PETITION TO CHANGE AN APPROVED PLAN OF ELECTION REGIONS
Jurisdictional Statement
This Court has original jurisdiction over this Petition pursuant to 42 Pa.
C.S. § 931 (a) and Section 303 of the Public School Code of 1949, Act of March 10,
1949, P.L. 30, as amended, 24 P.S. § 3 -303.
Parties
1. Petitioner is the duly elected Board of Directors of the Mechanicsburg
Area School District ("District").
2. The current members of the School Board are Richard J. Bradley,
Dennis P. Burkhard, Dawn M. Merris, Tracy L. Morgan, Gregory P. Pappas, John Rupp,
Stephen E. Trask, Jerry S. Wills, Jr., and Raymond D. White, Jr.
Background
3. The municipal subdivisions of the District are Upper Allen Township,
Borough of Mechanicsburg and Borough of Shiremanstown.
4. The 2000 census information used in 2002 to support the current
regional plan was the following:

5. The current plan was approved by the Cumberland County Court of
Common Pleas on January 2, 2003. A map showing the current regions and election
districts is attached as Exhibit "A" and made a part hereof.
6. When the current plan was approved, the following election districts
existed and were the basis for the decision:
a. Upper Allen Township - Precincts 1, 2, 3, and 4
b. Borough of Mechanicsburg - Wards 1, 2-1, 2-2, 3, 4 and 5
c. Borough of Shiremanstown
7. By Resolution No. 818 adopted on December 19, 2007, the Board of
Commissioners of Upper Allen Township voted a precinct realignment to be presented
to the Cumberland County Court of Common Pleas for approval.
8. The Upper Allen Township precinct realignment of ten voting districts
was approved by the Order of the Cumberland County Court of Common Pleas on July
24, 2008.
9. The number of precincts in Upper Allen Township since the district
regional plan was approved has increased from four (4) to ten (10). A map showing the
current precincts in Upper Allen Township is attached as Exhibit "B" and made a part
hereof.
10. As a result of the Upper Allen Township voting precinct realignment,
the current plan of the school district is no longer in compliance with Section 303 of the
School Code because the regions are no longer compatible with the boundaries of
election districts which have changed as a result of the Upper Allen Township
realignment.
11. In order to comply with Section 303 of the School Code, the district
must realign the school board election regions to be compatible with the Upper Allen
Township realigned election districts.
12. At its Board meeting on October 28, 2008, the Board duly adopted by
resolution a proposed plan and directing that the plan be presented to this Court for
approval. A copy of the Resolution is attached hereto as Exhibit "C" and made a part
hereof.

Proposed Plan to Change Three Regions
13. In developing its proposed regional plan, the Board considered as
primary criteria the statutory mandates that the regions be as nearly equal as possible
and be compatible with the boundaries of election districts.
14. In addition to the two statutory criteria, the Board also considered the
following preferences:
a. To estimate and consider projected growth in each municipality
based on proposed subdivisions so that the proposed regional plan would not become
immediately obsolete;
b. To avoid any disruption of the four-year seats of the current elected
School Board; and
c. To incorporate an orderly transition to the proposed plan.
15. The Board considered and reviewed three possible options to
accomplish the restructuring of the regions based upon the statutory criteria and the
preferences discussed in Paragraph 14 above.
16. Option 2 was recommended by the Administration and adopted by the
Board for approval by this Court because it best addressed the statutory mandates and
Board criteria. A map showing the proposed regions and election districts is attached
as Exhibit "D".
17. The Resolution establishes three regions as follows:

18. Under the proposed plan, the percentage distribution of the population
is Region 1 - 31 percent; Region 2 - 34 percent; and Region 3 - 35 percent.
19. The greatest variation from the mean population per region of 8,729 is
500 persons, which is a percent variance from the mean of 5.7 percent.
20. The population per director is Region 1 - 2,743; Region 2 - 2,972;
and Region 3 - 3,014.
21. The maximum variation in the number of individuals represented by
each board member between the highest and lowest regions is 271 (3,014 - 2,743) or
3.1 percent of the mean number represented.
22. The proposed plan meets all the mandatory criteria and preferences
established by the School Board in that:
a. The population distribution among regions are within reasonable
limits, particularly when persons per representative are considered.
b. A review of population growth indicates that Regions 1 and 2 are
currently experiencing and will continue to experience the most rapid growth so that the
plan should result in equalization among regions in subsequent years.
c. The proposed plan will permit complete phase-in of the new regions
without disrupting any current four-year seats sooner than the expiration of the sitting
school directors' terms.
23. The proposed plan was shared with the Board of Directors at public
meetings on October 21, 2008 and October 28, 2008 and an explanation appeared on
the website.

