McNaughton Homes, Builder In the Court of Common Pleas, County of Cumberland Pennsylvania Number /~L~Term, 2004.- I~/ WHEREAS, Jason J. Huh and Mihyun Huh of Meehanicsburg, PA are about to execute contemporaneously herewith, a contract, with McNaughton Homes of Harrisburg, PA, for the erection of a single family dwelling upon a lot of land situate in the Township of Hampden, Cumberland County, PA (see schedule 'A' for description) Now, April 16, 2004 at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said owner to the said contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with and the further consideration of One Dollar, to paid by, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor. Nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. WITNESS, our hands and seals the day and year aforesaid. SIGNED AND SEALED IN THE PRESENCE OF McNaughton Homes by: Mihyun Huh ~t ALL that certain piece, parcel or lot of land, together with improvements, situated in Hampden Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the Southern right-of-way line of Joshua Road (50.00 feet wide), said point being in line of lands now or formerly of The McNaughton Company; then along said other lands of McNaughton, South 33 degrees 13 minutes 17 seconds East, for a distance of 105.00 feet, to a point along the Northern boundary line of Lot No. 179; then along the Northern boundary line of Lot No. 179, South 56 degrees 46 minutes 43 seconds West, for a distance of 103.00 feet, to a point at the Southeastern corner of Lot No. 167; then along the Eastern boundary line of Lot No. 167, North 33 degrees 13 minutes 17 seconds West, for a distance of 105.00 feet, to a point along said Southern right-of-way line of Joshua Road; then along said Southern right-of-way line of Joshua Road, North 56 degrees 46 minutes 43 seconds East, for a distance of 103.00 feet, to a point and the place of BEGINNING. This piece, parcel or lot of land contains approximately 10,815.00 square feet of land, and is known and numbered as Lot No. 168 on the Final Subdivision Plan for Good Hope Farms South - Phase VIII, which is recorded in Cumberland County in Plan Book 87, Page 24. BEING A PART of the same premises which Thomas W. Gaughen d/b/a TWG Real Estate Management Services, conveyed to The McNaughton Company, a Pennsylvania Corporation, by deed dated October 5, 1994 and recorded in Cumberland County in Record Book 112, Page 1058.
