel of record for Administrator Castle and Cynthia M. von Schlichten, Esquire of RJ Marzella & Associates, entered her appearance as counsel of record, as authorized by Metzger Wickersham. 14. Since then, Counsel has continued the numerous attempts to contact Administrator Castle. 15. However, every attempt has been fruitless. 16. Accordingly, Counsel now requests permission to withdraw as Counsel for Administrator Castle with respect to the Estate of Betty J. Castle. 17. Obviously, it is impossible to continue aiding in the administration of the estate without any contact with the Administrator.
