Kuhns Carpentry & Building, Contractor This instrument is executed this 24`h day ofNovember, 2008, by Gregory A. Kuhns Carpentry & Building ("Contractor") (or "Subcontractor"') in favor of Adam G. Shaffer ("Owner") Whereas, Owner is about to execute contemporaneously herewith, a contract with Contractor for the erection of an addition and other work on the existing building located at 445 N. College Street, Carlisle, Pennsylvania, located in the Borough of Carlisle, more fully described as follows: ALL that certain frame house and lot of ground situated in the Fifth Ward, #445, on the East side of North College Street, in the Borough of Carlisle, County and State aforesaid, bounded and described as follows, to wit: on the west by North College Street; on the north by land now or formerly of Edward M.1Vlountz, on the east by an alley sixteen (16) feet wide, on the south by land of Arthur E. Adams. CONTAINING twenty-five (25) feet in front on North College Street, and extending at an even width two hundred and ten (210) feet in depth to the alley aforesaid. BEING THE SAME PREMISES which Jean R. Adams, widow, by Deed dated November 24, 2008, and intended for recording immediately prior hereto in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, granted and conveyed unto Adam G. Shaffer. Now, November 24, 2008, at the time of and immediately before the execution of the construction contract aforesaid, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same, inconsideration of the Owners making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. 1 Witness, our hand and seals the day and year aforesaid.
