I, ALBERT W. WEIBLEY, of the Borough of Shippensburg,
Cumberland County, Pennsylvania, declare this to be my Last Will
and Testament and revoke any Will or Codicil previously made by me.
ITEM I: I direct that all my just debts (except as may be
barred by a Statute of Limitations) and my funeral expenses
(including my gravemarker and expenses of my last illness) shall be
paid from my residuary estate as soon as practicable after my
decease as a part of the administration of my estate.
ITEM II: I devise and bequeath the residue of my estate to the
Trustee acting at the time of my death under the Trust created by
me on October 2, 1996 and last amended on Oc~0~~ 1~9~ , of
which FINANCIAL TRUST SERVICES COMPANY is Trustee, IN TRUST, for
the uses and purposes and subject to the terms and provisions
thereof. My residuary estate shall be added to such Trust and
administered and distributed as a part thereof, including any
alterations or amendments thereto made pursuant to its terms or to
any other lifetime trust which I may hereafter substitute therefor.
Should the Trust created by me on October 2, 1996 and last
amended on Oo~~--q i(~ be entirely revoked without a
substitute (or other provision made in the document of revocation)
or should that Trust fail to exist or be or become unenforceable
for any reason, then my residuary estate shall be held and
administered and distributed by my Executor as a Trustee pursuant
to the terms and provisions of that Trust as it existed on October
2, 1996 and last amended on ~. ~C,,~ 2~ (0~ , without
such resultant Trust being considered a testamentary Trust.
ITEM III: My Executor and/or Trustee herein appointed shall
have, in addition to those powers vested in it by law and any other
provisions of my Will, all powers granted by me to the Trustee in
the above referenced Trust (and any amendment of or substitute for
such) as fully and completely as if the same were set forth herein
in their entirety and the same are hereby incorporated herein by
reference.
ITEM IV:

I direct that all taxes that may be assessed in
of my death, of whatever nature and by whatever
jurisdiction imposed, shall be paid from my residuary estate as
part of the expenses of the administration of my estate.
ITEM V: I appoint FINANCIAL TRUST SERVICES COMPANY, Executor of
performance of their duties in any jurisdiction.
ITEM VII: My corporate fiduciary shall
this my Last Will. Should it fail to qualify or cease to act as
Executor, I appoint my friend, GALEN J. KARPER, Alternate Executor
of this my Last Will.
ITEM VI: I direct that my Executor and Trustee or their
successors shall not be required to give bond for the faithful

compensation based upon its regular schedule of fees for such
services in effect from time to time during the period over which
its services are performed.
ITEM VIII: My individual fiduciary shall be entitled to
reasonable compensation for his or her services rendered from time
to time and/or to reimbursement of out of pocket expenses.

that Albert W. Weibley (as printed on the Will) and Albert Weibley (as executed by the
decedent) are the same individual. Please have all official probate documents issued by
your office indicate "Albert W. Weibley a/k/a Albert Weibley" (or vice versa, whichever is
appropriate). This should allow for a more problem-free administration of the estate.

For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the
surviving spouse is 3% [72 P.S. §9116 (a)(1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0%
[72 P.S. §9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure
of assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural
parent, an adoptive parent, or a stepparent of the child is 0% [72 P.S. §9116 (a) (1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. §9116
1.2) [72 P.S. §9116 (a) (1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. §9116 (a) (1.3)]. A sibling is defined,
under Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

