Plaintiff, Pennsylvania State Employees Credit Union ("PSECU") is a Pennsylvania financial institution having an office at One Credit Union Place, Harrisburg, Pennsylvania 17110. 2. Defendant, David J. Leach, is an adult individual with a last known address of 527 Walnut Street, Lemoyne, Pennsylvania 17043-1547. 3. On or about May 3, 1990, Defendant applied for a Personal Service Loan ("Account I") with PSECU. A true and correct copy of the Personal Service Loan Application is attached hereto as Exhibit "A" and incorporated by reference. 2431440-1 4. On or about June 11, 1990, Defendant applied for a Visa and Mac account ("Account II") with PSECU. A true and correct copy of the Visa and Mac Application is attached hereto as Exhibit "B" and incorporated by reference. 5. PSECU approved Defendant's applications, opened accounts in Defendant's name and issued a Visa credit card to Defendant. 6. At various times Defendant received Personal Service Loan advances and made purchases on Account I and Account II subject to the terms and conditions of PSECU's Loanliner Credit Agreement and Truth in Lending Disclosure ("Agreement"). A true and correct copy of the Agreement and Plaintiff's statements showing charges to Account I and Account II are attached hereto as Exhibit "C" and incorporated by reference. 7. Defendant is in default under Account I and Account II for failure to make payments when due. 8. Notices of default were sent to Defendant: on May 23, 2008 and August 26, 2008. A true and correct copy of the notices are attached hereto as Exhibit "D" and incorporated by reference. 9. The balance due and owing to PSECU from the Defendant on Account I is $2,546.25, plus collection costs of twenty percent (20%) or $509.25 for a total of $3,055.50. 10. The balance due and owing to PSECU from Defendant on Account II is $7,138.51, plus reasonable attorneys' fees of $1,427.70 for a total of $8,566.21. 11. PSECU has demanded payment from the Defendant, but despite these demands, the Defendant has refused and continues to refuse to make payments. 12. On or about October 17, 2002, the Defendant executed and delivered to PSECU a Home Equity Line of Credit Agreement (the "Note") in the original principal sum of $21,700.00. 2431440-1 2 A true and correct copy of the Note is attached hereto as Exhibit "E" and incorporated by reference. 13. The Note carries interest at the yearly rate of 1.500 percent above the highest prime rate as published in the Money Rates Table in the last issue of the "Wall Street Journal" on the last day of the preceding month but one, and requires Defendant to make monthly payments equal the greater of $50.00 or a dollar amount based on the principal balance as of the date of the last draw, the current interest rate and a term of 120 months. 14. The Note requires Defendant to pay a late charge of five percent (5%) of the overdue payment when PSECU does not receive Defendant's monthly payment within fifteen (15) days of the date that the payment is due. 15. The Note is secured and accompanied by an Open-End Mortgage (the "Mortgage") dated October 17, 2002 and recorded in the Office of the Recorder of Deeds of and for Dauphin County, Pennsylvania in Book 4741, Page 305 on Defendant's property located at 2328 Berryhill Street, Harrisburg, Dauphin County, Pennsylvania (the "Premises"). A true and correct copy of the Mortgage is attached hereto as Exhibit "F" and incorporated by reference. 16. Defendant is in default under the Note and Mortgage for failure to make monthly payments which were due beginning April 16, 2008 and on the 16th day of each month thereafter. 17. Notice as required by the Homeowner's Emergency Mortgage Assistance Act of 1983 (Pennsylvania Act 91) was sent to Defendant by certified mail, return receipt requested on July 16, 2008. A true and correct copy of this Notice is attached hereto as Exhibit "G" and incorporated by reference. 2431440-1 18. Pursuant to the Note, in the event of Default, PSECU may, and hereby does, declare all amounts owed under the Note, including principal, accrued interest, late charges, and all other charges, including reasonable attorneys' fees, to be immediately due and payable. 19. Pursuant to the Note, in the event of Default, PSECU is entitled to be reimbursed for all costs and expenses, including reasonable attorneys' fees incurred in bringing any action to enforce the Note. 20. For purposes of this action, PSECU believes, and therefore avers, that $3,000.00 constitutes reasonable attorneys' fees for enforcing the Note. However, PSECU recognizes that it is restricted by law to those attorneys' fees that are actually incurred. If those fees are less than $3,000.00, PSECU agrees to adjust its demand for attorneys' fees, if applicable, at the time payment on any judgment is made. 21. As of October 7, 2008, the amount due on the Note and the Mortgage is as follows: Principal Balance $21,223.26 Interest through October 7, 2008 555.18 Satisfaction Fee 28.50 Collection Fees 50.00 Attorneys' Fees 3,000.00 $24,856.94 plus attorneys' fees and costs. 