MUMMA CUMBERLAND COUNTY, PENNSYLVANIA Deceased NO. 21-86-398 ORPHAN'S COURT DIVISION EXECUTRICES' EMERGENCY MOTION FOR PROTECTIVE ORDER AND NOW come Barbara McK. Mumma and Lisa M. Morgan, Executrices of the Estate of Robert M. Mumma, deceased, and Trustees under his Will, by and through their attorneys, MARTSON DEARDORFF WILLIAMS OTTO GILROY & FALLER, move this Court to enter a protective order, and in support thereof, aver as follows: On or about September 30, 2008, Robert M. Mumma, II served a Notice of Subpoena and a Subpoena to Attend and Testify for Lisa M. Morgan. A copy of the Notice and Subpoena are attached as Exhibit A. 2. The Subpoena schedules a deposition to take place at the Office of Robert M. Mumma, II in Lemoyne, Pennsylvania on October 13, 2008. 3. On March 26, 2007, Judge Oler entered an Order of Court limiting any further deposition of Lisa M. Morgan to six hours (one day) to be held in Florida. A copy of that Order ~~ is attached as Exhibit B. 4. Pursuant to Judge Oler's Order of Court October 3, 2007, the deposition or further of Lisa M. Morgan was to be completed before November 22, 2007. A copy of that Order is attached as Exhibit C. 5. Counsel for the Executrices sent a Notice to Robert M. Mumma, II that the deposition of Lisa M. Morgan was being taken on November 12, 2007, in Florida, and that he was invited to attend and participate. A copy of said Notice is attached as Exhibit D. 6. Although being served with notice at three (3) addresses of record, Robert M. Mumma, II did not attend the deposition on November 12, 2007. 7. The Court had set a discovery deadline in this matter for May 31, 2008. 8. On or about May 2, 2008, Robert M. Mumma, II served a Notice of Deposition for Lisa M. Morgan to take place on May 15, 2008. 9. On May 6, 2008, the Executrices filed an Emergency Motion for Protective Order similar to this Motion, based on the prior Orders relating to any further deposition of Mrs. Morgan. 10. On May 12, 2008, the Court entered an Order issuing a Rule, returnable in 10 days, staying the discovery, and referring the matter to the Auditor for a brief interim report and recommendation. A copy of that Order is attached hereto as Exhibit E. 11. No response was filed pursuant to the Rule issued on May 12, 2008. 12. The Executrices again seek a Court Order for protection for Mrs. Morgan. 13. Robert M. Mumma, II has taken many hours of deposition of Mrs. Morgan, and he failed to appear for the last deposition that was approved by the Court with certain parameters. 2 14. It is clear that Robert M. Mumma, II has had the opportunity to depose Mrs. Morgan in depth and, in fact, has deposed her numerous times. Indeed, Mrs. Morgan testified at the January 25, 1989, hearing on Mr. Mumma, II's prior motion to disqualify Morgan Lewis. With regard to the scope of that hearing and the Court's opinion issued following it, Mrs. Mumma and Mrs. Morgan incorporate herein their answer and new matter to Mr. Mumma, II's motion for disqualification. 15. The Notice purportedly was served in connection with this Court's August 28, 2008, Order regarding Mr. Mumma, II's Motion to Disqualify Counsel for Mrs. Mumma and Mrs. Morgan. 16. On September 25, 2008, counsel for Mrs. Morgan, in response to correspondence from James G. Gault, Esquire, a lawyer purporting to act on behalf of Mr. Mumma, II, sought clarification as to what testimony was sought from Mrs. Morgan. The request pointed out that "[t]he allegations in Mr. Mumma's motion are focused upon (a) work performed by Morgan Lewis for Mr. Mumma, II and (b) positions taken by Morgan Lewis, on behalf of Mrs. Mumma and Mrs. Morgan, in various litigation matters." Because the former is utterly outside the personal knowledge of Mrs. Morgan, and the latter are a matter of public record through filings, hearings, etc., it is difficult to imagine what testimony of relevance Mr. Mumma, II might seek to elicit from Mrs. Morgan. 17. The September 25 correspondence requested that Mr. Gault contact Mrs. Mumma and Mrs. Morgan's counsel to discuss the requested depositions to see if there were grounds for agreement. 3 18. Neither Mr. Mumma, II nor Mr. Gault responded to the September 25 correspondence. 19. The history of this and other related cases demonstrates the need for a Protective Order, and it is not likely that Mr. Mumma, II would limit any deposition of Mrs. Morgan to any specific matter or subject. 20. Judge Oler has ruled on previous issues in this case. 21. This Motion is being sought in an expedited, emergency fashion and concurrence of Robert M. Mumma, II, has not been sought, however it is not likely he would concur. WHEREFORE, the Executrices respectfully request that the Court enter a Protective Order that Lisa M.