I, ALBERT W. WEIBLEY, of the Borough of Shippensburg,
Cumberland County, Pennsylvania, declare this to be my Last Will
and Testament and revoke any Will or Codicil previously made by me.
ITEM I: I direct that all my just debts (except as may be
barred by a Statute of Limitations) and my funeral expenses
(including my gravemarker and expenses of my last illness) shall be
paid from my residuary estate as soon as practicable after my
decease as a part of the administration of my estate.
ITEM'II: I devise and bequeath the residue of my estate to the
Trustee acting at the time of my death under the Trust created by
me o1% October 2, 1996 and last amended on Oc'~c~-%~) 1~9~ , o~
which FINANCIAL TRUST SERVICES COMPANY is Trustee, IN TRUST, for
the uses and purposes and subject to the terms and provisions
thereof. My residuary estate shall be added to such Trust and
administered and distributed as a part thereof, including any
alterations or amendments thereto made pursuant to its terms or
any other lifetime trust which I may hereafter s~bstitute therefor.
Should the Trust created by me on Octobe¥ 2, 1996 and last
amended on _Oo~-~-~ ![%96 be entirely revoked without a
substitute (or other provision made in the document of revocation)
or should that Trust fail to exist or be or become unenforceable
for any reason, then my residuary estate shall be held and
administered and distributed by my Executor as a Trustee pursuant
to the terms and provisions of that Trust as it existed on october
such resultant Trust being considered a testamentary Trust,
ITEM III: My Executor and/or Trustee herein appointed shall
have, in addition to those powers vested in it by ].aw and any other
provisions of my Will, all powers granted by me to the Trustee in
the above referenced Trust (and any amendment of or substitute for
such) as fully and completely as if the same were set forth herein
in their entirety and the same are hereby incorporated herein by
r.:ference.
ITEM IV:
I direct that all taxes that may be assessed in
consequence o4 my death, of whatever nature and by whatever
jurisdiction imposed, shall be paid from my residuary estate as
part of the expenses of the administration of my estate.
ITEM V: I appoint FINANCIAL TRUST SERVICES COMPANY, Executor of
this my Last Will. Should it fail to qualify or cease to act as
E~ecutor, I appoint my friend, GALEN J. KARPER, Alternate Executor

ITEM VI: I direct that my Executor and Trustee or their
snccessors shall not be required to give bond for the faithful
performance of their duties in any jurisdiction.
ITEM VII: My corporate fiduciary shall be entitled to
compensation based upon its regular schedule of fees for such
services in effect from time to time during the period over which
its sea-vices are performed.
ITEM VIII: My individual fiduciary shall be entitled to'
reasonable compensation for his or her services rendered from time
to time and/or to reimbursement of out of pocket expenses.

THIS AMENDED AGREEMENT OF TRUST executed in multiple
counterparts this ~day of O~~_ , 1996, between ALBERT W.
WEIBLEY, of 101 North Prince Street (110 Stevenson Building)
Shippensburg, Cumberland county, Penns¥1uania (hereinafter called
"SETTLOR") and FINANCIAL TRUST SERVICES COMPANY (hereinafter called
"TRUSTEE"~. , ...................
WHEREAS, SETTLOR and TRUSTEE entered into an Agreement of
Trust dated October 2, 1996; and
WHEREAS, SETTLOR reserved the right and power to amend the
original Trust (and any subsequent amendments) and he desires
hereby to do so; and
WHEREAS, TRUSTEE is agreeable that such amendments be made and
become effective immediately upon the execution hereof.
WITN ES SETH :
FIRST: The Agreement of Trust dated October 2, 1996, is
hereby amended by revoking all provisions thereof and replacing
them with the following, which shall be in full substitution
therefor. .-
SECOND: The principal and any accumulated income presently
held by TRUSTEE shall continue to be so held, which sum, together
with all other property, real or personal, that may be added to the
trust (such cash and additions being hereinafter called
"principal,,), shall hereafter be held by TRUSTEE, IN TRUST, upon
the following terms and conditions.
THIRD: TRUSTEE shall manage all property comprising the
principal of this Trust and shall collect the income therefrom and
accretions thereto and shall pay the net income and hold and
distribute the principal of said Tr~st as follows:
A. TRUSTEE shall pay from the net income therefrom to
SETTLOR for and during his lifetime such Periodic installments
in such amounts as SETTLOR shall request, provided that if, in
the opinion of TRUSTEE, SETTLOR should by reason of age,
illness, or for any ot~er cause become incapable of
appropriately receiving and disbursing income TRUSTEE may then
apply the net income of this Trust for the health and medical
care and maintenance and support of SETTLOR to maintain him in
the station of life to which he is accustomed at the creation
of this Trust. Any income not disbursed hereunder or as
directed by SETTLOR under ITEM EIGMTH shall be accumulated and
(from time to time) added to the principal.
B. As much of the accumulated income and principal of
this Trust as TRUSTEE in its sole discretion may from time to
time think advisable for the heal=h, support and maintenance
in reasonable comfort of SETTLOR (to maintain him in the
station of life to which he is accustomed at the creation of
this Trust) shall be either paid to him or else applied
directly for his benefit by Trustee.
C. Upon SETTLOR's death, TRUSTEE shall hold or
distribute the residue and remainder of the principal and any
accumulated and undistributed income hereof and herefrom and
any additions received under SETTLOR's Will or the Will of any
other person or otherwise, after payment of SETTLOR's debts,
taxes and administration expenses as hereinafter provided, in
PERPE~JAL TRUST, for the benefit .of the Christ United
Methodist Church of Shippensburg, Pennsylvania for the
following uses and purposes and under.the following terms and
conditions, a~ an endowment, as follows:
1) From the income (but not exceeding $250 per
year) there shall be distributed the-following:
a) The cost of having placed upon SETTLOR's
grave and SETTLOR's late wife's grave (being Pearle
B. Weibley), upon SETTLOR's wife's mother's and
father's graves (being Charles B. Baker, Jr. and
Dorothy V. Baker), and upon SETTLOR's wife's
brother's grave (being Chalmer D. Baker) in Spring
Hill Cemetery, Shippensburg, Pennsylvania, on
Memorial Day of each year, an arrangement of
natural or fresh flowers, the selec%ion of such
flowers to be in the sole discretion of the said
Trustees of Christ United Methodist Church of
Shippensburg.
b) The cost of having placed upon SETTLOR's
grave and SETTLOR's late wife's grave, upon
SETTLOR's wife's mother's and father's graves
(being Charles B. Baker, Jr. and Dorothy V. Baker)
and upon SETTLOR's wife's brother's grave (being
Chalmer D. Baker) in Spring Hill Cemetery,
Shtppensburg, Pennsylvania on Christmas Day of each
year, an arrangement of. artificial flowers, the
selection of such flowers to be in the sole
discretion of the Trustees of Christ United
Methodist Church of Shippensburg.
2} The balance of the income therefrom, annually,
shall be payable to the Trustees of Christ United
Methodist Church, to be utilized by it, in its
discretion, for appropriate .uses in the following
specified order:
a) For the maintenance, repair and
replacement of the sound system in the church
sanctuary (which was Dreviously a gift in SETTLOR's
lifetime by SETTLOR).
b) For the use in.~onnection with the music
department of Christ United Methodist Church.
c) Any residue not applied in the discretion
of the Trustee to the uses specified in
subparagraphs (a) and (b) shall be disbursed by the
Board of Trustees as it in its discretion