22. PSECU has demanded payment from Defendant, but despite these demands, the Defendant has refused and continue to refuse to make payments. 23. Pursuant to the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq., Defendant may dispute the validity of the debt or any portion thereof. If Defendant does so in writing within thirty (30) days of receipt of this pleading, Counsel for Plaintiff will obtain and provide Defendant with written verification thereof, otherwise, the debt will be assumed to be 2431440-1 4 valid. The 'credit-union' means PSECU or anyone to whom the credit union transfers its rights under this Plan. HOW THIS PLAN WORKS - The credit union anticipates that you volt borrow( money (called advances) under this Plan from time to time. The credit union, however. Is not required to make advances for you under this Plan and can refuse a request for an advance at any time. The Addendum describes the different types of credit (called subaccounts) available under this Plan. If you have been approved for credit under a subaccount marked with a star ('), you will be given a specific credit limit for that subaccount. For other subaccounts you may not be given a specific dollar limit. PROMISE TO PAY - You promise to repay to the credit union all advances made to you under this Plan and any applicable charges described in the Addendum together with interest on what you owe until the total amount has been repaid. The interest rate depends on the subaccount under which the advance is made. The Addendum shows the current interest rates as daily periodic rates and their corresponding annual percentage rates. If the interest rate for any or all advances Is a variable interest rate, the Addendum explains how the variable interest rate works. PAYMENTS - The amount of payments for an advance is determined according to the payment schedule in the Addendum. If the Addendum has no payment schedule for a subaccount, the amount and due date or payments will be determined 21 the time or each advance. You may pay any or all of the principal balance on any business day. You promise to make payments in the amount required under the payment schedule provided on your disclosure statement. Payments are not reduced as the principal balance declines, even it the new advances are made. Payments must Include any amount past due and any amount by which you have exceeded any credit limit you have been given for a subaccount. You may prepay all or part of whal you owe at any lime without any prepayment penalty. LATE CHARGE - If your (minimum) payment is not received by us within 15 days or its d8b date vve may charge and you have to pay a late charge or 5% of the overdue payment. COST OF CREDIT - The dollar amount you pay for money borrowed is called a finance charge and begins on the dale of each advance. To compute the finance charge, the unpaid balance (or each day since your last payment (or since an advance if you have not yet made a payment) Is multiplied by the applicable daily periodic rate. The sum of these amounts Is the finance charge owed. The balance used to compute the finance charge is the unpaid balance each day site( payments and credits to that batance have been subtracted and any new advances have been added. A finance charge will be computed separately for each separate balance under this Plan. SECURITY INTEREST - You agree that all balances under this Plan except those obtained by using your ATM card to access your line or credit subaccount will be secured by the shares and deposits in all joint and Individual accounts you have with the credit union now and in the future. You will give us a security interest in all individual and joint accounts you have with the credit union now and in the future to secure art advances obtained by use of your ATM card. Additional security will be required depending on the subaccount under which an advance is requested. For example, a subaccount called 'New Car Advances' means the security will be a new car. Shares and deposits in an Individual Retirement Account and any other account that would lose special tax treatment under slate or federal law if given as security are not subject to the security Interest you have given in your shares and deposits. Property given as security under this Plan or for any other loan may secure all amounts you owe the credit union new and in the future. However, to( purposes of loans made under this LOANLINER Agreement, the credit union specifically waives any security interest it may have in your dwellings given through any other mortgages or security agreements. DEFAULT - You will be in default if you do not make a