T.F. PROPANE, INC., Defendant IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY_PENNSYLVANIA CIVIL ACTION-LAW COMPLAINT 1. The Plaintiff is American Welding & Tank, a division of HARSCO Corporation, a corporation organized and existing under the laws of the state of Delaware, with an address of P.O. Box 8870, Camp Hill, Cumberland County, Pennsylvania 17001-8870. 2. The Defendant is T.F. Propane, Inc. is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, with an address of 101 First Avenue, Collegeville, Montgomery County, Pennsylvania 19426. 3. On or about October 17, 2000, and again on November 22, 2000, the Defendant ordered from the Plaintiff certain propane tanks of various sizes as more particularly set forth in the attached invoices marked as Exhibits "A" and "B". 4. The Defendant agreed to pay the prices quoted by the Plaintiff at the time of the orders. 5. The Plaintiff shipped the aforementioned propane tanks to the Defendant on or about November 4, 2000 and November 27, 2000, as reflected on Exhibits "A" and "B".. 6. The Plaintiff invoiced the Defendant for the purchase price of the tanks on November 6, 2000, and November, 27, 2000 for $10,351.00 and $472.00 respectively, for the total amount of $10,823.00. 7. The Defendant has failed to make any payments on the account since that date, and despite demand, the Defendant continues to refuse to pay the amount due. 8. Pursuant to the invoice terms, the payment was to be made within 45 days, and thereafter interest would accrue at the rate of I percent (1%) per month. 9. The Defendant is in default under its contract with the Plaintiff as aforesaid. WHEREFORE, the Plaintiff requests this Honorable Court to enter judyx~ent in favor of the Plaintiff and against the Defendant in the amount of $10,823.00, plus interest at the rate of I percent per month, and cost of suit.