determines necessary and desirable for the general
purposes of Christ United Methodist Church of
Shippensburg, Pennsylvania.
FOURTH: The principal and income of this Tr~st shall be free
from anticipation, assignment, pledge or obligation of SETTLOR or
of any beneficiary and shall not be subject to any execution or
attachment or to voluntary or involuntary alienation.
FIFTH: TRUSTEE shall have the power, but not the duty, to
make such expenditures out of this Trust as it, in its uncontrolled
discretion, may consider desirable in .order to facilitate the
settlement of SETTLOR's estate. In exercising such power, TRUSTEE
may pay, in whole or in part, any or all of the following items:
the expenses of SETTLOR's last illness and burial, including cost
of gravemarker: his debts: his income taxes: the death taxes on any
and all property included in his gross estate for tax purposes; and
all other items in connection with the settlement of his estate.
Any such items may be paid directly by TRUSTEE or the funds for
their payment may be transferred by TRUSTEE to SETTLOR's executor
or administrator; and neither such execut~ or administrator or any
beneficiary of SETTLOR's estate shall be required to reimburse
TRUSTEE for any funds so paid or transferred. TRUSTEE may rely on
certification
executor.
SIXTH:
as to any such costs and taxes from SETTLOR'$
TRUSTEE and any other fiduciary shall have the
following powers in addition to those vested in it by law and by
other provisions of this tim/st, applicable to all property, whether
principal or income, including property held for minors,
exercisable without court approval, and effective until actual
distribution of all property:
A. To retain any or all of the assets of this Trust,
real or personal, including stock of a Trustee, without regard
to any principle of diYersification or risk.
B. To invest in all for%ms of property, including Gtock, .
common trust funds, mutual funds and mortgage investment funds
whether operated
restriction to
fiduciaries, as
by a TRUSTEE or by others, without
investments authorized ~or Pennsylvania
it deems proper,, without regard to any
principle of diversification or risk, in the form of stock,
checking accounts, savings accounts, certificates of deposit
or:other investments without limitation as to Federal Deposit
Insurance Corporation (or other similar agency) insurance
limits for such investments.
C. To sell at public or pri~te sale, to exchange, or to
lease for any period of time, any real or personal property
and to give options for sales, exchanges or leases, for much
prices and upon such terms or conditions as it deems proper.
D. To allocate receipts and expenses to principal or
income or partly to each as TRUSTEE, from time to time, think~
proper in its sole discretion, but in no event shall the
income of the marital deduction trust De reduced by the
exercise of this power.
E. To compromise any claim or controversy.
F. To distribute in.cash or kind or partly each.
G. To purchase assets from SETTLOR's estate and to lend
money to SETTLOR's estate.
H. To hold property in.its name without designation of
any fiduciary capacity, or in the name of a nominee or
unregistered.
I. To repair, alter or improve any real or personal
property: to borrow money including the right to borrow money
from any fiduciary hereunder, and to pledge, mortgage~ or
create a security interest in any property held by them as
security therefor, and to mske loans, secured or unsecured,
for such purposes and upon such terms and conditions as the
TRUSTEE may deem advisable, including loans to SETTLOR's
estate, with or without interest, for any purpose whatsoever,
and to exercise options of any kig~.
J. To subscribe for or to exercise options for stocks,
bonds, or other investments; to join in any plan of lease,
mortgage, merger, consolidation, reorganization, foreclosure
or voting trust and to deposit securities thereunder; to vote
securities in person or by proxy, in such connection to