REAPPORTIONMENT OF ELECTION REGIONS
BOARD OF SCHOOL DIRECTORS
MECHANICSBURG AREA SCHOOL DISTRICT
WHEREAS, the Mechanicsburg Area School District ("School District") is a
school district existing under the laws of the Commonwealth of Pennsylvania (the
"Commonwealth"); and
WHEREAS, by Resolution No. 818 of December 19, 2007, Upper Allen
Township resolved to create new voting districts by dividing four (4) present
voting precincts of the Township and creating ten (10) voting precincts or
districts; and
WHEREAS, the Cumberland County Court of Common Pleas by Order of
July 24, 2008, accepted the proposed election precinct realignment of ten (10)
election precincts; and
WHEREAS, the School District's current regional plan was approved by
the Cumberland County Court of Common Pleas on January 2, 2003 based on
the four (4) precincts in Upper Allen Township; and
WHEREAS, Section 303 of the Public School Code ("School Code")
requires that the population of each region from which school board directors are
elected shall be as nearly equal as possible and shall be compatible with the
boundaries of election districts; and
WHEREAS, as a result of the Upper Allen Township voting precinct
realignment, the current plan of the School District is no longer in compliance
with Section 303 of the School Code because the regions are no longer
compatible with the boundaries of election districts, which have changed as a
result of the Upper Allen Township realignment; and
WHEREAS, Section 303 of the Code authorizes the school board to
formulate a proposed plan for submittal to the county court of common pleas for
approval.
NOW, THEREFORE, BE AND IT HEREBY IS RESOLVED by the Board
of School Directors of the Mechanicsburg Area School District that:
SECTION 1. The Plan.
The School Board hereby adopts the following plan that sets forth the
boundaries of three regions for the election of school directors:

Attached as Exhibit "A" to the Resolution is a map showing the proposed regions
and election districts, which map is incorporated by reference into this
Resolution.
SECTION 2. Statutory Reauirements.
The proposed plan meets all statutory requirements in that it creates three
regions, the regional boundaries are compatible with the boundaries of election
districts, and the regions are established in such a manner that the population of
each region shall be as nearly equal as possible.
SECTION 3. Criteria Addressed.
In addition to the statutory mandates, the proposed Plan best, out of the
options considered, addresses the criteria established by the Board in that:
a. A review of population growth indicates that proposed Regions 1
and 2 are currently experiencing the most rapid growth and proposed Region 3 is
experiencing the least rapid growth so that the proposed regional plan should
result in even greater equalization among regions in subsequent years.
b. The proposed plan permits complete phase-in of the new regions
without disrupting any current four-year seats sooner than the expiration of the
sitting school director's terms.
SECTION 4. Submittal to the Court.
The Superintendent and School Solicitor are hereby directed to submit a
Petition to Reapportion Election Regions to the Cumberland County Court of
Common Pleas for approval by the Court.
ADOPTED by the Board of School Directors of the Mechanicsburg Area
School District, in lawful session assembled, on October 28, 2008.

ORDER
AND NOW, this 44 day of , 2008, upon consideration
of the School Board of Mechanicsburg Area School District's Petition to
Reapportion Election Regions, it is hereby Ordered and Decreed that:
Petitioner shall arrange for the advertisement of the prescribed
notice of this action in the The Sentinel, and in the Harrisburg Patriot-News. The
prescribed notice shall also be posted on the School District web site and on
each public bulletin board in each of the schools of the District.

