SETTLEMENT AGREEMENT AND FINAL RELEASE
In the estate of
NANCY GUTSHALL
THIS SETTLEMENT AGREEMENT AND FINAL RELEASE is made this '-``t r day of
October, 2007, by and among beneficiaries of the Estate of Nancy Gutshall, deceased, Jean P.
hotter, (hereinafter "hotter"); Faye Bur-r~gardner, (hereinafter "Baumgar-drier"); Crossroads
Community Church, (hereinafter "Church"); and Barbara Vogler, Executrix of the Estate,
(hereinafter referred to as "Executrix").
In accordance with the desire that the administration of the Estate be terminated without
the expense and delay of a court accounting, the parties hereto, in consideration of the mutual
covenants herein expressed and intending to be legally bound, hereby agree that:
WHEREAS: Letters Testamentary of the Estate were duly issued by the Register of
Wills of Cumberland County, Pennsylvania, on July 4, 2007, to Executrix; and
WHEREAS: Executrix has gathered the assets, consisting of real and personal property,
of the Estate. The Statement of Account of the said Executor, which is attached hereto and made
part hereof as Exhibit "A", constitutes the assets gathered, the debts paid, the disbursements
made, and the distribution to all respective parties hereto. A copy of the decedent's Last Will &
Testament is attached hereto and made part hereof as Exhibit "B"; and
WHEREAS: The balance/remainder of the Estate property has been distributed by the
Executor in accordance with this Settlement Agreement, and as stated in the Statement of
Account (Exhibit "A"); and
WHEREAS: Under the provisions of the Last Will and Testament of Nancy Gutshall, the
residuary estate is to be given to the following beneficiaries in the fractional shares set forth
opposite their names:
Motter 60% $46,542.92
Baumgardner 20% $15,169.34
Church 20% $18,021.89
$79,734.15
NOW THEREFORE, KNOW YE, that we the undersigned, Executrix and beneficiaries,
Motter, Baumgardner, and Church, the persons being entitled to inherit under the Last WiII and
Testament of Nancy Gutshall, do hereby acknowledge that we have been notified by Executrix,
in her capacity as Executrix, of full satisfaction and payment of all sum or sums of money,
legacies, bequests, and devises as given, devised and bequeathed to us pursuant to said Wi11,
and/or the amounts to us pursuant to said Will, which amounts we have this day acknowledged;
and which amounts, are in the amounts set opposite the Distributions to Each Beneficiary in the
Statement of Account, and to be distributed as to said Distribution Schedule in the Statement of
Account, attached hereto and made part hereof as Exhibit "A."
Agreement to waive filing of formal account
We each hereby stipulate that in order to avoid the expense and time involved in the
filing of a formal account and schedule of distribution, we each agree that no account is
necessary and we each hereby agree and consent to distribution being made without the f ling of
an account and schedule of distribution, with the same to be with the same force and effect as if
they had been filed and confirmed by the Orphan's Court Division of the Court of Common
Pleas, Cumberland County, Pennsylvania.

AFFIDAVIT
1N THE COMMONWEALTH OF PENNSYLVANIA
COUNTY OF DAUPHIN