delegate discretionary powers: and generally to exercise all
the rights of security holders or employees of any
corporation.
K. To pay from the income of the trust created herein,
monthly payments on any mortgage on real estate owned by
SETTLOR individually or Jointly with another person at the
time of SETTLOR's death, if TRUSTEE deems it advisable not to
prepay any such mortgage.
L. Trustee, generally, shall have full power, and
authority to exercise all rights and privileges appurtenant to
any property held by it, and to execute and deliver any and
all instruments which may be necessary or expedient in the
exercise of the powers granted herein.
M. To exercise any law-given option to pay death taxes
in installments, the payment · of interest due on such
installments to be charged against principal.
N. To exercise any law-given option to treat
administrative expenses either as income tax or as estate tax
deductions, without regard to whether the expenses were paid
from principal or income.
O. Should the principal of any Trust herein provided for
be or become too small in TRUSTEE'$ discretion so as to make
establishment or continuance of trust inadvisable, TRUSTEE or
SETTLOR's personal representative may make immediate
distribution of the then remaining principal and any
accumulated or undistributed income outright to the person or
per~ons and in the proportions they are entitled to.
p. Any individual TRUSTEE may from time to time delegate
his or her powers and duties, both administerial and
discretionary, to one or more other trustee with full power to
revoke such discretion and renew the same at pleasure.
p. To receive other property of any type acceptable to
the TRUSTEE, including, but not in way of limitation, life
insurance proceeds, which may be devised, bequeathed,
assigned, granted, conveyed or made payable to TRUSTEE by any
other person, to be added to and administered in accordance
with the then applicable provisions of the Trust or Trusts
hereunder; provided, however, if more than one Trust is then
being administered hereunder, such other person may specify,
· in the instr~ment of transfer, among which Trusts, and in what
proportions ~uch property shall be allocated.
Q. To treat the entire Trust estate as a common fund for
the purpose of investment, notwithstanding any provision
herein for division thereof into shares or separate trusts.
SEVENTH: Subject to approval of TRUSTEE, anyone may add
property, real or personal, to the principal of this Trust by Dee~,
Will or otherwise, sETTLOR specifically reserves the right to add
property to the principal of this Trust by Deed, Will or otherwise.
EIGHTH: SETTLOR reserves the right by an instrument in

writing intended to take effect during SETTLOR's lifetime signed by
SETTLOR and delivered to TRUSTEE to withdraw s~ms of principal, to
direct payments of accumulated income or to revoke or amend this
Agreement in whole or in part, provided that the duties, powers and
liabilities of TRUSTEE shall not be substantially changed without
its written consent.
NINTH: TRUSTEE shall receive compensation for the performance
of its functions hereunder in accordance with its standard schedule
of fees in effect from time to time during the period over which
its servicem are performed.
TENTH: The situs of this Trust
accounting purposes shall be in the

any reason desires to resign or otherwise not continue as TRUSTEE,
SETTLOR grants onto his attorney, Hamilton C. Davis, Esquire (or
should he be unable or unwilling to act, Joel R. .Zullinger,
Esquire) as the case may be, in his sole discretion, the right and
authority to appoint a successor corporate Trustee, which successor
Trustee shall have all the powers given to the TRUSTEE under this
Agreement, but shall not be liable for any acts or omissions of the

Services Company ("Trustee"), the property described in the
.attached Schedule, to be held in Trust upon the following
terms:
FIRST. Dispositi¥.e. Provision- I_.'or. ,My Benefit. During
my lifetime:
A. All of the net income shall be paid to me at
least quarterly or shall be paid or accumulated and
added to principal, as I may direct in writing.
B. As much of the principal as I may from time to
time request in writing shall be paid to me or as I may
otherwise direct.