payment of the amount required when ft Is due. You will be in default if you break any promise you made under this Plan or if anyone is in default under any security agreement made in connection with an advance under this Plan. You will be in default if you die, rile for bankruptcy, become insolvent, have your PSECU account gamished, if you make any false or misleading statements in any credit application or update of credit information, or if something happens which the credit union believes may substantially reduce your ability to repay what you owe. In the case of loans ncf conforming to policy, the credit union reserves the right to charge the highest signature subaccount interest rase currently in effect at PSECU or may require payment in full When you are in default the credit union can demand immediate payment of the entire unpaid balance under this Plan without giving you advance notice. If immediate payment is demanded, you will continue to pay Interest, at the applicable interest rates in effect under this Plan, until what you owe has been repaid. If a demand for immediate payment has been made, the shares and deposits given as security for this Plan can be applied towards what you owe. The credit union can also exercise any other rights given by law when you are in default. PROPERTY INSURANCE - You will be required to purchase property insurance on certain types of security that you give for advances. You may purchase the property insurance from anyone you choose that is acceptable to the credit un:on. In addition, at any time your Total New Balance exceeds your Credit Line, you must Immediately pay the excess upon our demand. We will apply your payments first to the Finance Charge on both purchases and cash advances, then to any billed fees, then to the principal balance of purchases in the order they were posted to your account and then to the principal balance of cash advances. FINANCE CHARGES - You can avoid Finance Charge on purchases by paying the full amount of the New Balance of Purchases each month within 25 days of your statement closing date. Otherwise, the New Balance of Purchases, and the subsequent purchases from the date they are posted to your account, will be subject to Finance Charge. Cash advances are always subject to Finance Charge from the date they are posted to your account. Monthly Periodic Finance Charge, Monthly Periodic Rate and Annual Percentage Rate. The Finance Charge is the Monthly Periodic Finance Charge. The Monthly Periodic Finance Charge (or each billing cycle will be calculated by multiplying the Average Adjusted Balance (see explanation below) for your Account for the billing cycle by the Monthly Periodic Rate as disclosed on the Addendum Calculation of the Average Adjusted Dairy Balance. We calculate your Average Adjusted Daily Ba•arce (the balance which is subject to the Nlonlhly Periodic Rate) as follows: - The Average Az;justed Daly Balance for ycur account for the billing cycle is the average of the adjusled daily balances for each day of the billing cycle. To calculate the Adjusted Daily Balance each day, we lake the following steps: We lake the outstanding balance (all amounts you ovre) at the start of the day. Then, in the sequence in which the amounts post to your account, we add the amounts or all debits and subtract the amounts of all payments and credits which post to your account that day. Payments are applied first to any Late Charges, then to any Overlimit Charge, then to any unpaid Finance Charge for previous billing cycles, Annual Fee, then to the Cash Advance balance, and then to the balance of your Account. Credits ate applied first to the particular type of debt which is being credited, if any, and then to the balance of your account. After applying payments and credits, we subtract any amount of Finance Charge, Late Charge, Overlimil Charge and Annual Fee that remains unpaid. Then we also subtract the amount of any Cash Advance transaction that posts to your account on that day or on any previous day on the same billing cycle. The result is the Adjusted Daily Balance for that day. We add together all the Adjusted Daily Balances for each day in the billing cycle and divide the total by the number of days in the billing cycle. The result is the Average Adjusted Daily Balance for Thal billing cycle. Note that cash advance transactions which are posted to your Account during a billing cycle are not included in the Average Adjusted Oaity Balance for that cycle, and are therefore not subject to the Monthly Periodic Rate during that cycle. However, they are included in the New Balance shown on the statement for that cycle, and are therefore also included in the outstanding balance at the start of the first day of the next billing cycle. Nola also that if the total of the payments and credits which are posted to your account by