I bequeath all of my automobiles and all other articles of personal or household use, including but not limited to household goods, furniture, personal effects, and other tangible personal property to COLBY FAIRCHILD. B. I devise and bequeath all the rest, residue and remainder of my estate of whatever nature and wherever situate unto Dauphin Deposit Bank and Trust Company, Trustee, IN TRUST, NEVERTHELESS, for the following uses and purposes and under the following terms and conditions: 1. The trust shall be held for the benefit of my grandnephew, COLBY FAIRCHILD. The trustee shall invest and reinvest the principal and out of the income derived by the trustee, trustee shall pay all the necessary costs and expenses of the trust, including its reasonable compensation, and shall pay the net income to or for the benefit of my grandnephew. The trustee, at. its sole and absolute discretion, may make expendi- tures from the principal of the trust as it may deem necessary for the support, maintenance and education of said beneficiary. As he attains the age of 35, he shall have the right to withdraw one-third of the principal balance of the trust; as he attains the age of 40, he shall have the right to withdraw one-half of the then-remaining principal; as he attains the age of 45, he 2 SAIDIS, SHUFF & MASLAND AT~ORh~'~*AT*LAW 2109 Market Street Camp Hill, PA shall have the right to terminate the trust and receive the balance of the funds. Such rights of withdrawal may be exercisec at any time or from time to time after the right accrues. If he shall have attained any such respective ages at the time when such shares are directed to be set apart or at the time when any addition is made thereto, he shall then have the right to with- draw such part or parts or all, as the case my be, of such share as is given to him upon attaining such respective age. 2. Should the said COLBY FAIRCHILD die before distribution of the entire share held for his benefit, the principal and any accumulated and undistributed income of the share shall then be distributed to his issue. Should he die and have no issue surviving, including afterborn issue, then the remaining principal and accumulated and undistributed income of the share shall be distributed to his heirs at law. 3. No interest in income or principal shall be assignable by, or be available to anyone having a claim against, my said beneficiary before actual payment to the benefi- ciary. To retain any or all of the assets of this trust, real or personal, including its own stock, without regard to any principal of diversification or risk. B. To invest in all forms of property, including stock, common trust funds and mortgage investment funds whether operated by it or others, without restriction to investments authorized for Pennsylvania fiduciaries, as it deems proper, without regard to any principal of diversification or risk. C. To sell at public or private sale, to ex- change, or to lease for any period of time, any real or personal property and to give options for sales, exchanges or leases, for property for such prices and upon such terms or conditions as it deems proper. D. To allocate receipts and expenses to princi- pal or income or partly to each as it from time to time thinks proper in its sole discretion. E. To make payment to the parents or guardians of any minor or incompetent beneficiary. F. To hold property in my name or in its name, or in the name of a nominee or unregistered. G. To lend to, or purchase from, my executor even though trustee may also be such executor. VII - I appoint ELMER G. ENGLE, Executor of this, my Last Will and Testament.
