Lemmon, Jr. and Andrea R. Lemmon, hereinafter called the Owner, is about to execute contemporaneously with Schaffs Home Center of Fayetteville, Pennsylvania, hereinafter called the Contractor, a contract for the erection or construction of a SINGLE FAMILY DWELLING upon the lot of ground known as 177 Fairview Road, Shippensburg, PA 17257Hopewell Township, Shippensburg, Cumberland County, Pennsylvania, described in Exhibit "A" hereof, of which Bruce E. Lemmon, Jr. and Andrea R. Lemmon are the title holder of record, as more particularly described in Cumberland County, Pa., Instrument No. ;and Now, November 20, 2008, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the Owner to the Contractor to commence work on said building or improvement, to purchase materials for the same, it is hereby stipulated and agreed by and between said parties as part of said contract and for the consideration therein set forth, nether the undersigned Contractor, any Sub-contractor or material man, nor any other person furnishing labor or materials to the said Contractor under the contract entered into between said parties shall file a lien for work done or material furnished to said building, improvements or any part thereof. This stipulation is made and intended to be filed with the Prothonotary within 10 days after date in accordance with the requirements of the Act of August 24, 1963, P.L. 497, as amended, In Witness Whereof, the said parties have hereunto set their hands and seal the day and year aforesaid. Robert Ackelsberg; thence by Ackelsberg, North 84 degrees 48 minutes 14 seconds West, 28.82 feet to an iron pin; thence by same, South 29 degrees 29 minutes 37 seconds West, 206.75 feet to an iron pin; thence by same, South 42 degrees 45 minutes 55 seconds West, 30.27 feet to an iron pin; thence by the same, South 61 degrees 21 minutes 41 seconds West, 627.96 feet to an iron pin; thence by lands now or formerly of Mary Cramer, North 36 degrees 09 minutes 54 seconds West, 612.42 feet to an iron pin; thence by other lands now or formerly of Mike F. Zemencik, North 55 degrees 45 minutes 22 seconds East, 1065.50 feet to an iron pin; thence by same, South 38 degrees 03 minutes 08 seconds East, 430.86 feet to a railroad spike in the center of said Fairview Road; thence by the center line of said road, South 24 degrees 27 minutes 29 seconds West, 167.96 feet to a railroad spike; thence by same, South 7 degrees 28 minutes 27 seconds West, 102.17 feet to a railroad spike in the center of Fairview Road, the place of BEGINNING. CONTAINING 15.046 acres pursuant to Subdivision Plan of Mike Zemencik, dated July 25, 1987 and recorded in the office of the Recorder of Deeds of Cumberland County, Pennsylvania in Plan Book 53, Page 126.
