REAL ESTATE TAX APPEAL
AND NOW COMES the Property owner, Cumberland Pointe LP, by and through
their attorneys, Fred Siegel, Co. LPA, 1. Kieran Jennings, Esquire and files this Real
Estate Tax Appeal for property situated in Upper Allen Twp, Cumberland County,
Pennsylvania and alleges as follows:
I. Cumberland Pointe LP is the owner of certain commercial property known as
0000 Cumberland Pointe Circle, Cumberland County, Pennsylvania and assessed on the
records of Cumberland County as Parcel Number 42-24-0792-002 said property being
one parcel of ground of approximately 9.8576 acres having erected thereon a 113 unit
subsidized apartment complex.
2. The Appellant, Cumberland Pointe LP has the right to pay and all of the real
estate taxes on said property and to contest the assessment and market value of the same.
3. Defendant is the Cumberland County Board of Assessment Appeals that
established the assessment on said property for the tax year 2002 and thereafter.
4. The Appellants herein did file a real estate tax appeal on the assessment that
comprised the property for tax year 2002 having an assessment in the amount of
$6,258,630 on property known as Parcel Number 42-24-0792-002.
5. A hearing was held on September 26, 2001, and a Notice dated November 2, 2001
and mailed by the Defendant on November 2, 2001, was issued wherein no change was
made to the assessment. Attached hereto and marked Exhibit "A" is said Notice of
Appeal Decision.
6. The Appellants believe and therefore aver that the ratio of assessment to market
value in Cumberland County is 100% and that the current assessment is based upon a
market value of approximately $6,258,630.

7. The Appellants to the best of their knowledge, information and belief avers that
the market value of the property for the taxable year 2002, based on the economics of the
same, comparable sales, would indicate a market value not to exceed $3,260,000.
8. The Appellants believe and therefore aver that the present assessment as reduced,
based upon a market value of $6,258,630 for the parcel as above set forth is unjust,
inequitable and not based upon a proper legal foundation.
9. The Appellants believe and therefore aver that the said assessment and market
value that the same is based upon is unlawful, inequitable and unjust as it is not based
upon the current market value of the property.
10. The Appellants believe and therefore aver that the assessment requires a revision and
adjustment to reflect the current market value of the property and that the assessment be
based upon the appropriate ratio of assessment to market as established in Cumberland
County for the years that the tax appeal is in effect.

WHEREFORE, the Appellants herein request your honorable Court to set a
hearing date, take testimony and render a decision reducing the assessment in conformity
with the market values and ratio of assessment to market value as found by the Court and
in conformity with the laws of the Commonwealth for the tax year of 2002 and the years
thereafter until the appeal is heard.

AND NOW, comes Cumberland County Board of Assessment Appeals by Stephen D.
Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Motion for General
Continuance of which the following is a statement:
1. The parties have engaged in Informal Discovery and are anticipating settlement
negotiations which will continue beyond February 14, 2002, when the hearing for this case is
scheduled.
2. Each ofthe parties to this case desires a general continuance of the hearing
scheduled for February 14, 2002, and the undersigned acts at their mutual requests.
3. Specifically, J. Kieran Jennings, Esquire, attorney for Appellant, and Donna S,