MOTION SEEKING APPROVAL
OF THE PROPOSED REGIONAL PLAN
1. On November 26, 2008, the Board of School Directors of the
Mechanicsburg Area School District filed with the Prothonotary of this Court a
Petition to Change an Approved Plan of Election Regions.
2. By December 4, 2008 Order, the Petitioner was directed to
advertise the prescribed notice of this matter in The Sentinel and the The Patriot
News, to post the notice on the School District web site, and on each public
bulletin board in each of the schools of the District.
3. On December 11, 2008, said Notice was advertised in the The
Patriot News. Proof of publication is attached hereto as Exhibit "A".
4. On December 15, 2008, said Notice was advertised in The
Sentinel. Proof of publication is attached hereto as Exhibit "B.
5. As required by the December 4, 2008 Order, the Notice was posted
on the School District web site. An Affidavit from the Secretary of the Board of
School Directors certifying that this was accomplished is attached hereto as
Exhibit "C".
6. The Notice required that any objections to the proposed plan be
served on the Secretary of the School Board and filed with the Prothonotary of
the Cumberland County Court of Common Pleas no later than twenty (20) days
from the latest date of publication of that notice.
7. Twenty days from the latest date of publication of the Notice was
January 4, 2008, and, as of that date and thereafter, the Secretary of the School
Board has received no objections to the proposed plan. The Affidavit attached
hereto as Exhibit "C" certifies that no written objections to the proposed plan
have been received.
8. The facts stated in the Petition to Change an Approved Plan of
Election Regions comply with the two statutory mandates that the regions be as
nearly equal as possible and be compatible with the boundaries of the election
districts.
9. The facts as stated in the Petition support that the Board of School
Directors carefully considered and reviewed possible options to accomplish the
restructuring of the regions based on the statutory criteria.
10. The facts as stated in the Petition support that the 2003 regional
plan no longer complies with the statutory mandate that the regions be
compatible with the boundaries of the election districts because of the Upper
Allen Township precinct realignment from 4 to 10.
11. In order to comply with Section 303 of the School Code, the District
must realign election regions to be compatible with the Upper Allen Township
realigned election districts.
13. As part of the municipal primary process, the Cumberland County
Bureau of Elections has set a deadline of Tuesday, February 17, 2009, for the
school district to identify the areas the election regions include. The Official
Notice is attached as Exhibit "D".
WHEREFORE, there having been filed no objections to the proposed
plan, Petitioner respectfully requests that this Court approve the proposed plan
as set forth in Resolution 2008-6 adopted by the Board of School Directors on
October 28, 2008 (Exhibit "B" of Petition).

Notice is hereby given that the Board of School Directors of the Mechanicsburg Area
School District has petitioned the Cumberland County Court of Common Pleas to approve a
new plan fixing the regional boundaries for the election of school directors. A copy of the
Petition will be available from the Secretary of the Board, Alan Vandrew, at the Administration
Office between the hours of 8:00 a.m. and 4:00 p.m. on regular business days.
Any objection to the proposed plan shall be filed no later than twenty (20) from the latest
date of publication of this notice with the Prothonotary of the Cumberland County Court of
Common Pleas, Cumberland County Courthouse, One Courthouse Square, Carlisle PA 17013
and shall be served on the Secretary of the School Board, Alan Vandrew, at 100 East Elmwood
Avenue, Mechanicsburg, PA 17055. Any objection shall clearly reference at the top of the
page the caption of the matter: `in re: Petition of the Board of Directors of the Mechanicsburg
Area School District to Change an Approved Plan of Election Regions', shall be entitled,
`Objection to Petition to Reapportion Election Regions', and shall state the specific reasons
for opposing the proposed region plan.

Municipal Clerks and Secretaries to Furnish Information as to Offices to be Filled
To assist the respective county boards in ascertaining the offices to be filled, it shall be the
duty of the clerks or secretaries of the various cities, boroughs, towns, townships and school
districts with the advice of their respective solicitors on or before the thirteenth Tuesday
preceding the Municipal Primary, to send to the county boards of their respective counties, a
written notice setting forth all city, borough, town, township and school district offices to be
filled in their respective subdivisions at the ensuing Municipal Election and for which
candidates are to be nominated at the ensuing Primary.
Mark an X opposite the names of the offices that are to be filled in the column
bearing the number of candidates to be Elected. Mark in the proper column the number of
years such officer shall serve, if more than one officer is to be nominated, indicate how many

Board of Mechanicsburg Area School District's Petition to Change an Approved Plan of
Election Regions and after public notice of said plan advising of the right to file written
objections to the proposed plan advertised in The Sentinel and the The Patriot-News,
