Albright, deceased, (hereinafter referred to as "the Decedent"), died on November 10, 1993. 2. That a Petition for Probate of the Last Will and Testament and for Grant of Letters Testamentary was made by William S. Daniels, Executor, (hereinafter referred to as "the Executor"). Letters Testamentary were granted to the Executor on November 24, 1993. That as of the date of this Petition no Inheritance Tax Return has been filed by the Executor of this estate as required by Section 1736 of the Act of December 13, 1982, P.L. 1086, No. 255, (72 P.A. C.S. § 1736). 5. That under Section 2176 of the Act of August 4, 1991, P.L. 97, No. 22, (72 P.S. § 9176), the Secretary of Revenue is authorized to request the Court to issue a Citation directed to those subject to any duty imposed by the aforesaid Act, commanding such persons to appear and show cause why the requirements of this Act should not be met. WHEREFORE, your Petitioner prays your Honorable Court to issue a Citation upon the Executor, directing the Executor to appear and show cause why said Inheritance Tax Return in the estate of the Decedent should not be filed as required by law; and to further direct that the costs of this action shall be borne by the Executor. It is located along township road 692 between-Route 34 and L. R. 21005. This is a small farm containing 24 Acres and 134 Perches and has the following buildings: a 28 x 30' frame barn with att- ached.implement shed. This building has little or no value and has not been used for many years. There is also a 2z story frame dwel- ling.house.of.nn value with metal roof=:and insulbrick siding, and front and side porch. This dwelling has been unoccupied for many years. It appears the chimney has blown off and there is a large hole in the metal roof. Located near the dwelling is a very small one-car garage. This property could have subdivision possibilities on the part that is located on the South side of the public road which passes through same. However, the 9.75 Acres on the North side of the road including the plot containing the house 'and barn as an ease- ment by Appalachian Trail, which restricts use of this plot to agri- cultural purposes only. It is not known at this time whether or not the dilapidated buildings may be removed or restored. Therefore this easement affects the value of this property. In our opinion the value of this property on November 10, 1993, his date of death is SIXTY THOUSAND DOLLARS ($60,000.00) PROPERTY located in Dickinson Township, it fronts approximately along the West side of Rt. 34, is irregular in shape and consists of three (3) parcels which is recorded in the office afo- resaid in Deed Book "H", Vol. 15, Page 583.