Explanatory Comment
The Supreme Court of Pennsylvania has promulgated new Rule of Civil Procedure 230.2 governing the termination of
inactive cases and amended Rule of Judicial Administration 1901. Two aspects of the recommendation merit
comment.
I. Rule of civil Procedure
New Rule of Civil Procedure 230.2 has been promulgated to govern the tennination of inactive cases within the
scope of the Pennsylvania Rules of Civil Procedure. The termination of these cases for inactivity was previously
governed by Rule of Judicial Administration 1901 and local rules promulgated pursuant to it. New Rule 230.2 is
tailored to the needs of civil actions. It provides a complete procedure and a uniform statewide practice, preempting
local rules.
This rule was promulgated in response to the decision of the Supreme Court in Shop v. Eagle, 551 Pa. 360,710 A.2d
1104 (1998) in which the court held that "prejudice to the defendant as a result of delay in prosecution is required
before a case may be dismissed pursuant to local rules implementing Rule of Judicial Administration 190 I."
Rule of Judicial Administration 1901(b) has been amended to accommodate the new rule of civil procedure. The
general policy of the prompt disposition of matters set forth in subdivision (a) of that rule continues to be applicable.
II Inactive Cases
The purpose of Rule 230.2 is to eliminate inactive cases from the judicial system. The process is initiated by the
court. After giving notice of intent to terminate an action for inactivity, the course of the procedure is with the parties.
If the parties do not wish to pursue the case, they will take no action and "the Prothonotary shall enter an order as of
course terminating the matter with prejudice for failure to prosecute." If a party wishes to pursue the matter, he or she
will file a notice of intention to proceed and the action shall continue.
a. Where the action has been terminated
If the action is terminated when a party believes that it should not have been terminated, that party may proceed
under Rule230(d) for relief from the order of termination. An example of such an occurrence might be the termination
of a viable action when the aggrieved party did not receive the notice of intent to terminate and thus did not timely file
the notice of intention to proceed.
The timing of the filing of the petition to reinstate the action is important. If the petition is filed within thirty days of
the entry of the order of termination on the docket, subdivision (d)(2) provides that the court must grant the petition and
reinstate the action. If the petition is filed later than the thirty-day period, subdivision (d)(3) requires that the plaintiff
must make a show in to the court that the petition was promptly filed and that there is a reasonable explanation or
legitimate excuse both for the failure to file the notice of intention to proceed prior to the entry of the order of
termination on the docket and for the failure to file the petition within the thirty-day period under subdivision (d)(2).
B. Where the action has not been terminated
An action which has not been terminated but which continues upon the filing of a notice of intention to proceed may
have been the subject of inordinate delay. In such an instance, the aggrieved party may pursue the remedy of a
common law non pros which exits independently of termination under Rule 230.2.

between Petitioner, Cumberland Pointe, L.P., by its Attorney, Bert M. Goodman, Esquire, and

Mechanicsburg Area School District by its attorney, Donna S. Weldon, Esquire; and Intervenor,
Upper Allen Township, by its attorney, William E. Miller, Jr., Esquire, as follows:
1. Petitioner filed a Real Estate Tax Appeal on or about November 26,2001 to
which the Court entered an Order fixing a Hearing date of February 14,2002. By Order dated
January 15,2002, the Hearing scheduled for February 14,2002 was cancelled and the matter was
continued generally. The parties have now settled this case.
2. This Assessment Appeal relates to the market value applicable as of August 30,
2001, the date the appeal was originally filed before the Board of Assessment Appeals, effective
for assessments beginning on and after January 1,2002. The taxpayer appealed an assessment of

$6,258,630. At a Hearing held on September 26,2001, the Cumberland County Board of
Assessment Appeals ordered "no change" in the assessment.
3. The property which is the subject of this appeal is Cumberland County Tax Parcel
No. 42-24-0792-002, situate in Upper Allen Township, Cumberland County, Pennsylvania. The
property consists of a 113 unit apartment complex which was created under the Internal Revenue
Code Section 42 Tax Credit Program, and is subject to certain rental restrictions.
4. The parties stipulate that the total market value of the property as of the date of
the original appeal to the Board of Assessment Appeals, August 30, 2001, and at all times since,
is $5,500,000.
5. As a result of the year 2000 Cumberland County Countywide reassessment, the
predetermined ratio was 100% of year 2000 value until assessments for the year 2005.
Beginning with assessments for the year 2005, the predetermined ratio was 100% of year 2004
value, pursuant to the year 2004 Cumberland Countywide reassessment. The common level ratio
has not been applicable to the any of the assessment years which are the subject of the within
appeal. Therefore, the assessment shall be fixed as of January 1,2002 at $5,500,000, and the
same shall continue through December 31, 2006.
6. The Cumberland County Assessor's Office shall allocate the total assessments
between land and improvements as provided by law and the procedures of the Cumberland
County Assessment Office.
7. The said assessments shall be effective for tax years beginning on and after
January 1,2002 and shall remain unchanged unless and until changed as otherwise provided by
law, and shall be implemented beginning with the 2002 county and municipal taxes and
beginning with the 2002-03 school real estate taxes.

8. The Cumberland County Assessment Office shall promptly notify the appropriate
taxing bodies of the change in assessment, and instruct the taxing bodies to make appropriate
refunds.
9. Each party to this appeal shall bear its own costs.
10. The Court is requested to enter the proposed Order attached hereto.
11. The undersigned Attorneys each hereby warrant to the other and to the parties and
to the Court that he/she has reviewed this Settlement Stipulation with his/her client or clients and
that he/she has specifically been authorized to enter into this Settlement Stipulation by his/her

Stipulation and Joint Motion for Agreed Order, it is Decreed and Ordered that the total market
value of the subject property known as Cumberland County Tax Parcel No. 42-24-0792-002 as
