Identity of Testator and Declaration of Intent `~'~~ ~ I, Rocco Thomas DiSipio, born December 17, 1949 in Philadelphia, Penn~,~ia, USA, recorded by the Commonwealth of Pennsylvania Department of Health i # 2238010-49, and assigned the U.S. Social Security # 166-40-6683, being under no duress- nor delusion, make and declare this to be my Last Will And Testament, expressly revoking all my prior wills and codicils, superseding them and supplanting them. At the drawing of this will, I reside at 80BeechcliffDrive, Silver Spring Township, Cumberland County, Pennsylvania, and receive mail at Post Office box 405, New Kingstown, PA 17072-0405. Misspellings or typographical errors in this Will shall not be construed as cause to negate any of the directives of Testator or invalidate this Will. 2. Personal Representative Appointments I appoint my brother, Christopher N. DiSipio, currently of 202 Garrison Court, Asbury, New Jersey, as my personal representative of this Last Will and Testament, and provide that if he is unwilling or unable to serve in this position, I appoint John Carpenter, currently of 1204 Yorkshire, Grosse Pointe Park, Michigan, as my personal representative of this Last Will. I authorize my personal representative to carry out all provisions of this, my Will, and pay my just debts and expenses. I further provide that my personal representative shall not be required to post any bond in this or any other jurisdiction, and I direct that no expert appraisal be made of my estate unless required by law. Personal Representative, to extent the law allows, may administer my estate independently, without any administration, order, or direction of any court, and may reimburse himself from my estate for legitimate expenses of executing this Will. 3. It is the express intent of Testator that should any of the above in 4 merge, be bought, acquired, renamed, or otherwise subsumed, the superseding entity is to honor my personal representative's claim to my funds and benefits in representative's capacity as the executor of this Will. S. Will and Document Location Original of this Will is located with Personal Representative. No codicils exist as of this drawing. Facsimiles of this Will can be found among Testator's personal files, with contingent personal representative, and in Testator's safe deposit box (presently, First Union/Wachovia Bank). Businesss documents and personal papers are located in that safe deposit box. Personal Representative is to treat Testator's private mementoes and letters with judicious respect. 6. Schedule of Assets • Automobile: see NADA value for make, model, and mileage • Bank Accounts & fiduciary credits: sum varies. Personal Representative is to inquire of institutions indicated in Testator's personal files and safe deposit box. • Insurances and organization benefits: see section 4 • Personal Property: all possessions, including cash and tangible possessions of Testator, that can be found on Testator's person, in and at Testator's residence, automobile, storage areas, and places of custodianship, including safe deposit box. • Copyrighted Works: Actual manuscripts created by Testator registered with the U.S. Library of Congress by Testator, including non-registered works of Testator with natural copyrights. Full sets of these are located with Testator's Personal Property, Barbara Buck (cf.), John Carpenter (contingent Personal Representative), and Christopher N. DiSipio. Schedule of Assets- continued Copyrights: The actual right to copy, print, publish, sell, transfer, annotate, edit, adapt for stage, film, video, or cyber-publishing, quote, abridge, and serialize the above- referenced copyrighted works. These works of the Testator are registered with the U. S. Library of Congress, Office of Copyright, but a few smaller pieces are protected under `natural copyright'. Monetary value of such creative literary works naturally depends on their sale at market, directly or indirectly, thus cannot at present be established. 7. Funeral and Burial Directions I direct my Personal Representative, upon my death, to effect my burial or cremation directly, at least expense, with any certified funeral service. There is to be no formal funereal ceremony. "Least expense" shall also be governed by transportation costs. S.
