The Petition of Phoebe A. Brinley respectfully states that: -3~c~''~, t1

1. Petitioner Phoebe A. Brinley is the Administratrix of the Estate~f Williarrx.5. ' '~ ~'

Brinley, her son, who departed this life on February 15, 2008, and was, at the time of his death, a
resident of New Cumberland Borough, Cumberland County, Pennsylvania.
2. Samantha M. Brinley, natural daughter of the decedent, and a minor who was
born on August 23, 1994, and resides with her natural mother, Kimberly A. Lamarca, at 118
White Dogwood Drive, Etters, Pennsylvania, is the sole beneficiary of the Estate of William S.
Brinley.
3. A guardian of the minor's estate is necessary because the minor is the beneficiary of
the Estate of William S. Brinley and is also the beneficiary of her late father's Individual
Retirement Account with American Funds Service Company, with an account balance as of her
father's date of death in the amount of $65,010.00.
4. Kimberly A. Lamarca, the proposed. co-guardian is 42 years of age, resides at 118
White Dogwood Drive, Newberry Township, York County, Pennsylvania, and is employed by
Kreamer Brothers Glass as the office manager.
5. Elaine Brinley, the proposed co-guardian, is 45 years of age, resides at 375 Futurity
Drive, Fairview Township, York County, Pennsylvania, and is employed by Tyco Electronics as
an accountant.
6. Kimberly A. Lamarca, the proposed co-guardian, is the natural mother of the minor
and has no interest adverse to the minor.
7. Elaine Brinley, the proposed co-guardian, is the sister-in-law of the decedent and the
maternal aunt, by marriage, of the minor and has no interest adverse to the minor.
8. The minor's estate is composed of the proceeds from the estate of her late father, in an
amount yet to be determined, and the proceeds of the independent retirement account, currently
being held by American Funds Service Company pending the appointment of a guardian for the
minor's estate.
WHEREFORE, Petitioner respectfully requests that this Court appoint Kimberly A.
Lamarca and Elaine Brinley co-guardians of the estate of Samantha M. Brinley, a minor, and to
authorize them to invest the proceeds of the estate payable to the minor in restricted savings
certificates and savings accounts and to rollover the independent retirement account into a
suitable similar account, in lieu of entry of security in accordance with 20 Pa. Cons. Stat. §§5103
and 5122.

I reside at 118 White Dogwood Drive, Newberry Township, York County, Pennsylvania
and is employed as the office manager with Kreamer Brothers Glass of Camp Hill, Pennsylvania.
I am a citizen of the United States and can speak, read and write the English language.
I have no interest adverse to the minor.
It is not the intention of the guardian to apply for an allowance for the support or
education of the minor during minority.

I am a citizen of the United States and can speak, read and write the English language.
I have no interest adverse to the minor.
It is not the intention of the guardian to apply for an allowance for the support or
education of the minor during minority.