the Payment Due Dale shown on a statement is equal to or exceeds the New Balance shown on that statement, we will not apply the Monthly Periodic Rate to your Account on your next statement. DEFAULT - You will be in default if you fail to make any Minimum Payment within 25 days after your monthly statement closing date. You will also be In default tf your ability to repay us is malerially reduced by a change in your employment, an increase in your obligations, bankruptcy or insolvency proceedings involving you, your death or your failure to abide by this Agreement, or if the value of our security interest materially declines. We have the right to demand immediate payment or your full account balance if you default, subject to our giving you any notice required by law. To the extent permitted by law, you will also be required to pay our collection expenses, ini, luding court costs and reasonable attorney fees. USING THE CARD - To make a purchase or cash advance, there are two alternative procedures to be followed. VISA LOAN - PERSONAL SERVICE LOAN (PSL) INFORMATION FINANCE CHARGE: ANNUAL PERCENTAGE RATE - 1407o DAILY PERIODIC RATE -.00038356 Finance charges begin to accrue upon the date each loan advance is processed. No period exists during which loan advances may be repaid without incurring a finance charge. The single daily periodic rate that we use to compute the finance charge on your entire unpaid balance is .00038356 which is an ANNUAL PERCENTAGE RATE OF 14%. We figure the finance charge on your account for any payment by applying the periodic rate to the "unpaid loan balance' after the previous payment was made. This gives you the interest for one period (day). We then multiply the interest for one period (day) by the number of periods (days) which have elapsed since the last finance charge was applied. The balance used to compute the finance charge is the actual unpaid balance each day after credits are subtracted and new advances are added. The following chart gives examples of the finance charge when paid according to the VISA LOAN SCHEDULE: TOTAL LOAN MONTHLY LAST TOTAL OF FINANCE BALANCE PAYMENTS PAYMENT PAYMENTS CHARGE 12,500 102 @ 210 51.08 21,471.08 8,971.08 12,000 103 @ 200 165.13 20,765.13 8,765.13 11,500 100 @ 195 88.18 19,588.18 8,088.18 11,000 97 @ 190 6.80 18,436.80 7,436.80 10,500 93 @ 185 106.83 17,311.83 6,811.83 10,000 90 @ 180 12.66 16,212.66 6,212.66 9,500 91 @ 170 1.60 15,471.60 5,971.60 9,000 87 @ 165 37.86 14,392.86 5,392.86 8,500 88 @ 155 6.68 13,646.68 5,146.68 8,000 88 @ 145 142.08 12,902.08 4,902.08 7,500 84 @ 140 80.39 11,840.39 4,340.39 7,000 80 @ 135 10.30 10,810.30 3,810.30 6,500 75 @ 130 63.05 9,813.05 3,313.05 6,000 70 @ 125 97.91 8,847.91 2,847.91 5,500 65 @ 120 115.76 7,915.76 2,415.76 5,000 61 @ 115 1.82 7,016.82 2,016.82 4,500 55 @ 110 101.70 6,151.70 1,651.70 4,000 54 @ 100 19.29 5,419.29 1,419.29 3,500 52 @ 90 11.05 4,691.05 1,191.05 3,000 49 @ 80 48.21 3,968.21 968.21 2,500 46 @ 70 32.68 3,252.68 752.68 2,000 42 @ 60 27.33 2,547.33 547.33 1,500 37 @ 50 6.76 1,856.76 356.76 1,000 29 @ 40 28.98 1,188.98 188.98 500 18 9 30 19.09 599.09 59.09 VISA LOAN M NIMUM MONTHLY PAYh1ENT SCHEDULE LOAN LOAN LOAN IRAN BALANCE PAYMENT BALANCE PAYMENT 0-500 $30.00 6001-6500 5130.00 501-1000 40.00 6501-7000 135.00 1001-1500 50.00 7001-7500 140.00 1501-2000 60.00 7501-8000 145.00 2001-2500 70.00 8001-8500 155.00 2501-3000 80.00 8501-9000 165.00 3001-3500 90.00 9001-9500 170.00 3501-4000 100.00 9501-10000 180.00 4001-4500 110.00 10001-10500 185.00 4501-5000 115.00 10501-11000 190.00 5001-5500 120.00 11001-11500 195.00 5501-6000 125.00 11501-12000 200.00 12001-12500 210.00 The following chart gives examples of the Finance Charge when paid according to the PSL SCHEDULE: TOTA L LOAN MONTHLY LAST TOTAL OF FINANCE BALANCE PAYMENTS PAYMEN T PAYMENTS CHARGE 12,500 102 @ 210 51.08 21,471.08 8,971.08 10,000 90 @ 180 12.66 16,212.66 6,212.66 7,500 84 @ 140 80.39 11,840.39 4,340.39 5,000 61 @ 1.15 1.82 7,016.82 2,016.82 3,500 52 @ 90 11.05 4,691.05 1,191.05 2,500 46 @ 70 32.68 3,252.68 752.68 1,000 19 @ 60 38.27 1,118.27 118.27 PSL MINIMUM PAYMENT SCHEDULE LOAN BALANCE AT TIME MINIMUM PAYMENT OF WAN ADVANCE MONTHLY BIWEEKLY s10,ooo.ol to $12,500.00 7,500.01 to 10,000.00 5,000.01 to 7,500.00 3,500.01 to 5,000.00 2,500.01 to 3,500.00 I ,000.01 to 2,500-00 up to 1,000.00 $210.00 5105.00 180.00 90.00 140.00 70.00 120.00 60.00 100.00 50.00 70.00 35.00 60.00 30.00 FIRST PAYMENT Your first payment is due and payable 30 days from the date of loan advance. Other In this Agreement, you and yours refers to the credit union, 1, me, and my means each person whose request for a Home Equity Line of Credit Account has been approved by you. Account means the Home Equity Line of Credit Account Premises means the property securing this Account. 