death, this Trust shall terminate and the Trustee shall pay
the then remaining principal and income to the Executor or
Administrator of'my estate for distribution as part of my
estate.

to revoke or amend this Trust, in whole or in part at any
time and from time to time by an instrument in writing,
delivered to the Trustee and intended to take effect during
my lifetime, except that the duties, powers, and liabilities
of the Trustee shall not be changed without its written
consent. The Trustee reserves the right, at any time upon
thirty (30) days advance written notice to Settlor, to resign
the Trust and deliver the Trust Estate to me, after deducting
therefrom its fees and any expenses then due and payable.

approval of the Trustee, I may add property, real and
personal, to the principal of the Trus~, Dy deed, will or
otherwise.
FIFTH. Trustee,s Powers. In addition to the powers
granted by law and such powers as may have been granted
.elsewhere in this Trust, the Trustee shall have the following
discretionary powers, applicable to principal and income,
which shall be exercisable without leave of court and shall
be effective until distribution is actually made:
A. To accept and retain amy property and to inYest
and reinvest, without being confined to "legal
investments,,, and without responsibility for
diversification, in any form of property, including by
way of illustration and not of limitation: real estate;
common stock; bonds; options; common trust funds
maintained by or securities issued by the Trustee or
securities issued by any corporation controlling or
otherwise affiliated with the Trustee; investment
trusts; mutual funds; and securities issued outside the
United States.
B. To subscribe for stocks, bends, or other
investments; to join in any plan of lease, mortgage,
merger, consolidation, reorganization, foreclosure, or
voting trust and deposit securities thereunder; to
exercise options to purchase stock and other property;
and generally to exercise all the rights of security
holders in any corporation.
C. To buy investments at a premium or discount;
D. To register securities i'~{ street name or in the
name of a nominee or in such manner that title shall
pass by delivery and to vote, in person or by proxy,
securities held hereunder and in such connection to
delegate discretionary powers.
E. To retain reasonable amounts of cash

or any portion thereof should be charged or credited to
income, to principal, or partly to both, without being
obliged to apply the statutory and/or usual trust
accounting rules.
I. To employ and compensate from income or
principal in Trustee's discretion investment and legal
counsel, accountants, brokers, and other specialists,
and to delegate to investment counsel discretion with
respect to the investment and reinvestment of any or all
of the assets held hereunder.
SIXT}~. Compensation. The Trustee shall be compensated
in accordance with its standard schedule of charges in effect
from time to time during the period of"its service, and'this
compensation shall be paid from principal or income or partly
from each in the sole discretion of the Trustee.
SEVENTH. NonTAs~ignment. The principal and income of

erty if the land is turned into

"The borough will not
maintain another park five
miles outside of town. The
borough already has two
parks (The Memorial Park
and Dykeman Springs Wet-
land Park) near the heart of
town," Crouse contended.
"The third park will need po-
lice protection and will be a
cost to borough taxpayers."
The borough authority has
three options to choose from
when dealing with the un-
wanted property.
They could simply abandon
the land. The second option
would be for the borough to
spend $90,000 to dismantle
the dam that sits on the land
and sell the property for
commercial or private devel-
opment; The third option, and
the one the borough is
the property over to an
organization willing to
make the woodland into a

to acquire the land from the
state and then turn over the

"He's a great man,"
remarked Shover. "First of
all, he still sings. He's
strong musically as well. He
reads music extremely well.
"When I first came to
Christ UM Church, he would
sing anthems and sing them
well. I just figured that he
had sung them before. But
then I brought some new
anthems. I knew he had
never seen them before, but
he sang them just as well.
"He's very pleasant," add-
ed Shover. "He goes in and
does his job, and he never
complains."
Said Weibley, as he re-
flected on the past 88 years,
"We've got a great group, but
we can always use new peo-
ple. The time went fast. I've
always liked music. It's al-
ways brought me o]easure."

"Blaine said I would have."
Later, Weibley was called
to the front of the church dur-

Weibley's favorite hymn.
"That was a surprise, I
can tell you that," laughed
Weibley.
Weibley retired at the age
of 65 from The Beistle Co.,
Shippensburg. He now enjoys
high school and college
sports, reading about them in
the newspaper.
"The girls at the college
had a great year," he said,
referring to the SU women's
basketball team that was No.
2 in the nation.
He also watches profes-
sional baseball on television.
Weibley said, "I've always
been a Yankees fan--.from
