Stoneroad, of Keystone Guardianship Services, of the above-captioned incapacitated individual and petitions as follows: 1. Keystone Guardianship Services was appointed Guardian for Janette Neely, an alleged incapacitated person by the Cumberland Country Orphan's Court by order dated March 5th 2008(see copy of Order attached as Exhibit "A"). 2. Janette Neely is presently a resident of Country Meadows located at 451 Sandhill Road, Hershey, Dauphin County Pennsylvania 17033. 3. Keystone Guardianship Services has been working on selling the real estate owned by Janette Neely in order to have funds readily available for her personal and medical care, as well as continual real estate maintenance. 4. Janette Neely is the sole owner of a piece of real estate known as 153 Center Street, Herndon, Northumberland County, Pa. 17830 (Parcel 23-00-001-101). 5. Keystone Guardianship Services requested and received an Order dated May 30, 2008, allowing the sale of the above described real estate for no less than $30,000.00. (see copy of Order attached as Exhibit "B"). Page 1 of 3 Pages Estate Janette Neely An Incapacitated Person 6. Since the date of the Order, Keystone Guardianship had no offers on the property. We made the assumption at the beginning of this Guardianship and that assumption appears to be true, that it would be difficult to sell the above captioned real for anything close to the appraised value because of the following: a. The general local opinion is that when living in the town of Herndon it is less desirable to live on the main street of Herndon, PA.; and, b. the property is located on the main street of Herndon which is known as Route 147 and the only access road available to pass through the town; and c. there is no off street parking for this real estate; and, d. there is no right of way to the rear of the property; and e. the property. was completely gutted with rafters being the only type of division in the property; 7. This real estate was first listed for sale with Century 21 - Carl Snyder, Carmen Villarose, 3703 Peters Mountain Road, Halifax, PA 17032 for $44,900.00 with consent for negotiations to $30,000.00. 8. In the last nine months 'the guardian has had repeated calls from a neighbor complaining of the condition of the real estate, namely the condition of the back yard including the partially removed tree. However the. only offer to buy the property was. received on December 12, 2008. 10. An offer of $11,000.00 has been made on the property, (see copes of offer attached as Exhibit "C"). This offer will net out between Eight Thousand ($8,000) and Nine Thousand ($9,000) Dollars. 11. Keystone Guardianship Services is requesting your consideration to approve the sale of this property in order to prevent the need for any further outlay of cash for upkeep and or maintenance. WHEREFORE, the aforementioned guardian respectfully requests this Honorable Court enter an Order directing the sale of the real estate known as 153 Center Street, Herndon, Northumberland County, Pa. 17830 (Parcel 23-00-001-101) owned by Janette Neely for the amount of $12,400.00 minus the normal expenses of selling real estate.