1 agree to the following: 1. PROMISE TO PAY. I promise to pay you all amounts I borrow under this Account, as well as all finance charges and other applicable costs. In addition, if I permit someone else to use my Account, I am responsible to you for repayment as if the advance were my own. 2. PAYMENTS. I can obtain advances of credit for five years (the draw period). After the draw period ends, I will no longer be able to obtain credit advances and 1 must repay the outstanding balance over ten years from the date of the last draw. During both the draw and repayment periods, payments will be due monthly. My minimum payment will equal the greater of $50, or a dollar amount based on the principal balance as of the date of the last draw, the current interest rate and a term of 120 months. During the repayment period, my monthly minimum payment will continue to be based upon the principal balance at the date of the last advance, the current interest rate and a ten year term from the date of the last advance, or $50, whichever is greater. 3. FINANCE CHARGE. The Annual Percentage Rate will be 1.500 percent above the highest prime rate as published in the Money Rates Table in the last issue of the "Wall Street Journal" on the last day of the preceding month but one. The rate change will be effective on the first day of the month. The minimum Annual Percentage Rate is 6 percent. The maximum Annual Percentage Rate is 21 percent. Computing how much interest will be taken from each loan payment is easy. You start by multiplying any unpaid loan balance by the daily factor to give you the interest charge for one day. To determine the daily factor, divide the current interest rate by 365 days and carry the answer eight decimal places. The interest charge for one day is then multiplied by the number of days since the last payment. An example of an interest calculation is shown below based on a 9 percent interest rate. Loan Balance = $5,000 Number of Days Since Last Payment = 31 $ 5,000 X .00024657534 =1.2328767 (daily interest charge) 1.2328767 X 31 = 38.22 (monthly interest charge) Finance charges begin to accrue on the date the transaction is posted to my account. The current periodic rate is .017123 % and the ANNUAL PERCENTAGE RATE is 6.250 %. An increase in the annual percentage rate will result in a higher minimum monthly payment. The annual percentage rate includes only interest and not other costs 4. LATE CHARGE. If my minimum payment is not received by you within fifteen (15) days of its due date, you may charge and I agree to pay a late charge of 5 percent of the overdue payment. 5. YOUR OBLIGATIONS. You agree to honor all advances made against my Account, up to my credit limit, for the term of this Agreement provided that each advance shall be for an amount not less than Five Hundred ($500.00) Dollars. Your obligation is unconditional unless I am in default under the Default Section of this Agreement. 6. CREDIT LIMIT. Equal Opportunity Lender I PSEf? If you do not make your payment and foreclosure proceedings have begun, you still have the right to make payment and prevent the sale at any time up to one hour before the Sheriff's sale. You may do so by paying the total amount of the unpaid monthly payments plus any other charges then due, as well as the reasonable attorney's fees and the costs connected with the foreclosure sale. It is estimated that the earliest date of the Sheriff's sale would be 90 days from the date of this letter. A notice of the date of the Sheriff's sale will be sent to you before the sale. Of course, the amount due will increase the longer you wait. You may determine your balance by calling me. Again, payment must be in cash or by a cashier's check, certified check or money order and payable to PSECU. You should realize that a Sheriff's sale would end your ownership of the mortgaged property and the right to remain in it. If you continue to live in the property after the Sheriff's sale, a lawsuit could be started to evict you. You have additional rights to protect your interest in the property: • You have the right to obtain money to pay off the mortgage debt; • You have the right to borrow money from another lending institution; and • You have the right to have the amount due paid by a third party acting on your behalf. You may have the right to sell or transfer the subject property to a buyer or transferee who will assume the mortgage debt, provided that all the outstanding payments, charges and attorney's fees and costs are paid prior to or at the sale, and that other requirements under the mortgage are satisfied. Contact us to determine under what circumstances this right might exist. If you make full payment of what you owe, the mortgage will be restored to the same status as if no default had occurred. However, you are not entitled to this right to cure your default more than three times in any calendar year.
